Tesla Lawsuit: Where the Full Self-Driving Class Action and the Idle-Fee Settlement Stand

Active Litigation

Claim deadline was September 25, 2026 · as of Oct 23, 2026

Get a free case reviewCan I still file?

There is no single Tesla lawsuit. The one in the news is the Full Self-Driving false-advertising case: on October 16, 2026 a federal appeals court vacated its class certification, so California FSD buyers cannot, for now, sue together. Separately, a small California Tesla settlement over Supercharger idle fees closed its claim window on September 25, 2026 and goes to a final approval hearing on December 2, 2026. As of October 2026, we found no Tesla class action with an open claim form.

What the Full Self-Driving Lawsuit Says

The main Tesla class action lawsuit claims that Tesla misrepresented its cars’ hardware capabilities when it sold Full Self-Driving (FSD) packages. According to the plaintiffs, Tesla’s website said that vehicles sold from October 2016 onward contained the hardware needed for full self-driving capability, and buyers paid extra for software that, they say, does not deliver it. The claims are brought under California consumer-protection statutes and common law.

Tesla denies the claims. No court has decided whether the hardware statement was false — every ruling so far has been about procedure: arbitration, which claims survive, and whether buyers can sue as a group.

Case details

The case is In re Tesla Advanced Driver Assistance Systems Litigation, No. 3:22-cv-05240-RFL, in the U.S. District Court for the Northern District of California, before Judge Rita F. Lin. The first complaint was filed on September 14, 2022; several proposed class actions were consolidated, with a Consolidated Amended Complaint on October 28, 2022. On September 30, 2023 the court sent four of five plaintiffs to arbitration.

The appeal is LoSavio v. Tesla, Inc., No. 25-7927, in the U.S. Court of Appeals for the Ninth Circuit, decided by Circuit Judges Gould, Bybee and Bress in an unpublished memorandum.

The idle-fee settlement is a separate state case: Shenkman v. Tesla, Inc., Case No. RG21102833, Superior Court of California, County of Alameda, Department 18, Judge Patrick McKinney.

Status: FSD Class Vacated, Idle-Fee Settlement Awaiting Approval

FSD case: active, no class, no settlement. On October 16, 2026 the Ninth Circuit held that the trial court erred by inferring that every class member saw the disputed hardware statement, and it vacated all three certified classes and sent the case back to Judge Lin. Reuters reported that the ruling is not on the merits and the case remains pending. There is no fund, no claim form and no deadline.

Idle-fee settlement: claims closed, approval pending. The court granted preliminary approval on June 25, 2026. The claim deadline was September 25, 2026. The final approval hearing is set for December 2, 2026.

Other Tesla cases, as of Tesla’s quarterly report for the period ended September 30, 2026: a second proposed FSD class action filed in the Northern District of California on June 4, 2026 faces a motion to dismiss filed September 22, 2026. An investor class action in the Western District of Texas over Autopilot, FSD and Robotaxi statements (stock bought April 19, 2023 to June 22, 2025) is waiting on a fully briefed motion to dismiss. The California Civil Rights Department’s race-discrimination case is in a bench trial that began September 21, 2026 and is scheduled to run until October 30, 2026; a parallel EEOC case is in discovery. Shareholder derivative suits in Delaware were dismissed on April 13, 2026 and are on appeal.

Follow this case

There's no claim deadline yet. We'll email you when the case moves forward, like a settlement or payments going out.

Who Is Affected by Each Case

FSD case. The class certified on August 18, 2025 was limited to California consumers who bought FSD and were not bound by Tesla’s arbitration agreement. That class no longer exists after the October 16, 2026 ruling. Buyers outside California, and buyers who signed arbitration terms, were never in it. Nothing is required of you while the case continues.

Idle-fee settlement. The class is people who received a Tesla vehicle in California before December 16, 2016, kept it after that date, were California citizens on June 21, 2021, and bought a car described in Tesla’s purchase agreement as “Supercharger Enabled,” “Supercharger Hardware” or “Supercharger Hardware & Access.” If that is not you, this Tesla settlement does not apply to you. Details are on the official settlement website.

Investors. The Texas securities case covers people who bought Tesla stock between April 19, 2023 and June 22, 2025; it is not a car-owner case.

Is There Any Money?

FSD case: no settlement, no fund, no claim form. No court has valued the claims, and after the class was vacated there is no group recovery on the table.

Idle-fee settlement: eligible class members who filed by September 25, 2026 can receive a refund of idle fees they paid, a $50 payment if Supercharger access was disabled for less than 30 days, or $350 if it was disabled for 30 or more consecutive days. Former owners could elect a $10 payment. Current owners keep Supercharger access and have unpaid idle fees waived. Payments go out only if the court grants final approval on or after December 2, 2026, and after any appeals are resolved. Class counsel will ask for up to $1,000,000 in fees, which Tesla pays separately.

