What the Lawsuits Say Happened
The Limetree Bay Refinery on St. Croix tried to restart in early 2021. The lawsuits allege that the “catastrophic failed” restart released hazardous substances, gases and odors over western St. Croix from February 2021 until the EPA shut the refinery down under its Clean Air Act emergency powers in May 2021.
Residents claim oil and chemical fallout on homes and in rooftop cisterns, nuisance, trespass, lost income and health effects. The operative complaint has seventeen named class representatives bringing twelve causes of action against eighteen corporate defendants. The settling defendants “vigorously deny that they violated any law” and settled to avoid the cost of continuing the case.
Case details
The class case is Boynes v. Limetree Bay Ventures, LLC, No. 1:21-cv-00253, in the District Court of the Virgin Islands, St. Croix Division. Four class actions were filed in 2021 — Boynes (filed June 9, 2021), plus Shirley (1:21-cv-00259), Charles (1:21-cv-00260) and Cotton (1:21-cv-00261) — and were consolidated on March 1, 2024, with Boynes as the lead docket. Per the docket, the case is assigned to Judge Mark A. Kearney. Judge Wilma A. Lewis signed the February 16, 2026 order granting the first preliminary approvals.
Separate matters with the same name: the federal government’s own case, United States v. Limetree Bay Refining, LLC, No. 1:21-cv-00264, and the refinery companies’ bankruptcy in the Southern District of Texas, No. 21-32351, were both filed July 12, 2021. Neither of those pays residents through this claim form.
Status: Settlements Pending Final Approval, Claims Open
Not every defendant has settled. Per the notice, “litigation continues against the remaining Defendants.” Limetree Bay Terminals (Ocean Point Terminals), Limetree Bay Refining and BP Products North America opposed the first settlement. Our news report has the same timeline: Limetree Bay settlement: claims due November 3, no money before December 14.
Don't miss the claim deadline
Claims are due by November 3, 2026. We'll email you 7 days and 1 day before the deadline.
Who Can File a Claim
Per the notice, you may be a Settlement Class Member if either of these is true:
1. You owned or rented property in the Affected Geographic Area on or after February 3, 2021.
2. You lived, worked, owned or ran a business there, or were present there, at any time from February 3, 2021 to May 26, 2021.
The area is the western part of St. Croix, bounded by 64.74 degrees West Longitude and the sea. The official site has a map. Plaintiffs told the court the area holds at least 6,000 households.
Being in the class does not get you paid. You have to file a claim with documentation by November 3, 2026.
How Much the Limetree Bay Settlement Pays
So your share depends on what you document and on how many others file. Receipts, medical records, repair bills and proof of where you lived or worked in 2021 are what earn points. Some of the total has been reported separately. The court preliminarily approved a $17,500,000 ArcLight and Freepoint settlement and a $550,000 Pinnacle settlement on February 16, 2026. Law360 reported a $35 million deal with affiliates of the former operator on July 15, 2026. No payment date has been set. Payments depend on final approval.
How cases like this one end
Our copy of the federal courts’ own case database covers 4,290 federal civil cases of this typeclosed in U.S. federal district courts between 2015 and 2026, 5.2% of them filed as class actions:
- 24.2% ended in a settlement recorded by the court. Another 31.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 24.2% and 56.1%.
- 6.6% were decided on a motion before any trial.
- 1 in 73 reached a trial (1.4%), after a median of 27.2 months.
- Median time from filing to the end of the case: 16.2 months.
- Only 61 of them (1.4%) record a money award at all; the median of those is $1,236,000.

Three Things to Watch For
Thousands of households, a published court notice, and a hard deadline — that combination draws imposters:
Look-alike “Limetree settlement” sites
The official address in the court notice is LimetreeBaySettlement.com. Type it yourself. Don’t follow links from texts or social media posts. The official phone number in the notice is 1-888-859-9973.
Anyone charging a fee to file your claim
Filing a claim is free, online or by mail. Class counsel’s fees come out of the fund with court approval. Someone who wants money up front, or a share of your payment, to fill in the form is not the administrator.
Private “release” offers presented as the settlement
The class payment comes only through a Claim Form filed with the Settlement Administrator. A separate paper that asks you to sign away claims for a quick check is a different deal. Read it, and ask class counsel before signing.
Limetree Bay Settlement — Questions People Actually Ask
Short answers to the questions people ask most about this case.
Is LimetreeBaySettlement.com legitimate?
Yes. The court-authorized notice of September 11, 2026 names www.LimetreeBaySettlement.com as the settlement website and 1-888-859-9973 as the information line. You can file your claim and download the claim form there.
What is the Limetree Bay settlement deadline?
Claims are due November 3, 2026. Opt-outs and objections must be postmarked by October 27, 2026. The final approval hearing is December 14, 2026.
Who qualifies for the Limetree Bay settlement?
People and businesses that owned or rented property in western St. Croix (west of 64.74 degrees West Longitude) on or after February 3, 2021. Also people who lived, worked, ran a business or were present there between February 3, 2021 and May 26, 2021.
How much will I get from the Limetree Bay settlement?
No fixed amount. After fees, costs and service awards come out of the $59,795,000 fund, the rest is divided by a point system. Points are based on documented property damage, cistern impact, health effects, economic losses and out-of-pocket expenses.
When will Limetree Bay settlement payments be made?
Not before the court grants final approval. The hearing is December 14, 2026. As of October 19, 2026, no payment date has been announced. An appeal would push payments back further.
Is Port Hamilton (PHRT) part of this settlement?
No. Port Hamilton Refining and Transportation is not named as a settling defendant in the notice. It has its own separate federal case against Limetree Bay Terminals (No. 1:24-cv-00004), filed February 15, 2024, which does not pay residents. For the settlement, LimetreeBaySettlement.com is the only claim channel.
Does the settlement end the case against every Limetree company?
No. The notice says litigation continues against the remaining defendants. Limetree Bay Terminals, Limetree Bay Refining and BP Products North America were the defendants that opposed the first settlement in court.
I am in the class but do nothing. What happens?
If the settlements are approved, you are bound by them and give up your claims against the settling defendants, but you get no money unless you file a claim by November 3, 2026. Class members who opt out by the October 27, 2026 postmark deadline keep their own claims but receive nothing from these settlements.
