Volkswagen Class Action Lawsuits: Which Case Is Which, and What Pays
Active Litigation
Claim deadline was November 29, 2025 · as of Oct 23, 2026
There is no single class action lawsuit Volkswagen owners can join — there are several, all in federal court in New Jersey, at very different stages. As of October 23, 2026: the Tiguan oil-consumption case survived Volkswagen's bid to dismiss it, a fuel-leak settlement for Golf, GTI, Jetta GLI and Audi A3 owners has been submitted for court approval, an ID.4 battery-fire suit is in its early stage, and the turbocharger and Atlas water pump settlements are closed to new claims. We could not confirm any Volkswagen claim form that is open today.

What the Volkswagen Lawsuits Allege
Each case targets a different part, and everything described here is an allegation, not a finding.
Tiguan oil consumption. The lawsuit alleges that 2022 and 2023 Tiguans with the EA888 2.0-liter turbo engine burn oil because the piston rings lack enough tension, forcing owners to keep topping up oil.
Fuel leaks. The suit alleges the fuel-tank suction jet pump in certain Golf, GTI, Jetta GLI and Audi A3 models can cause fuel leaks, gas odor inside the car and a risk of fire. Volkswagen recalled the part in 2024; the plaintiffs say the recall did not go far enough. Volkswagen denies there have been any reported fires or injuries tied to the part.
ID.4 batteries. The newest suit alleges that misaligned electrodes in some ID.4 high-voltage battery cells can cause fires, and that Volkswagen is aware of at least six fires connected to the battery. Volkswagen has issued three recalls, the first in December 2025.
Turbochargers (resolved). This case alleged early turbo failures caused by wastegate wear or corrosion on 2008–2024 models with Generation 1 or Generation 3 EA888 engines. Volkswagen settled without admitting fault.
Case details
All of these cases are in the U.S. District Court for the District of New Jersey, because Volkswagen Group of America has its U.S. headquarters there.
Tiguan: Zeiders, et al. v. Volkswagen Group of America, Inc., No. 2:24-cv-11197-BRM-JSA, filed December 16, 2024. Three Tiguan suits were combined into this one in February 2025.
Fuel leak: Hardy, et al. v. Volkswagen Group of America, Inc., No. 1:24-cv-08251, filed August 2, 2024, before Judge Karen M. Williams.
ID.4: Chen, et al. v. Volkswagen Aktiengesellschaft, et al., No. 2:26-cv-05409, filed May 13, 2026.
Oil consumption, wider EA888 lineup: Reece v. Volkswagen Aktiengesellschaft, No. 2:26-cv-00745, filed January 23, 2026 — covered on our Audi lawsuit page.
Closed: the turbocharger settlement, Kimball v. Volkswagen Group of America, Inc., No. 2:22-cv-04163, and the Atlas water pump settlement, Briggs v. Volkswagen Group of America, Inc., No. 2:25-cv-01540.
Status as of October 2026: One Deal Pending, Two Closed
Tiguan (Zeiders): active, no settlement. On January 8, 2026 the judge denied most of Volkswagen's motion to dismiss claims brought by drivers from seven states. The case is in discovery; a protective order was entered on October 9, 2026.
ID.4 (Chen): active, early stage. No settlement, no fund, no claim form.
Turbocharger (Kimball): closed to claims. The claim deadline passed on November 29, 2025, the court approved the settlement after the hearing on December 4, 2025, and claim decisions were mailed on June 11, 2026.
Atlas water pump (Briggs): closed to claims. Final approval came on September 10, 2026 and the claim window closed on October 5, 2026 — details in our Atlas water pump news report.
Every open class action suit against Volkswagen listed here is still about allegations, not findings.

