Kentucky's BCBS plan is Anthem Blue Cross and Blue Shield of Kentucky, operated by Elevance Health (formerly Anthem Inc., formerly WellPoint). Anthem BCBS Kentucky held approximately 70% of Kentucky's commercial health insurance market during the class period — one of the highest carrier concentrations in the nation. The American Medical Association has repeatedly flagged Kentucky as one of the top-10 least competitive health insurance markets in the US.
If you paid premiums to Anthem BCBS Kentucky between February 7, 2008 and October 16, 2020 (fully insured) or September 1, 2015 and October 16, 2020 (self-funded), and filed a valid claim by November 5, 2021, you may be entitled to a substantial payment.
Why Kentucky Payouts May Be Higher Than Average
Kentucky's health insurance market was exceptionally concentrated during the class period. Anthem Blue Cross and Blue Shield operated with near-monopoly dominance across much of the state, particularly in rural areas where no competing Blue plan existed.
Higher market concentration typically correlates with longer subscriber tenure, higher cumulative premiums paid, and therefore higher individual settlement allocations. Long-tenure claimants (12+ years, higher premiums) reach the $1,300 ceiling.
Anthem Blue Cross and Blue Shield of Kentucky
The Kentucky Blues plan is operated by Anthem Health Plans of Kentucky, Inc., doing business as Anthem Blue Cross and Blue Shield of Kentucky. Anthem is a subsidiary of Elevance Health (formerly Anthem, Inc., and prior to 2012, WellPoint, Inc.). During the class period (2008–2020), Anthem was the dominant insurer across individual, small group, and large group markets in Kentucky.
Coverage through Anthem BCBS Kentucky's fully-insured commercial plans during 2008–2020 qualifies for the Subscriber settlement. Self-funded employer plans qualify for the separate September 2015-October 2020 window.
Kentucky 2026 Distribution Status
Kentucky claimants are in the standard 2026 distribution wave. Settlement notices appeared in the Louisville Courier-Journal and Lexington Herald-Leader, Kentucky's largest daily newspapers. Digital notices also appeared through employer HR channels for group plan members.

Kentucky-Specific Exclusions
- Kentucky Employees' Health Plan (KEHP) — covers state employees, teachers, and their dependents. Administered by the Kentucky Department of Employee Insurance. Government account, explicitly excluded.
- Kentucky Retirement Systems (KRS) retiree health plans — government-administered retiree coverage, excluded.
- Kentucky Medicaid managed care through Anthem — government program, excluded.
- Federal Employee Health Benefit Program (FEHBP) — separate federal carve-out, excluded.
- Medicare Advantage plans through Anthem KY — excluded. Medicare Supplement (Medigap) DOES qualify.

I work for the state of Kentucky and had Anthem through KEHP. Am I eligible?
<strong>No.</strong> The Kentucky Employees' Health Plan (KEHP) is a government-administered account and is explicitly excluded from the settlement class. State employees, public school teachers, and their dependents covered through KEHP are not entitled to a settlement payment, regardless of whether Anthem BCBS administered the plan.
I'm a retired Kentucky state employee with health coverage through KRS. Can I file a claim?
Kentucky Retirement Systems (KRS) retiree health plans administered as government accounts are excluded from the settlement. If your retiree coverage was provided through a KRS government account, you are not a class member. However, if you also held a separate, privately purchased Anthem BCBS policy during the class period, that coverage may qualify independently.
How much can Kentucky residents realistically expect to receive?
Kentucky's high market concentration (~70%) means payouts above the national average ($333). Short-tenure or low-premium claimants land in the $500–$700 range.
Anthem is now Elevance Health. Does that affect my claim?
<strong>No.</strong> Elevance Health is the current parent company of Anthem Blue Cross and Blue Shield of Kentucky, formerly operating as Anthem, Inc. and WellPoint.
