Cymbalta Lawsuit: The Generic Duloxetine Settlement and the 2026 Recalls

Most people searching for a Cymbalta lawsuit right now are looking for one case: Boyer v. Breckenridge Pharmaceutical. It is a settled federal class action over generic duloxetine. It is not about Eli Lilly's brand-name Cymbalta. The main claim deadline was December 27, 2025. A separate refund program covers Breckenridge duloxetine recalled after May 22, 2025, and runs until at least January 1, 2028. New recalls in April and June 2026 put the program back in the news.

What the Cymbalta Class Action Lawsuit Was About
Duloxetine is the generic name for Cymbalta. Breckenridge Pharmaceutical distributes a generic version made by Towa Pharmaceutical Europe in Spain. The lawsuit alleged that Breckenridge did not tell buyers its duloxetine contained too much N-nitroso-duloxetine (NDLX). NDLX is a nitrosamine impurity, and the complaint called it a substance that can allegedly cause cancer under certain circumstances.
The claim was purely economic. The plaintiff alleged the pills were worthless, or worth less than what she paid. Breckenridge denies the allegations. The settlement covers economic loss only. It does not cover any illness.
The older Cymbalta class action is a different case. Between 2012 and 2017, users sued Eli Lilly, alleging that the brand-name label understated withdrawal symptoms. That class case failed (see the timeline below).
Case Details
Generic duloxetine: Boyer v. Breckenridge Pharmaceutical, Inc., No. 2:24-cv-06514-JKS-JBC, in the U.S. District Court for the District of New Jersey. It was filed May 29, 2024. The court granted preliminary approval on May 22, 2025 and final approval on September 23, 2025.
Brand-name Cymbalta withdrawal: Saavedra v. Eli Lilly and Company, No. 2:12-cv-09366, was filed October 31, 2012 in the Central District of California before Judge Stephen V. Wilson. A related individual case was Hexum v. Eli Lilly and Company, No. 2:13-cv-02701. The Ninth Circuit appeal was Strafford v. Eli Lilly and Company, No. 15-56808.
Status: Settled — Main Deadline Passed, Refund Program Open
The part that is still open is the Breckenridge Future Refund Program. It covers Breckenridge duloxetine recalled after May 22, 2025, and it runs until at least January 1, 2028. That matters because the FDA has listed more recalls since then. In 2026 alone there were three: D-0522-2026 (initiated April 21, 2026, 165,761 bottles), D-0583-2026 (initiated June 4, 2026, 359,676 bottles) and D-0582-2026 (initiated June 4, 2026, 14,729 bottles). All are Class II. Details are on the official site, BreckenridgeFutureRefundProgram.com.
There is no open lawsuit against Cymbalta's brand-name maker, Eli Lilly, that you can join. We found no court record of a new class action over the 2026 recalls.
Who Is Covered
Settlement class (now closed for claims): people in the United States who bought Breckenridge duloxetine between August 4, 2020 and May 22, 2025. Court papers estimate about four million class members. You had to have paid something out of pocket. If insurance covered the full cost, you were not eligible for cash.
Future Refund Program (open): purchases of Breckenridge duloxetine from a lot recalled after May 22, 2025.
How to tell if your pills qualify: the bottle label or your pharmacy record shows the distributor (Breckenridge, NDC beginning 51991), the lot number and the expiration date. The 2026 lots include 241069C, 241074C and 241180C. Other manufacturers' duloxetine and Lilly's brand-name Cymbalta are not covered.
What the Cymbalta Settlement Pays
$5 — one payment for buying Breckenridge duloxetine that was not recalled.
$7.50 — one payment if your duloxetine came from a recalled lot.
$10 per prescription — for recalled prescriptions you could not use because of a recall that began before May 22, 2025.
Every tier required proof, such as a pharmacy receipt or records. The recall tiers also needed the lot number, or the NDC and expiration date. There is no payment for illness, and the settlement does not release personal-injury claims. Breckenridge also pays administration costs and the court-approved attorneys' fees on top of the claims.
How cases like this one end
Our copy of the federal courts’ own case database covers 166,050 health care/pharmaceutical product liability casesclosed in U.S. federal district courts between 2015 and 2025:
- 34.5% ended in a settlement recorded by the court. Another 17.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 34.5% and 52.4%.
- 9% were decided on a motion before any trial.
- 1 in 2,863 reached a trial (0%), after a median of 32 months.
- Median time from filing to the end of the case: 26.3 months.
- Almost none record a money award in this data (18 of 166,050), and the recorded figures are capped, so we do not publish an average.

