Imerys Talc Settlement: Why There Is No Payout Date Yet
Active Litigation
Imerys Talc America was Johnson & Johnson’s talc supplier. It has been in Chapter 11 in Delaware since 2019, and Cyprus Mines joined in 2021. Their plan would pay talc injury claims through one trust — but as of October 2026 the court has not confirmed it. No trust is paying, and there is no claim form for the public.

What the Talc Claims Against Imerys Say
Imerys mined and supplied talc used in consumer products, including J&J’s. People who developed ovarian cancer, mesothelioma or lung cancer sued, alleging that talc exposure caused their illness. The companies dispute those claims.
Cyprus Mines owned part of the same talc business before Imerys. When it filed, Cyprus was a defendant in approximately 700 talc lawsuits, often alongside Imerys and for the same conduct.
Rather than defend each case, both companies used bankruptcy to channel all present and future talc injury claims into a single trust under section 524(g) of the Bankruptcy Code.
Case details
Imerys Talc America, Imerys Talc Vermont and Imerys Talc Canada filed on February 13, 2019: In re Imerys Talc America, Inc., No. 19-10289, U.S. Bankruptcy Court for the District of Delaware, before Judge Laurie Selber Silverstein. Cyprus Mines Corporation filed on February 11, 2021 (No. 21-10398), and that case runs in parallel.
A recognition case runs in Ontario (CV-19-614614-00CL). Kroll Restructuring Administration is the claims and voting agent; documents are at cases.ra.kroll.com/imerystalc and IandCtalc.com.
Status: Plan Voted On, Not Yet Confirmed
The confirmation hearing began in April 2025. It was paused in May 2025 over the treatment of “foreign claims” and concluded in February 2026, with insurers objecting. A report filed in Canada on March 23, 2026 said no ruling had been issued.
On August 17, 2026, Law360 reported that Imerys and Cyprus asked the court to reject insurers’ requests to postpone confirmation over a ruling in the J&J talc MDL. A docket tracker updated October 22, 2026 shows Imerys still in Chapter 11. Its October 20, 2026 motion (Dkt. 8557) asks to move up to $22 million of J&J settlement money into a holding trust until the injury trust exists. That motion is set for a November 10, 2026 hearing.
Even after confirmation, the companies say they will ask the Canadian court to recognize the order as a condition of the plan taking effect. We checked again on October 23, 2026 and found no later update on confirmation.

Whose Claims the Trust Would Cover
The plan covers talc personal injury claims against Imerys and Cyprus, present and future. The trust has separate sub-accounts for ovarian cancer claims and for mesothelioma and lung cancer claims. These claims are the only voting classes, and they are to be paid solely by the trust under court-approved Trust Distribution Procedures.
This is not a consumer class action. There is no refund for buying talc powder. Claims typically run through the claimant’s own lawyer, who could vote on the plan on the client’s behalf. Voting closed on December 16, 2024, and the objection deadline was March 26, 2025. Both have passed.
The Imerys case is separate from J&J’s own talc litigation. For that, see our J&J talc settlement page.
How Much Money Is Involved
Insurers appealed the approval. The district court denied that appeal in August 2025, and per J&J’s October 2026 filing the Third Circuit dismissed it in October 2026. The plan also relies on settlements with Imerys affiliates, Rio Tinto and Zurich, Cyprus, and XL Insurance.
What an individual eventually receives will depend on the Trust Distribution Procedures and the disease category. Figures circulating online are not from the court.

Three Things to Watch For
A large trust with no payout date draws imposters. These traps fit this case:
“Your Imerys payout is ready” messages
No trust exists yet to pay anyone, because the plan is not confirmed. A text or email saying a payment is waiting for a “release fee” or bank details is fake.
Fake Kroll or claims-agent callers
Kroll’s published line for this case is (844) 514-9092 and its site is IandCtalc.com. Verify any contact through those, not through a number the caller gives you.
“Last chance to vote or register” ads
Voting ended December 16, 2024. An ad pushing a new talc “registration” is most likely lead generation for a law firm. Read any retainer before signing.
Imerys Talc Settlement — Questions People Actually Ask
Short answers to the questions people ask most about this case.
What is the Imerys talc settlement payout date?
There isn’t one. Payments come from a talc personal injury trust that is created only once the Chapter 11 plan is confirmed and takes effect. As of October 2026, no confirmation order has been reported.
How soon can you expect to receive compensation from the lawsuit?
Not before the plan is confirmed, recognized in Canada and effective, and the trust is set up to review claims under its distribution procedures. No court has set a timetable for those steps.
Is this the same as the J&J talc settlement?
No. Imerys supplied J&J’s talc, and J&J contributed approximately $505 million to the Imerys and Cyprus estates. J&J’s separate $5.5 billion proposal for ovarian cancer claims is a different deal. See our J&J payout date page.
What is the latest update on the J&J talcum powder lawsuit?
Per J&J’s October 2026 quarterly filing, its $5.5 billion ovarian proposal requires participation of at least 95% of remaining claims, and the mesothelioma docket continues. Our news analysis covers that deal.
Who would be paid by the Imerys trust?
People with talc personal injury claims against Imerys or Cyprus. The trust has separate sub-accounts for ovarian cancer and for mesothelioma and lung cancer. Buyers of talc products with no injury are not covered.
Do I need to file a claim now?
There is no public claim form today. Voting ended December 16, 2024. If you have a talc injury claim, your lawyer handles it; if you have no lawyer, Kroll’s case line is (844) 514-9092.
Why is it taking so long?
The first plan failed the section 524(g) voting threshold. A second plan was filed January 31, 2024 and amended January 20, 2026. Disputes over foreign claims and insurer objections have stretched the confirmation hearing.
Where can I check the official status?
Kroll posts court filings at cases.ra.kroll.com/imerystalc and IandCtalc.com. The case is No. 19-10289 in the U.S. Bankruptcy Court for the District of Delaware.
