Highmark BCBS WV holds the largest share of West Virginia's commercial health insurance market, with more West Virginians carrying a BCBS card than any other carrier in the state.

West Virginia residents who held Highmark Blue Cross Blue Shield of West Virginia commercial coverage between February 7, 2008 and October 16, 2020 were eligible to file a claim by November 5, 2021. The acquisition by Highmark brought it under the Highmark family of plans, which also includes Highmark Blue Cross Blue Shield (Pennsylvania), Highmark Blue Shield, and several other regional BCBS licensees.

Highmark BCBS WV serves approximately 300,000 members in West Virginia through fully insured commercial plans and provides administrative services to self-funded employers. The plan maintains contracts with the substantial majority of West Virginia hospitals and physicians, including the West Virginia University Health System. Because the licensee underwent a name and ownership change in 2015 (Mountain State BCBS to Highmark BCBS WV), claimants with coverage in both eras are covered under a single claim. West Virginia-Specific Exclusions

  • PEIA (Public Employees Insurance Agency) — PEIA provides health, life, and other insurance benefits to West Virginia state employees, teachers, and their dependents. As a state government agency administering a government account, PEIA participants whose only BCBS-administered coverage was through PEIA are excluded from the settlement class.
  • West Virginia Medicaid (Mountain Health Trust / Managed Care) — Medicaid coverage is not a commercial health benefit product and is excluded. Medicaid-only enrollees are not eligible.
  • Medicare Advantage plans — Medicare Advantage policies are excluded. Medicare Supplement (Medigap) policies are included if they meet the class period criteria.
  • The Health Plan coverage — The Health Plan is not a BCBS licensee. West Virginia residents who held only The Health Plan coverage during the class period are not eligible for this settlement.
  • Highmark Health Options West Virginia (Medicaid) — Highmark's Medicaid managed care product in West Virginia is distinct from its commercial BCBS plans. Medicaid enrollment does not qualify for the settlement, even though it carries the Highmark brand.
  • Self-funded employer plans before September 1, 2015 — The Tier-3 class period begins September 1, 2015. West Virginia employers using Highmark BCBS WV ASO contracts before that date are not covered for the earlier portion of the class period.

I had The Health Plan coverage in West Virginia — does that qualify for the BCBS settlement?

<strong>No.</strong> The Health Plan (headquartered in Wheeling, WV) is an independent regional nonprofit insurer and is not a member of the Blue Cross Blue Shield Association. It is not a settling defendant. Only West Virginians who held <em>Blue Cross and Blue Shield-branded</em> coverage — specifically from Highmark Blue Cross Blue Shield West Virginia (or its predecessor, Mountain State Blue Cross Blue Shield) — during the class period are eligible.

I am a West Virginia state employee or teacher covered by PEIA — am I excluded?

Generally, <strong>yes</strong>. The <strong>Public Employees Insurance Agency (PEIA)</strong> is a government account operated by the State of West Virginia, and government accounts are excluded from the settlement class.
