Insurance Company Lawsuit: Which Insurers Are Being Sued, and What You Can Do
Reference Guide
An insurance company lawsuit is usually one of two things: a class action over how an insurer treated many policyholders, or your own claim that was denied, delayed or underpaid. As of October 2026, two class settlements are moving toward approval — Transamerica life insurance ($110 million, no claim form) and Progressive Texas PIP ($8 million, claims due January 19, 2027) — and a federal case over UnitedHealth's alleged use of AI to deny Medicare Advantage care is in discovery.

Most lawsuits against insurance companies come down to one accusation: the insurer did not pay what the policy promised, or paid it late.
Transamerica: the Wren lawsuit alleges Transamerica failed to credit certain cash value increases on Direct Recognition Life policies. Transamerica denies all wrongdoing, and the court has not decided who is right.
Progressive (Texas): the Koetter lawsuit alleges Progressive County Mutual paid personal injury protection (PIP) medical bills after the deadlines in Texas law without paying the interest owed. Progressive has not admitted wrongdoing.
UnitedHealth: the Lokken lawsuit alleges UnitedHealthcare used an AI tool, nH Predict, to cut off post-acute care for Medicare Advantage members instead of relying on doctors. Optum disputes this and says nH Predict is a care-support tool, not a claims tool.
Case details
Transamerica: Wren, et al. v. Transamerica Life Insurance Company, No. 5:21-cv-00178-JGB-SP, U.S. District Court for the Central District of California, before Judge Jesus G. Bernal. Official site: wrencvisettlement.com (administrator: JND Legal Administration).
Progressive: Koetter, et al. v. Progressive County Mutual Insurance Company, No. D-1-GN-18-005132, 419th Judicial District Court of Travis County, Texas — a state court, not federal.
UnitedHealth: Estate of Gene B. Lokken v. UnitedHealth Group, Inc., No. 0:23-cv-03514, U.S. District Court for the District of Minnesota. See our UnitedHealthcare lawsuit page.
Status: Two Settlements Pending, One Case in Discovery
Transamerica ($110 million): the opt-out and objection deadline of October 2, 2026 has passed. The fairness hearing is set for November 9, 2026. Nothing to file — eligible owners are paid automatically if the court approves. Our news report covers the fee request and the response from the class.
Progressive Texas PIP ($8 million): claims are open until January 19, 2027; the exclusion and objection deadline is November 12, 2026; final approval hearing December 17, 2026. Details in our Progressive PIP report.
UnitedHealth (Lokken): no settlement, no fund and no claim form. On March 9, 2026 the court ordered broad discovery, and on September 4, 2026 UnitedHealth filed an answer denying the allegations.
Are You Affected?
Transamerica: you owned a Transamerica universal life policy in effect on January 1, 2016, sold as “Direct Recognition Life 10” or “Direct Recognition Life 11” (codes DRL-10 or DRL-11).
Progressive: you had a Texas-based Progressive policy, submitted a medical bill under PIP, and Progressive paid a line item more than 15 business days (15-day class) or more than 30 days (30-day class) after receiving it, with an explanation-of-benefits print date between August 30, 2016 and June 1, 2026.
Your own claim, not a class action: if your insurer denied, delayed or underpaid you personally, a class settlement will not fix that. The usual path is a written complaint to the insurer, then to your state insurance department, and then, if needed, a lawsuit against insurance company bad faith.
What an Insurance Company Settlement Pays
Progressive: the 15-day class receives 11.452% annual interest on the allowed amount for the days the payment was late; the 30-day class receives a flat 5% of the allowed amount plus 11.452% annual interest. For a small medical bill, that can be a modest sum.
UnitedHealth: no settlement, no fund, no claim form.
In a class action, a settlement check from insurance company funds is mailed by the court-appointed administrator, not by your agent. See what a settlement check looks like.

Three Things to Watch For
Insurance settlements involve policy numbers and bank details, which is exactly what imposters want:
“File your Transamerica claim” requests
The Wren settlement has no claim form. Eligible owners are paid automatically by JND Legal Administration. Anyone asking you to file, pay a fee or confirm bank details to “release” a Transamerica payment is not the administrator. The official number is on wrencvisettlement.com: 1-888-305-6486.
Progressive PIP messages asking for your full policy file
The real Progressive PIP claim is a claim form filed on the official settlement website. Nobody legitimate needs your Social Security number, a login to your Progressive account or a processing fee. When in doubt, type the administrator's address yourself instead of tapping a link.
“Join the UnitedHealth AI lawsuit” ads
There is no Lokken settlement and no claim form. Ads promising a payment for Medicare Advantage denials are recruiting, not paying. If a class is certified or a settlement is reached, notice comes from a court-appointed administrator.
Insurance Company Lawsuits — Questions People Actually Ask
Short answers to the questions people ask most about this case.
Which insurance company is getting sued?
As of October 2026 the cases with dates attached are Transamerica (Wren, $110 million life insurance settlement, hearing November 9, 2026), Progressive County Mutual (Koetter, $8 million Texas PIP settlement, claims due January 19, 2027) and UnitedHealth (Lokken, alleged AI denials in Medicare Advantage, in discovery, no settlement).
Do I need to file a claim in the Transamerica insurance company settlement?
No. The official site says eligible class members automatically receive a check in the mail from JND Legal Administration if the court approves the settlement. The opt-out deadline passed on October 2, 2026.
How do I claim the Progressive PIP settlement?
File online by January 19, 2027 using the claim form on the official settlement website. If you want to exclude yourself or object, the deadline is November 12, 2026. The final approval hearing is December 17, 2026, so payments cannot come before then.
How long does an insurance company have to decide my claim?
It depends on your state. In California, under 10 CCR 2695.7, an insurer must accept or deny a claim within 40 calendar days of receiving proof of claim. If it needs more time, it must say so in writing and update you every 30 calendar days. Once it accepts, it must pay within 30 calendar days.
What happens if insurance doesn't want to settle?
In California a denial of a first-party claim must be in writing and list every reason, with the policy provision or law it relies on. Ask for that letter. You can then file a complaint with your state department of insurance, which investigates unfair claim delays or denials for free and can require the company to correct the problem. A lawsuit against the insurance company for bad faith is the last step, not the first.
Is a settlement check from an insurance company in a class action real?
Check who sent it. Class settlement checks come from the court-appointed administrator named on the official settlement website — for Wren that is JND Legal Administration. Verify by phoning the number on the official site, not the number printed in the letter. Our settlement check problems page covers lost and expired checks.
What should I gather before suing my insurance company?
The NAIC advises gathering your policy number, documentation, bills and records, and keeping a log of every contact with the insurer, including dates and times. Keep the written denial letter — it is the document every complaint and lawsuit starts from.
Can an insurer be sued for using AI to deny claims?
That is the question in Lokken v. UnitedHealth. The court dismissed some claims but let breach of contract and breach of the implied covenant of good faith and fair dealing proceed, and on March 9, 2026 ordered discovery including contact details for staff who denied coverage to 300 putative class members. No court has found UnitedHealth liable.
