What the HireVue Class Action Says

HireVue runs one-way video interviews that many employers use for first-round screening: you record answers to prompts and software processes what you submit. The lawsuit alleges that some HireVue interview models collected candidates' voice and facial biometrics in Illinois without the written disclosure and written consent required by the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14.

HireVue contests the claims, denies that it collected or possessed biometrics or any other information covered by BIPA, and denies violating the law. The settlement notice states that the settlement is not an admission of wrongdoing. According to the official FAQ, HireVue says the models at issue were phased out beginning in 2020, retired entirely by February 2023, and are not part of any current HireVue product.

Case Details

The case began on January 27, 2022 in Cook County Circuit Court (No. 2022-CH-00719). HireVue removed it to the U.S. District Court for the Northern District of Illinois as Deyerler, et al. v. HireVue, Inc., No. 1:22-cv-01284. After a mediation before a retired federal judge on May 27, 2025, the federal case was dismissed without prejudice on January 21, 2026.

On February 23, 2026 the plaintiffs refiled in the Circuit Court of Lake County, Illinois, Case No. 2026LA00000141, before the Hon. Daniel L. Jasica. That state court is where the HireVue settlement is being approved. The official settlement website is VideoInterviewBIPASettlement.com.

Status: Preliminary Approval, Claims Open Until October 13, 2026

Settled, awaiting final approval. As of October 8, 2026, the court has preliminarily approved the HireVue settlement (on June 25, 2026) and claims are being accepted. The claim deadline is October 13, 2026 — online, or by mail postmarked by that date. The deadline to opt out or object was September 28, 2026 and has passed.

Who Is in the HireVue Settlement Class

You are in the class if, while in Illinois, you completed a HireVue video interview that involved a model that may have collected your voice and facial biometrics between January 27, 2017 and June 25, 2026. HireVue told the parties the class has 91,305 people; its email list covers about 22,234 addresses.

Not every HireVue interview counts. The official FAQ says completing a video interview does not, by itself, make you a class member. June 25, 2026 is simply the date of preliminary approval, not a sign the technology was in use until then — HireVue says the relevant models were retired by February 2023.

If you got an email notice with a Login ID and PIN, records indicate your interview likely qualified. If you got no notice, you can still file with your interview documentation (for example, the invitation or confirmation email), and the administrator checks it against HireVue’s records. Do not contact the employer: per the FAQ, employers do not run this settlement and cannot decide eligibility.

How Much the HireVue Settlement Pays

The fund is $3,750,000. After administration costs, attorneys’ fees (class counsel will ask for up to one-third of the fund plus expenses) and service awards of up to $6,000 for each of the three class representatives, the rest is split equally among valid claims.

The notice estimates $150 per valid claimant but says the exact amount is unknown and depends on how many valid claims come in. Payment is by check or electronic transfer. The FAQ expects payment within approximately 60 days after the approval becomes final; an appeal can delay that. Paper checks become void 75 days after they are issued, so cash yours promptly.

“Recruiter” messages asking you to verify your HireVue claim

The real notice came by email from the administrator, Simpluris, with a Login ID and PIN and a link to VideoInterviewBIPASettlement.com. Type that address yourself instead of clicking. The real claim form does not ask for a fee or your bank password.

Fake job interviews collecting your ID

Job scams already imitate one-way video interviews. A “settlement” or “interview” link that asks for a Social Security number, a photo of your license or a payment is not part of this case.

Paid “claim filing” services

Filing is free and takes a few minutes on the official site. Nobody needs a cut of a $150 payment to submit it for you, and nobody can file after October 13, 2026.