Three Things to Watch For
News of a recall, a settlement and a refund program creates easy openings for impostors:
“Late claim” offers for the Boyer settlement
The main claim deadline was December 27, 2025. Anyone offering to “reopen” or speed up your claim for a fee is not part of the settlement. The administrator never charges a fee.
Cancer-lawsuit ads using the recall
The settlement covered money only, not illness. The FDA rated these recalls Class II, meaning the chance of serious harm is remote. An ad promising large payouts for taking recalled duloxetine is advertising, not a court notice.
Lookalike refund sites
The only official sites are BoyerSettlement.com and BreckenridgeFutureRefundProgram.com. Be wary of any site that asks for your Social Security number or bank login just to check a lot number. Returned pills go to the address given in the instructions, not to a stranger.
Cymbalta Lawsuit — Questions People Actually Ask
Is there a Cymbalta class action lawsuit right now?
Not against Eli Lilly. The current Cymbalta class action lawsuit people mean is Boyer v. Breckenridge, about generic duloxetine. It settled, and the court gave final approval on September 23, 2025. Its main claim deadline, December 27, 2025, has passed. The Future Refund Program remains open until at least January 1, 2028.
Can I still file a Cymbalta settlement claim?
Not in the main settlement. That closed on December 27, 2025. If you bought Breckenridge duloxetine from a lot recalled after May 22, 2025, including the 2026 recalls, you can ask for a refund through the official Future Refund Program. Keep your pharmacy records and the bottle.
Is there a class action lawsuit Cymbalta users can join over withdrawal symptoms?
No. The withdrawal class action against Eli Lilly, Saavedra (No. 2:12-cv-09366), was denied class certification on December 22, 2014. The Ninth Circuit dismissed the class appeal on October 12, 2017. The JPML also twice refused to combine the federal withdrawal cases. Individual cases went forward one at a time.
Was there a lawsuit against Cymbalta for causing cancer?
Not in the way the ads suggest. The Boyer case alleged that generic duloxetine contained too much NDLX, a nitrosamine. It sought money back, not damages for illness, and the settlement covers economic loss only. The FDA says nitrosamines may raise cancer risk above acceptable levels over long periods of time.
Which duloxetine was recalled in 2026?
These are Breckenridge-distributed capsules made by Towa: lot 241069C (60mg, April 21, 2026), lot 241180C (30mg, June 4, 2026), and a batch of 60mg lots including 241074C (June 4, 2026). Ask your pharmacist to check your NDC and lot. Do not stop taking duloxetine without talking to your prescriber.
How much did the settlement pay?
$5 for a purchase that was not recalled, $7.50 for a recalled purchase, or $10 per prescription you could not use because of a recall. You had to provide proof and could choose only one tier.
I got a letter about the Boyer settlement. Is it real?
The settlement is real, and its official contact number is 1-833-688-8988. Check any letter against BoyerSettlement.com before replying. Be suspicious of any message that asks for a fee or for full financial logins.
Does the settlement stop me from suing over an illness?
No. The class gave up economic-loss claims about Breckenridge duloxetine bought between August 4, 2020 and May 22, 2025. Personal-injury claims were not part of the settlement. A licensed attorney can tell you whether you have one.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
