Philips CPAP Recall MDL 3014
Philips Respironics DreamStation, System One, and BiPAP machines contained polyester-based polyurethane (PE-PUR) foam for sound dampening. The foam degraded and off-gassed volatile organic compounds + carcinogens — diethylene glycol, phenol, diisocyanate — that users inhaled during sleep.
$1.1 billion global settlement approved April 2024: $1.075B personal injury + $25M medical monitoring. 58,000+ claimants in active payout phase as of January 2026. Points-based allocation through Special Master system.
However, 621 individual trial cases remain in the MDL for plaintiffs who did NOT join the global settlement. No individual trial verdicts yet. If you have lung cancer, head/neck cancer, or severe pulmonary disease linked to Philips device use, evaluate whether to accept settlement tier vs pursue individual trial (opt-out decision irrevocable).
Philips CPAP Lawsuit FAQs
Was my device recalled by Philips?
Check serial number at philips.com/recallnotice or W.D. Pa. settlement website. Recalled models: DreamStation 1, System One (REMstar), A-Series BiPAP, certain ventilators. If your device is in the recall, you're likely eligible.
What injuries qualify for the Philips CPAP settlement?
Settlement tiers: Minor respiratory irritation (no diagnosis) $7,500-$15,000; Significant documented respiratory illness $15K-$75K; Serious pulmonary conditions (COPD exacerbation, fibrosis) $75K-$200K; Lung/head/neck/respiratory cancer $200K-$500K+ (final methodology not public).
What cancers qualify for the highest tier?
Lung cancer, throat cancer, tracheal cancer, nasal cancer, and other respiratory-tract cancers with documented CPAP use history. Must have diagnosis linking to device use (timing + exposure). Medical records + pathology + device prescription records required.
When will I receive my Philips CPAP settlement payment?
High-tier cancer payouts expected Q4 2026. Lower tiers already paying. Total distribution staged through 2026-2027. Check the official settlement website for your claim's status.
Do I need to have the physical CPAP machine?
No — serial number OR prescription/DME records are sufficient. Physical device not required. If you replaced your machine, the original serial number + pharmacy records establish use.
I already filed a property damage claim — does that affect my personal injury claim?
No. The $25M property/device replacement fund is separate from the $1.075B personal injury fund. You can claim both if eligible for both.
If I joined the settlement, can I still sue Philips separately?
No — participation in the global settlement releases all personal injury claims. If you have severe injuries (cancer, severe respiratory disease), consider consulting attorney about opt-out BEFORE accepting settlement — some plaintiffs chose opt-out to pursue individual trials for higher recovery.
What's the statute of limitations for Philips CPAP claims?
Typically 2-3 years from date of injury discovery, or from the June 2021 recall announcement (whichever is earlier, varies by state). Many states' SOL has run for earliest diagnoses — consult immediately. Discovery rule may extend for recently-diagnosed cancer linked to device use.
