New Jersey's 2019 Sexual Abuse Reform

New Jersey overhauled its sexual abuse civil law in 2019 with P.L. 2019 c.120 (S477), signed by Governor Murphy on May 13, 2019. The reform did three things: (1) extended the childhood abuse SOL to age 55 (or 7 years from discovery, whichever is later); (2) extended the adult SOL to 7 years with discovery rule; (3) opened a two-year revival window from December 1, 2019 to December 1, 2021 for previously time-barred childhood claims. The window is now closed, but the extended deadlines remain.

The major landmark case out of NJ is the Diocese of Camden $180 million settlement (February 2026), covering approximately 300 victims — initially announced at $87.5M in 2022/2024 and finalized at $180M after renegotiation. The NJ Attorney General's office continues investigating all five dioceses (Camden, Newark, Paterson, Metuchen, Trenton) for ~200 credibly accused clergy.

No adult revival window exists as of April 2026. Advocates have lobbied for a NJ equivalent of New York's Adult Survivors Act, but no legislation has passed. If you are an adult survivor whose 7-year SOL (with discovery rule) has expired, your options are limited unless new legislation is enacted.

New Jersey's Sexual Abuse Revival Window

NJ ran one revival window (childhood only, closed 2021). Even without an open window, the extended SOL remains generous — here's what applies:

New Jersey Statute of Limitations — Current Rules

Childhood sexual abuse (under 18 at the time): Under N.J.S.A. § 2A:14-2a (P.L. 2019 c.120, effective December 1, 2019), survivors may file until the later of: (a) age 55 (37 years after reaching majority at 18), OR (b) 7 years from discovery of injury causally linked to abuse. The discovery rule is applied robustly — NJ courts look to when the survivor reasonably connected psychological harm to the abuse. Even if you are over 55, a recent discovery may revive the claim.

Adult sexual abuse (18+ at the time): 7 years from the last act of sexual abuse under N.J.S.A. § 2A:14-2a. The 7-year discovery rule also applies — runs from when the victim reasonably discovered injury and its causal link to the abuse. This is more generous than New York's 20-year clock from the act (no discovery) because NJ's discovery rule can substantially extend the filing deadline for adult victims with delayed psychological recognition.

Damage Caps in New Jersey Sexual Abuse Cases

NJ has no cap on compensatory damages (economic + non-economic) in sexual abuse civil cases. Punitive damages are capped at the greater of $350,000 or 5× compensatory damages under N.J.S.A. § 2A:15-5.14. There is no MICRA-equivalent reduction. The NJ Tort Claims Act (N.J.S.A. § 59:1-1 et seq.) imposes notice-of-claim requirements and some limitations on claims against public entities — consult an attorney for public-defendant-specific analysis.

Institutional Liability: Why the Real Money Is There

Individual abusers often have limited assets. Institutional defendants (churches, schools, organizations) have deep pockets AND legal liability for enabling abuse. Understanding institutional liability theories explains the massive recoveries.

Negligent hiring

Negligent hiring: Institution hired an abuser despite red flags (prior complaints, criminal history, industry warnings). Liable for inadequate background checks and ignoring references.

Negligent supervision

Negligent supervision: Institution failed to supervise the abuser appropriately given their role and contact with vulnerable populations. Applies to teachers, clergy, coaches, caregivers.

Negligent retention

Negligent retention: Institution kept the abuser on staff after learning of concerning behavior. This is the 'priest shuffle' theory — moving abusers between locations without action.

Respondeat superior

Respondeat superior: Employer is vicariously liable for employee acts committed in the course of employment. Narrower for intentional acts but still applies to many abuse scenarios.

Breach of fiduciary duty

Breach of fiduciary duty: Special relationships (clergy-parishioner, teacher-student, counselor-client) create heightened duties. Breach creates liability beyond negligence.

Fraudulent concealment

Fraudulent concealment: Institution actively hid the abuse from law enforcement, new victims, or parents. Often unlocks punitive damages and extends SOL (the clock starts from discovery of concealment).

The 2019–2021 NJ revival window is closed. Can I still sue?

Possibly yes. The extended SOLs remain in force. Childhood abuse: file until age 55 OR 7 years from discovery (whichever is later). Even if you are over 55, a recent discovery of psychological injury causally linked to the abuse can revive the claim under N.J.S.A. § 2A:14-2a. Adult abuse: 7 years from the last act OR 7 years from discovery. Consult an attorney immediately to evaluate whether your facts fit — NJ's discovery rule is generously applied and many survivors who believe they are time-barred actually qualify.

What is the NJ discovery rule for sexual abuse?

NJ courts apply a robust discovery rule: the SOL clock starts when the victim reasonably discovered the injury AND its causal link to the abuse. For childhood abuse where the survivor repressed memories, the clock may not start until the memories resurface. For adult survivors who did not connect psychological symptoms (PTSD, depression) to the abuse until years later, the 7-year clock starts from that discovery. Medical/psychological documentation of when the discovery occurred strengthens the claim. The rule is codified at N.J.S.A. § 2A:14-2a and interpreted generously in NJ Supreme Court jurisprudence.

Is there a NJ adult sexual abuse revival window coming?

Not as of April 2026. Advocates have lobbied for a NJ equivalent of New York's Adult Survivors Act, and there has been legislative discussion, but no bill has been enacted. Do not assume a future window will revive your claim. If your 7-year adult SOL (with discovery rule) has expired, your options are limited to: (1) waiting for legislation (uncertain timing), (2) exploring federal claims if applicable, (3) joining multi-plaintiff cases against institutional defendants in other states if the defendant operated across state lines.

How much are New Jersey sexual abuse settlements worth?

The Diocese of Camden final settlement of $180M for approximately 300 victims averages ~$600K per survivor. Individual severity varies significantly — some claimants received closer to $250K, while severely abused survivors with strong cover-up evidence received $1M–$3M. Contested institutional cases that go to trial have produced verdicts exceeding $5M. Four other NJ dioceses (Newark, Paterson, Metuchen, Trenton) have not yet reached global settlements; case values there remain to be determined. Which NJ dioceses are still in settlement negotiations?

As of April 2026: Camden ($180M final, February 2026). Newark: in ongoing investigation, no global settlement. Paterson: investigation open. Metuchen: investigation open. Trenton: investigation open. The NJ Attorney General's office is conducting a statewide grand jury investigation into all five dioceses for approximately 200 credibly accused clergy. New individual plaintiffs against the non-Camden dioceses may benefit from filing during active investigation periods when documents are being produced.