Crash verdict: in Benavides v. Tesla (S.D. Fla., No. 1:21-cv-21940), a jury on August 1, 2025 awarded $129 million in compensatory damages, finding Tesla 33% at fault, plus $200 million in punitive damages. That money goes to the plaintiffs in that one case, not to Tesla owners, and Tesla is appealing.

How cases like this one end

Our copy of the federal courts’ own case database covers 83,315 other statutory actions casesclosed in U.S. federal district courts between 2015 and 2026, 11.8% of them filed as class actions:

  • •25.6% ended in a settlement recorded by the court. Another 22.4% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 25.6% and 47.9%.
  • •7.4% were decided on a motion before any trial.
  • •1 in 156 reached a trial (0.6%), after a median of 21.8 months.
  • •Median time from filing to the end of the case: 4.9 months.
  • •Only 1,756 of them (2.1%) record a money award at all; the median of those is $199,500.

These are base rates for this type of case (federal other statutory actions cases) — not a prediction about this lawsuit, and not legal advice. Source: Federal Judicial Center, Integrated Database (civil), analysed by Settlement Insight. Cases heard in state courts are not included.

The Ninth Circuit vacates all three certified classes and remands to Judge Lin. The case continues, with no class, no settlement and no claim form.

Three Things to Watch For

A lot of headlines with almost nothing to claim is the setting imposters like:

“Claim your Tesla FSD refund”

There is no FSD settlement and no FSD claim form. A site promising a share of a “Full Self-Driving payout” is collecting your data, not filing anything.

Offers to file a late idle-fee claim

The idle-fee deadline was September 25, 2026. Anyone charging a fee to “reopen” or “expedite” a claim is not the settlement administrator. Class members are not charged for Class Counsel’s services, so check with the administrator on the official settlement website before paying anyone.

Requests for your Tesla account login

The idle-fee settlement uses Tesla’s own records to work out refunds. No legitimate notice needs your Tesla account password or a verification code to “confirm your vehicle.”

Tesla Lawsuit — Questions People Actually Ask

Short answers to the questions people ask most about this case.

Is there a Tesla class action lawsuit I can join right now?

Not in any way that pays out today. If you are searching for a class action lawsuit Tesla owners can sign up for, there is none to sign up for: you never “join” a class by registering. The FSD class was vacated on October 16, 2026, and the idle-fee settlement stopped taking claims on September 25, 2026.

What happened to the Tesla Full Self-Driving class action?

The Ninth Circuit ruled on October 16, 2026 that the trial court should not have assumed every buyer saw Tesla’s hardware statement, and it vacated the certified classes. The lawsuit against Tesla is still pending before Judge Rita Lin, but buyers cannot, for now, pursue it as a group.

Is there a Tesla settlement paying money right now?

Not yet. The only open consumer settlement we found is the California idle-fee case, Shenkman v. Tesla. Its claim deadline was September 25, 2026, and nothing is paid until the court grants final approval (hearing December 2, 2026) and any appeals end.

I missed the September 25, 2026 idle-fee deadline. Can I still claim?

The official site lists September 25, 2026 as the deadline for online claims and the postmark deadline for mailed forms. Only the court-appointed administrator can say whether anything else applies to you: call (833) 421-7344, the number on the official settlement website.

How much does the Tesla idle-fee settlement pay?

A refund of idle fees you actually paid, plus $50 if your Supercharger access was disabled for less than 30 days or $350 for 30 or more consecutive days. Former owners could choose a $10 payment instead of keeping access.

How big was the Tesla Autopilot verdict?

In Benavides v. Tesla, a Miami federal jury on August 1, 2025 awarded $129 million in compensatory damages, with Tesla found 33% at fault, and $200 million in punitive damages. The trial court denied Tesla’s post-trial motions on February 19, 2026. Tesla’s reply brief in the Eleventh Circuit is due November 6, 2026. This was one family’s case, not a class action.

Are there lawsuits over Cybertruck doors?

Yes, as individual injury and wrongful-death suits, not a class action. Families and the sole survivor of a 2024 Cybertruck crash in Piedmont, California have sued in Alameda County Superior Court. Their complaints allege that the electrically powered doors would not open after the crash. Tesla has not conceded those claims.

Is the headlight recall part of a Tesla class action?

No. A recall is a free repair, not a lawsuit, and as of October 2026 we found no Tesla class action settlement tied to it. Our report on the August 2026 headlight recall covers the affected cars, and the Tesla recall check lists every open campaign.
