Celsius Class Action Lawsuit: The Investor Case Behind the Headlines
Active Litigation
The Celsius class action lawsuit in the news in October 2026 is a shareholder case, not a drinker case. Investors who bought Celsius Holdings (CELH) stock between February 21, 2025 and June 3, 2026 are the proposed class, and the deadline to ask to lead it is November 3, 2026. If you only drink Celsius, there is no open settlement and no claim form as of October 2026 — the old $250 settlement closed in 2023.

What the Lawsuits Say
The new investor suit (Alani Nu). Celsius closed its purchase of Alani Nu, a maker of high-caffeine energy drinks, on April 1, 2025 for a net price of $1.65 billion. According to a notice by plaintiffs' counsel describing the complaint, Celsius told investors its drinks were safe while a single 12-ounce Alani Nu contains 200 milligrams of caffeine — more than twice the 100-milligram daily limit pediatric groups recommend for teens — and the brand was allegedly marketed to people under 18. The complaint alleges the stock fell when a wrongful-death suit over an Alani Nu drinker was reported on April 9, 2026 and again when the Texas Attorney General announced an investigation on June 4, 2026.
The older investor suit (Pepsi). A separate securities case alleges Celsius oversold inventory to PepsiCo, its main U.S. distributor, far beyond real demand, setting up a sales cliff. Celsius says the claims in the Pepsi investor case are without merit.
Case details
Both investor cases are in the U.S. District Court for the Southern District of Florida. The Alani Nu case is docketed as No. 26-cv-62465, per a law-firm notice dated October 8, 2026. The Pepsi case is No. 24-cv-81472, a consolidation of suits filed November 22, 2024 and January 14, 2025, led by Shelby Township Police v. Celsius Holdings, Inc.
A third, unrelated consumer case — Dubreu v. Celsius Holdings Inc., No. 5:25-cv-00180 in the Central District of California — claims buyers were misled about Celsius's financial ties to social-media promoters. That one is covered with the drink cases on our Celsius energy drink lawsuit page. Celsius's own court-case summaries are in its quarterly SEC report (Note 15).
Status: Investor Suits Pending, No Settlement
Alani Nu investor case (26-cv-62465): just past the filing stage. Investors who bought between February 21, 2025 and June 3, 2026 can ask the court to be appointed lead plaintiff by November 3, 2026. That is a deadline to volunteer for a leadership role, not a deadline to get paid.
Pepsi investor case (24-cv-81472): a magistrate judge recommended dismissal on December 4, 2025; the court dismissed the complaint with leave to amend on March 31, 2026. Plaintiffs refiled on April 20, 2026, Celsius moved to dismiss again on May 20, 2026, and that motion was fully briefed on July 21, 2026. We found no ruling on it as of October 2026.
Consumer promoter case (5:25-cv-00180): dismissed with leave to amend on June 17, 2026; an amended complaint followed on July 8, 2026, and motion papers were still being filed on October 12, 2026.

Who Is Covered
Investor cases: the proposed classes are people who bought Celsius stock in the class periods — February 21, 2025 to June 3, 2026 for the Alani Nu case, and May 9, 2023 to November 5, 2024 for the Pepsi case. You do not have to sign up or apply to be lead plaintiff to stay in a class; if there is ever a recovery, a court-approved notice goes to class members. Keep your brokerage trade confirmations.
People who drink Celsius or Alani Nu: the investor suits do not cover you. The only consumer case still pending is the promoter case in California, and no class has been certified there.
Celsius Network (crypto): a different company entirely — see the FAQ below.
Is There Money? Not Yet
The last Celsius payment to consumers came from the “no preservatives” settlement: buyers from January 1, 2015 to November 23, 2022 could get up to $250 with proof of purchase or $20 without, if they filed by February 13, 2023. That window is closed.
Two Celsius money events that are not class payouts: the company paid a $3.0 million civil penalty to settle an SEC accounting-controls inquiry on January 17, 2025, and a Florida court entered a $101.1 million judgment for Strong Arm Productions on April 17, 2026 in an endorsement-contract dispute, which Celsius has appealed.
How cases like this one end
Our copy of the federal courts’ own case database covers 17,074 federal civil cases of this typeclosed in U.S. federal district courts between 2015 and 2026, 27.1% of them filed as class actions:
- 8.9% ended in a settlement recorded by the court. Another 40.8% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 8.9% and 49.7%.
- 10.1% were decided on a motion before any trial.
- 1 in 151 reached a trial (0.7%), after a median of 37.3 months.
- Median time from filing to the end of the case: 4.6 months.
- Only 1,032 of them (6%) record a money award at all; the median of those is $1,079,500.

Three Things to Watch For
Three different Celsius names in the news make this an easy target:
“Claim your Celsius $250” posts
The $250 no-preservatives payment closed on February 13, 2023. Old articles and social posts still circulate. A site taking your details for it today is not filing anything.
Celsius Network “claims portal” emails
The bankruptcy case website warns of emails posing as Celsius or Stretto that ask creditors to log in, enter wallet details and use a one-time code, often promising USDC or ether. Real distributions are bitcoin or cash, never sent straight to your wallet.
“Deadline to get paid: November 3”
November 3, 2026 is the lead plaintiff deadline in the Alani Nu investor case — not a claim deadline. Investors do not lose class membership by ignoring it, and no fee is needed to stay in.
Celsius Class Action Lawsuit — Questions People Actually Ask
Short answers to the questions people ask most about this case.
What is the Celsius class action lawsuit in the news right now?
A shareholder suit, No. 26-cv-62465 in the Southern District of Florida, claiming Celsius hid the risks and teen marketing of its Alani Nu drinks from investors. It covers stock purchases from February 21, 2025 to June 3, 2026. The lead plaintiff deadline is November 3, 2026.
Who won the Celsius lawsuit?
No one has won the pending class actions. The 2023 “no preservatives” case ended in a settlement, not a verdict. In the Pepsi investor case Celsius won a dismissal on March 31, 2026, but plaintiffs were allowed to refile and did. Separately, Strong Arm Productions won a $101.1 million judgment on April 17, 2026, which Celsius is appealing.
Is there a Celsius class action lawsuit payout date?
No. As of October 23, 2026, no Celsius case has a settlement, so there is no payout date. The last consumer payment came from the settlement whose claim deadline was February 13, 2023.
I drink Celsius or Alani Nu. Can I join?
Not the investor suits — they cover stock buyers only. The pending consumer case in California is about promoter ties, not caffeine, and has no certified class. Details are on our Celsius energy drink lawsuit page.
I bought CELH stock. Do I need to do anything by November 3?
Only if you want to apply to lead the case, which is optional. Class members who do nothing stay in the proposed class. Keep your trade records for the class period.
Is this about Celsius Network, the crypto lender?
No. Celsius Network filed for Chapter 11 on July 13, 2022, Case No. 22-10964 in the Southern District of New York bankruptcy court; its plan was confirmed November 9, 2023. Creditor questions go to the official case site. The energy drink company is unrelated.
Is Celsius being sued over a death linked to Alani Nu?
A wrongful-death suit filed April 8, 2026 in Hidalgo County, Texas names a former Alani Nu distributor, not Celsius. Celsius says it must indemnify that distributor and calls the claims without merit. The lawsuit alleges the person died of cardiomyopathy allegedly caused by excessive caffeine consumption.
Is the Texas Attorney General investigating Celsius?
Yes. Celsius reports receiving a civil investigative demand from the Texas Attorney General in June 2026 under the state's consumer-protection law, and says it is cooperating. An investigation is not a finding of wrongdoing.
