Liberty Mutual Lawsuit: The $13.4 Million 401(k) Settlement and Three Other Cases
Active Litigation
Claim deadline was August 22, 2026 · as of Oct 23, 2026
The Liberty Mutual class action most people are reading about is a $13.4 million settlement over the company’s own employee 401(k) plan — a federal judge approved it in September 2026. It pays employees and former employees, not policyholders. Separately, drivers are in a certified class over rental-car coverage after a total loss, and customers sued over a 2026 data leak. As of October 2026, the 401(k) deal is the one with a claim process, and its claim deadline has passed.

What Each Liberty Mutual Case Is About
There is no single “Liberty Mutual lawsuit.” Four separate cases sit behind the searches:
1. The 401(k) fee case (settled). Employees alleged that Liberty Mutual caused its 401(k) Plan to pay excessive fees for recordkeeping and administrative services and kept imprudent investment options, in violation of ERISA. Liberty Mutual denied the claims and still denies wrongdoing.
2. The rental-car case (headed for trial). Policyholders allege Liberty Mutual Personal Insurance Company limited rental-vehicle coverage after a total loss to fewer than 30 days without assessing how long the driver actually needed to replace the car. Liberty Mutual denies the allegations.
3. The Liberty Mutual data breach suit (early stage). The ransomware group Everest claimed in spring 2026 to hold 108 gigabytes of Liberty Mutual data. The lawsuit alleges names, dates of birth, Social Security numbers, financial and health-insurance information of “at least 15,630” current and former clients were taken. Liberty Mutual said its review found no compromise of its own systems and pointed to “a third-party service provider who may be impacted.”
4. Two smaller matters. A New Mexico class action over minimum-limit underinsured-motorist coverage settled for $6.5 million, and a separate 401(k) forfeiture suit in California was dismissed with leave to amend.

Who Is Covered by Each Case
401(k) settlement: “All participants and beneficiaries of the Liberty Mutual 401(k) Plan from April 10, 2014 through December 31, 2025.” If you still had a balance in the plan on December 31, 2025, you are a Current Participant and did not need to do anything. If you had no balance on that date, you are a Former Participant and had to file a claim form by August 22, 2026. Policyholders who never worked at Liberty Mutual are not in this class.
Rental-car case: Liberty Mutual Personal Insurance Company auto policyholders nationwide with Optional Transportation Expense Coverage who claimed rental benefits after a total loss and got fewer than 30 days of coverage. There are extra subclasses for Missouri and Illinois residents. If you did nothing, you are still in the class.
Data breach: the proposed class is current and former clients whose data was exposed. No class has been certified. Keep any breach notice letter you receive.

How cases like this one end
Our copy of the federal courts’ own case database covers 64,910 erisa casesclosed in U.S. federal district courts between 2015 and 2026, 1.8% of them filed as class actions:
- 42.7% ended in a settlement recorded by the court. Another 23.1% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 42.7% and 65.7%.
- 6.2% were decided on a motion before any trial.
- 1 in 295 reached a trial (0.3%), after a median of 22.8 months.
- Median time from filing to the end of the case: 6.2 months.
- Only 5,008 of them (7.7%) record a money award at all; the median of those is $102,500.

Three Things to Watch For
Several Liberty Mutual cases in the news at once make it easy for imposters to sound plausible:
“Claim your Liberty Mutual data breach payout”
There is no breach settlement and no claim form. A site asking for your Social Security number or policy number to “register” is collecting data, not filing anything.
Late “401(k) claim” offers
The former-participant deadline was August 22, 2026, and current participants are paid into their plan accounts automatically. No one can file late for you for a fee. The real administrator is Analytics Consulting LLC at 866-550-8022.
Policyholders told they are owed 401(k) money
The $13.4 million settlement covers only participants in Liberty Mutual’s employee 401(k) plan. A call or text telling an auto or home customer they have money waiting from it is false.
