Nebraska is one of the most Blue Cross Blue Shield–concentrated states in the country. Blue Cross and Blue Shield of Nebraska (BCBSNE) — an independent licensee headquartered in Omaha — held approximately 86% of Nebraska's commercial insurance market and 76% of the state's PPO market during the 2008–2020 class period. The American Medical Association ranked Nebraska the 10th least-competitive state health insurance market in the country.

That near-monopoly concentration is precisely what drove the antitrust harm alleged in the $2.67 billion class action — and it is what places Nebraska subscribers well above the national average payout.

Why Nebraska Payouts Are in the Top Tier

The settlement formula incorporates a state-specific multiplier that reflects how dominant the local BCBS plan was. With BCBSNE controlling roughly 86% of the commercial insurance market across Nebraska's 93 counties, the state faced virtually no competitive pressure from alternative carriers for the majority of the class period.

A Tier-1 individual with 10–12 continuous years of BCBSNE fully-insured coverage and moderate annual premiums ($4,500–$7,500/year) can expect payouts in the $900–$1,300 range. Claimants with shorter tenure or lower premium histories cluster in the $700–$900 range.

Blue Cross and Blue Shield of Nebraska (BCBSNE)

The sole BCBS licensee in Nebraska is Blue Cross and Blue Shield of Nebraska, founded in 1939 and headquartered in Omaha. It is an independent licensee of the Blue Cross Blue Shield Association — not affiliated with Anthem or Elevance Health.

In July 2018, BCBSNE underwent a corporate restructuring: the organization formed GoodLife Partners Inc. as a mutual holding company while converting from mutual ownership to a stock company wholly owned by GoodLife. Despite this restructuring, the insuring entity remained the same BCBS licensee throughout the class period, and its policies are fully covered by the Subscriber settlement.

Nebraska 2026 Distribution Status

Nebraska claimants are included in the standard national Tier-1 distribution wave. JND Legal Administration began distributing initial payments on May 11, 2026. Payments are being issued as paper checks or prepaid Visa debit cards.

Local Nebraska media coverage of the distributions has appeared in the Omaha World-Herald and the Lincoln Journal Star, the state's two largest daily papers.

Nebraska-Specific Exclusions

  • Nebraska state employee health plans — Coverage provided through Nebraska state government accounts is government-funded and excluded.
  • NPERS (Nebraska Public Employees Retirement System) retiree health benefits — government-sponsored account excluded.
  • Nebraska Medicaid Managed Care — any BCBSNE-administered Medicaid managed care products are government-funded programs and excluded.
  • Medicare Advantage plans through BCBSNE — excluded. Medicare Supplement may qualify partially.
  • Federal Employee Program (FEP) BCBS — separate carve-out excluded from the Subscriber settlement.
  • Self-funded employer plans before September 2015 — eligible only for the separate $120M self-funded pool from September 2015 onward.

I was a Nebraska state employee with BCBSNE coverage — am I excluded?

<strong>Almost certainly yes</strong> for coverage tied to your state employment. Nebraska state government health plans are government accounts — explicitly excluded from the Subscriber settlement damages class. However, if you separately purchased a personal fully-insured BCBSNE plan outside of state employment during 2008–2020, that personal coverage may qualify independently.

Why is BCBSNE not part of Anthem — and does that affect my payout?

Blue Cross and Blue Shield of Nebraska is an <strong>independent BCBS Association licensee</strong> — entirely separate from Anthem (Elevance Health).
