How Much Is My Workers’ Comp Case Worth?

Workers’ comp valuation differs from personal injury in fundamental ways — capped by statute, no pain-and-suffering multiplier, no juries. Here’s how it actually works.

The Workers’ Comp Formula (Simplified)

FAQs

What's the average workers' comp settlement amount?

Hugely variable by injury and state. Median lump-sum settlements: $5K–$25K for minor injuries (sprain, minor burn), $40K–$100K for documented surgical cases (rotator cuff, meniscus), $150K–$500K+ for permanent impairments. Catastrophic injuries reach seven figures, especially combined with third-party suits.

How is the weekly TTD rate calculated?

Average Weekly Wage (AWW) × benefit percentage. Most states use 66⅔% of AWW. Some use 80% of spendable (post-tax) earnings (CT, MI, IA, RI). NJ uses 70%; MA uses 60%. AWW is usually the 52 weeks of earnings before the injury, including overtime and tips.

What's a 'scheduled loss' and how is it valued?

Most states publish a schedule of weeks payable for specific body-part losses (e.g., loss of a hand might be 200 weeks). Your benefit = weeks × your TTD rate × your impairment percentage. Example: 200 weeks × $1,000/week × 15% impairment = $30,000 PPD benefit. Different from non-scheduled losses (back, spine, brain) which use a state-specific formula factoring AWW, age, and rating.

Can I get more than just workers' comp?

Yes — through third-party liability claims. WC bars suing the employer, but you can usually sue equipment manufacturers, subcontractors, drivers, premises owners, and toxic-exposure defendants. Third-party recoveries often dwarf the WC benefit. Construction injuries, vehicle-related work injuries, and toxic-exposure cases are the most common third-party scenarios.

Should I take a lump-sum settlement or keep weekly benefits?

Depends on your situation. Compromise & Release (C&R) = lump sum, closes the case (including future medical). Good if you're at MMI and need cash, or if you're done dealing with the carrier. Stipulated Award = preserves future medical, structured payments. Good if you have ongoing medical needs. Medicare-eligible claimants over $25K need a Medicare Set-Aside (MSA) review.

What if my employer doesn't have workers' comp insurance?

Most states require it; uninsured employers face state-fund liability + plaintiff can pierce limited liability. Some states have an Uninsured Employer Fund (CA, NY). Texas is the one state where employers can legally opt out — if your Texas employer is a non-subscriber, you can sue them directly under tort law (often more valuable than WC).
