I had Tufts Health Plan or Harvard Pilgrim — am I eligible?

No. Tufts Health Plan and Harvard Pilgrim Health Care are not members of the Blue Cross Blue Shield Association and are not defendants in this antitrust case. Only coverage through Blue Cross Blue Shield of Massachusetts (BCBSMA) during 2008–2020 qualifies.

I got insurance through Romneycare or the ACA marketplace in Massachusetts — does it count?

Yes, if your marketplace plan was issued by Blue Cross Blue Shield of Massachusetts. The plan issuer is listed on your insurance card and benefits booklet. If BCBSMA issued the fully-insured policy — even through the Health Connector — it qualifies for the class period.

I'm a Massachusetts state employee covered through the GIC — do I qualify?

Generally no. The Group Insurance Commission (GIC) administers a self-insured program for Massachusetts state employees, where BCBSMA acts as a third-party administrator rather than the insurer. Self-insured arrangements are excluded from the Subscriber damages portion of the settlement.
