Almost Every Story About the Publix Blueberry Outbreak Still Says Twelve People Got Sick and Publix Faces No Legal Action. Both Statements Were Out of Date When They Were Written. The CDC Now Counts Seventeen, the Investigation Is Still Open, a Florida Couple Sued on July 13 — and on September 2 the Recall Jumped to Walmart's Great Value Berries.

Most of the coverage still in circulation was written against the July figures. These are the current ones, taken from the CDC outbreak investigation page and the FDA outbreak advisory as they read on September 3 and 4, 2026.

Two things worth keeping straight. First, the eight-state and sixteen-state figures you will see are where the product was sold. People have gotten sick in two states. Second, the CDC attaches its standard caveat, and it matters here: “The true number of sick people in this outbreak was likely much higher than the number reported.” Mild cases are not cultured, and cases that are cultured take weeks to be matched to the outbreak strain.

One small inconsistency we could not resolve: the FDA's fast-facts panel gives the last illness onset as August 6, 2026, while the CDC's investigation page gives August 2. We use the CDC date above and flag the difference rather than pick a winner. Of thirteen people interviewed, eleven — 85 percent — reported eating frozen blueberries, against a background rate of about 24 percent.

The recall people remember is the Publix one. It was not the first, and as of two days ago it was not the last.

July 3, 2026 — the supplier, one lot

Frutas y Hortalizas del Sur S.A. of San Carlos, Chile recalled Frozen GreenWise Organic IQF Blueberries, 10 oz, lot code 60401, Best By February 9, 2028, sold at Publix in Alabama, Florida, Georgia, Kentucky, North Carolina, South Carolina, Tennessee and Virginia.

July 29, 2026 — Publix, every lot, four products

Publix then recalled all lots of four items, which is why no lot code or best-by date is given for this stage. The FDA classified it Class I, its highest risk tier, meaning a reasonable probability of serious health consequences or death.

Publix's instruction is to discard the product or return it to the store for a full refund; its customer care line is (800) 242-1227.

September 2, 2026 — the recall reaches Walmart

The same Chilean supplier expanded the recall to Great Value Organic Triple Berry Blend, 10 oz (strawberries, blackberries and blueberries), UPC 7874211226, lot code 6040 01-6 printed on the front of the package, Best By February 9, 2028. It went to Walmart stores in sixteen states: Alabama, Arkansas, Florida, Illinois, Indiana, Kentucky, Louisiana, Minnesota, Mississippi, Missouri, North Carolina, Ohio, Oklahoma, South Carolina, Texas and Wisconsin. The FDA notice states that there are no illnesses associated with this specific product to date.

If you have a bag of frozen organic berries in the freezer from either chain, the best-by date of February 9, 2028 is the single fastest thing to check — it appears on both the original Publix lot and the Walmart expansion.

Trade press reported on September 3 that the FDA has also placed the supplier on an import alert for detention without physical examination. We could not confirm that on an FDA page ourselves, so we pass it on as a press report rather than as a verified agency action.

This distinction decides what you should do, so it is worth being blunt about it. A recall is a product-safety measure. It creates a refund at the till, not a settlement fund. There is no claim number, no administrator, no deadline to register, and any site inviting you to file a claim for this outbreak is not connected to it.

What does exist is an individual personal-injury case. Roberta Cash and Oscar Cash v. Publix Super Markets, Inc., No. 502026CA007802XXXAMB, was filed in the Circuit Court of the Fifteenth Judicial Circuit in and for Palm Beach County, Florida on July 13, 2026 — six weeks before the widely syndicated line that Publix was facing no legal action. The complaint pleads strict liability, negligence and breach of implied warranties, seeks damages in excess of $100,000 and demands a jury. According to the reporting, Roberta Cash spent ten days at Jupiter Medical Center and eighteen days in a rehabilitation facility after eating GreenWise frozen blueberries bought in May 2026.

Outlets differ on whether the Chilean supplier was named as a co-defendant. We have not read the complaint itself, so we describe it as a case against Publix and leave the supplier out of that sentence.

Whether other suits have been filed we genuinely do not know: we have no access to the Florida clerk's docket or PACER for this county, and three of the outlets that usually cover foodborne-illness litigation were unreachable for us. Absence of press coverage is not absence of filings.

Because this is product liability rather than a class settlement, nothing notifies you and no administrator writes to you. The limit is a statute, and in Florida it is not one number.

In Florida the period follows the legal theory, not the facts — a food-poisoning case typically pleads both product liability and negligence, and the two clocks run side by side. That means the practical warning is the shorter one: two years. For an illness that began in May 2026, that is May 2028, and it arrives without any notice.

Georgia's rule is simpler and also two years. Its ten-year outer limit is irrelevant for berries bought this year, but it is the reason older product claims sometimes fail even when the injury is recent. We list only these two states because they are the only ones with reported illnesses.

One thing we will not tell you is that you must have a laboratory result or a receipt. Those are not elements of the claim in either statute, and we found no authority making them one. What is true is practical rather than legal: the CDC links cases to an outbreak by matching the bacterial strain, so a stool culture is what ties an illness to this particular product — and a purchase record is what ties it to a particular store. Someone with both is in a stronger evidentiary position than someone with neither. That is a different sentence from “you must prove.”

• Check the freezer for Best By February 9, 2028 on organic frozen berries from Publix or Walmart. Do not rinse and eat — E. coli O145:H28 is not removed by washing, and these products are eaten without cooking.
• Return it for a refund rather than discarding it if you want a record: the transaction is the purchase proof you would otherwise lack. Photograph the package, the UPC and the lot code first.
• If someone in the household was ill between May and now with severe cramps, bloody diarrhoea or a hospital admission, ask the treating provider whether a stool culture was taken and whether it was serotyped. That result is what connects an individual case to this outbreak.
• Watch for haemolytic uraemic syndrome, the kidney complication of Shiga toxin-producing E. coli. None has been reported in this outbreak, but it is the reason these recalls are Class I.
• Do not wait for a settlement notice. There is no fund to notify you. The statute runs whether or not anyone tells you it is running.