Who Is Covered by Each Case
Fuel-leak settlement (proposed): owners and lessees of 2015–2020 Audi A3, 2015–2019 Audi A3 Cabrio, 2015–2020 Volkswagen Golf, GTI and Golf SportWagen, and 2019–2020 Jetta A7 GLI vehicles. The class is only final if the court approves it.
Tiguan case: the proposed classes cover buyers and lessees of 2022 and 2023 Tiguans. You do not sign up; if a class is certified or a settlement is reached, a court-appointed administrator contacts class members.
ID.4 case: a proposed nationwide class plus a California subclass of people who bought or leased the affected ID.4s.
Older Tiguans: certain 2009–2018 Tiguans were in the turbocharger settlement, along with GTI, Golf R, Jetta GLI, Arteon, Atlas and other models. The coverage was set by VIN, and the claim deadline has passed.
What Volkswagen Owners Can Actually Get
Turbocharger: the settlement reimbursed 50% of one turbo repair paid within 8.5 years or 85,000 miles of the in-service date. Generation 3 vehicles also got a 50% warranty extension. Claims are closed, and we could not find a payment date on the official site.
Tiguan and ID.4: no settlement, no fund, no claim form. No court has valued these claims.
How cases like this one end
Our copy of the federal courts’ own case database covers 25,309 other fraud casesclosed in U.S. federal district courts between 2015 and 2026, 27.6% of them filed as class actions:
- 17.1% ended in a settlement recorded by the court. Another 22.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 17.1% and 39.9%.
- 10.2% were decided on a motion before any trial.
- 1 in 112 reached a trial (0.9%), after a median of 29.9 months.
- Median time from filing to the end of the case: 7 months.
- Only 761 of them (3%) record a money award at all; the median of those is $663,000.

Three Things to Watch For
With two closed settlements and one pending, Volkswagen owners are an easy target:
“Claim your Volkswagen fuel-leak payment now”
As of October 2026 we could not confirm that the fuel-leak settlement has been approved or has a claims site. If it is approved, notice comes from a court-appointed administrator and names the case, Hardy, No. 1:24-cv-08251. A real claim never costs a fee.
Offers to file a late turbo claim
The turbocharger claim deadline passed on November 29, 2025. Anyone offering to “reopen” it for a fee is not the administrator. The real administrator's number is 1-855-779-6685.
“Join the lawsuit to get your recall repair”
Recall repairs, such as the ID.4 battery and fuel-pump recalls, are free at a dealer whether or not you take part in any lawsuit. Nobody needs your signature or a retainer before a recall repair.
Volkswagen Lawsuits — Questions People Actually Ask
Short answers to the questions people ask most about this case.
Is there a lawsuit against Volkswagen right now?
Yes, several. As of October 23, 2026 the active cases are the 2022–2023 Tiguan oil-consumption case, the ID.4 battery-fire case and the fuel-leak case, which is waiting for approval of a settlement. All are in federal court in New Jersey. The turbocharger and Atlas water pump settlements are closed to claims.
Is there a class action lawsuit Volkswagen Tiguan owners can join?
Owners of 2022 and 2023 Tiguans fall within the proposed classes in Zeiders v. Volkswagen Group of America (2:24-cv-11197). There is nothing to sign: if a class is certified or a settlement is reached, the administrator notifies class members. Some 2009–2018 Tiguans were in the turbocharger settlement, but its claim deadline passed on November 29, 2025.
How do I join a class action against Volkswagen?
You usually don't need to. Under Rule 23 you are included in a certified class or approved settlement unless you opt out. What you do need to do is file a claim when a settlement opens one, by the deadline in the official notice. Keep your repair receipts in the meantime.
When is the class action lawsuit Volkswagen payout date?
It depends on the case. For the turbocharger settlement, claim decisions were mailed on June 11, 2026; the official site gives no payment date. The fuel-leak settlement pays nothing until the court approves it. For the Atlas water pump settlement, see our Atlas settlement page.
What was the punishment for the Volkswagen scandal?
In the diesel emissions scandal, Volkswagen AG agreed on January 11, 2017 to plead guilty to three felony counts. It paid a $2.8 billion criminal penalty and $1.5 billion in civil penalties, $4.3 billion in total, over about 590,000 U.S. diesel vehicles fitted with a defeat device. It was also put on probation for three years. That case is over; this page covers the current cases.
Which VW models are being recalled?
This page tracks lawsuits, not every recall. The cases here involve the 2024 suction jet pump recall and three ID.4 battery recalls, the first in December 2025. To check your own car, enter its VIN at the NHTSA recall lookup.
How do I file a complaint with VW?
A class action is not a complaint channel, and this page cannot file one for you. Take repair or warranty disputes to your dealer and Volkswagen customer care. Report safety defects to NHTSA, which uses those complaints to open investigations and push recalls.
Is a Volkswagen settlement letter or email real?
Check it against the case. A real notice names the case and court, such as Kimball (No. 2:22-cv-04163) for the turbo settlement or Hardy (No. 1:24-cv-08251) for fuel leaks. It sends you to an administrator, not a law firm, and never asks for a fee. If in doubt, call the number on the court-approved settlement website rather than the one in the message.
