Key Findings: Chicago Police Misconduct Data

Chicago’s police misconduct settlement costs are extraordinary both in absolute terms and on a per-case basis. The city’s 4,974 settlements totaling $1.16B produce an average payout of $232K — more than 3x the NYC average of $68K per police misconduct case.

The median of $9K is significantly lower than the average, indicating extreme right-skew: a relatively small number of million-dollar-plus settlements drive the average far above what most individual claimants receive. This pattern is consistent with police misconduct litigation where wrongful conviction and officer-involved shooting cases produce very large payouts.

On a per-capita basis, Chicago’s police settlement costs are among the highest in the nation. With a population of approximately 2.7 million, the city has paid roughly $428 per resident in police misconduct settlements — a significant burden on city finances.

High-profile cases have driven much of the cost. The Laquan McDonald shooting settlement ($5M, paid before the dashcam video was released), the Jon Burge torture cases (which collectively cost the city over $100M in settlements and reparations), and numerous wrongful conviction exonerations have all contributed to the total.

Why Chicago Pays More Per Case

Chicago’s average police misconduct settlement ($232K) is 3.4x higher than New York City’s ($68K), despite NYC having a much larger police force. Several factors explain this:

  • Wrongful convictions: Chicago has one of the highest rates of wrongful conviction exonerations in the U.S. Cases involving decades of wrongful imprisonment routinely settle for $5M–$20M+.
  • Jon Burge torture legacy: Former CPD Commander Jon Burge and officers under his command tortured over 100 suspects between 1972 and 1991. The resulting lawsuits, exonerations, and reparations fund have cost the city over $100 million.
  • Consent decree costs: Following the DOJ investigation into CPD practices (2017), the city entered a consent decree that increased accountability but also increased settlement pressure.
  • Illinois tort law: Illinois does not cap damages in civil rights cases, allowing juries and settlement negotiations to reflect the full scope of harm — unlike some states with damage caps.

Impact on Chicago’s Budget

The financial burden of police misconduct settlements on Chicago taxpayers is substantial. The city has historically spent $50M–$100M+ per year on police-related legal costs, including settlements, judgments, and legal fees.

Unlike some cities that fund settlements from general revenue, Chicago has used bond financing to pay for large settlements, spreading the cost over decades but adding interest. A 2016 analysis found the city had issued $684 million in bonds to cover police settlement costs, paying an estimated $1 billion with interest over the life of those bonds.

These costs are ultimately borne by taxpayers through property taxes, reduced city services, and long-term debt obligations. Reform advocates argue that the settlement costs alone justify significant changes to policing practices and accountability structures.
