Polk v. American Well Corp., Case No. 25CV026746, Superior Court of California, County of Sacramento, Department 8A, Judge Jill H. Talley (per the latest filings). Final-approval papers now on the settlement website show that, as of October 8, 2026, the administrator Simpluris had received 6,105 claims from a class of 250,566 people who used LiveHealth Online’s appointment booking tool between October 2024 and August 2025. Class counsel asks for $679,250.48 in fees and costs and a $5,000 service award, and Simpluris puts administration at $73,491.00. If all of that is approved and the count stayed at 6,105, each share of the $2,037,751.46 fund would be about $209.67, by our arithmetic. The claim deadline is October 30, 2026, and the final approval hearing is January 15, 2027.

The new numbers: 6,105 claims out of 250,566 class members as of October 8
The LiveHealth Online data sharing settlement now has its first real numbers. In a declaration signed on October 15, 2026 and filed with the motion for final approval, the administrator Simpluris reports that “As of October 8, 2026, Simpluris has received and processed a total of 6,105 Claim Forms.” The class list Amwell handed over had 252,478 records; after removing duplicates, Simpluris counts 250,566 potential class members. So as of October 8, about 2.4% of the class had filed, by our arithmetic. Every approved claim gets the same share, so a low claims rate means a bigger payment for each person who files.
If you used the appointment booking tool on livehealthonline.com or in the LiveHealth Online app for iPhone or Android between October 2024 and August 2025, you are probably in the class. The claim deadline is October 30, 2026, for online and paper claims. The fund is $2,037,751.46. The only defendant is American Well Corp. (Amwell), whose platform runs LiveHealth Online. The lawsuit, Polk v. American Well Corp., says Amwell “disclosed its customers’ medical information and confidential communications to third parties, without permission”. Amwell “denies that it violated any law”, and the court has not decided who is right.
The same declaration shows how notice went out. Starting August 31, 2026, emails went to 229,025 validated addresses, and 197,162 were delivered as of October 8. On September 3, postcards with a detachable claim form went to 21,518 people who had a valid mailing address. Of those, 1,863 came back, 1,668 were re-mailed and 195 could not be delivered. In total, Simpluris says notice reached 218,485 class members, or 87.20%. The website had 69,233 views from 32,674 unique visitors, and the toll-free line had taken 61 calls. As of October 8, there was one exclusion request and no objections. No claim had been flagged as deficient, and all claims are still “under review, including the full assessment of each Claim’s validity and review for duplicate submissions.”
What that means for your payment: about $210 at the October 8 count, less as more people file
The settlement pays a “pro rata (meaning equal) share”. Fees, the service award and administration costs come out first. The final-approval papers now put a number on each one. The proposed order asks the court to award class counsel $679,250.48 in fees and costs, which is the one-third maximum, plus a $5,000 service award to the class representative. Simpluris puts its total cost, including future work, at $73,491.00. That is $11,353 more than the $62,138 limit the court set at preliminary approval, which applies “absent good cause”. The papers we could read do not explain the difference. The court decides all three amounts.
If the court approves every amount requested, deductions total $757,741.48 and $1,280,009.98 is left for claimants, by our arithmetic. Divided among the 6,105 claims counted on October 8, that is about $209.67 per claim, or roughly $210. That is well above the notice’s estimate of $51.14 to $102.29. But it is only a snapshot. More claims are likely to come in before the deadline, and a reminder email campaign began on October 1. Some claims may also be rejected as invalid or duplicates. Here is how the share changes as the number of approved claims grows:
| Approved claims (our scenarios) | Per claim, by our arithmetic |
|---|---|
| 6,105 (count as of October 8, 2026) | ~$209.67 |
| 10,000 | ~$128 |
| 12,500 | ~$102.40 |
| 15,000 | ~$85.33 |
| 20,000 | ~$64 |
| 25,000 | ~$51.20 |
This assumes every requested deduction is approved and ignores interest on the escrow account. If the judge cuts the fees or the administration cost, every share goes up. The FAQ says class members “can contact Class Counsel to inquire as to the number of claims filed” at info@Bursor.com.
What to do by October 30, 2026
File online at LiveHealthOnlineSettlement.com using the Login ID and PIN from your email or postcard notice. No notice? Use the paper claim form on the website. The FAQ says you can submit by “printing and mailing a paper Claim Form” to LiveHealth Online Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. It must be submitted by October 30, 2026. Payment comes by check “unless you elect to receive payment by PayPal or Venmo”, and checks expire 180 days after they are issued. If a claim is deficient, Simpluris sends a notice and gives you 21 days to fix it.
Opting out or objecting. These deadlines are also October 30, 2026. If you opt out, you keep your right to sue Amwell yourself but get no payment. If you object, you stay in the class and file a written objection with the court. If you do nothing, you get no money and still give up your claims once the settlement is approved.
Is the LiveHealth Online settlement email real?
Yes, if it matches the court-filed copy. Simpluris filed the actual email as Exhibit A to its declaration. It comes from “LiveHealth Online Settlement” noreply@LiveHealthOnlineSettlement.com and has the subject line “Legal Notice of Class Action Settlement”. It names Polk v. American Well Corp., Case No. 25CV026746, starts with “Our Records Indicate You Have Used the Appointment Booking Tool on LiveHealth Online” and shows a personal Login ID and PIN. The reminder email that started October 1 uses the same sender and subject. The real contacts are LiveHealthOnlineSettlement.com, (888) 369-3797 and info@LiveHealthOnlineSettlement.com. The filing shows the toll-free number has been active since August 24, 2026.
To be safe, do not click links in the email. Type the website address yourself and enter your Login ID there. Be wary of any other website domain that claims to handle LiveHealth Online claims.
What the court decides on January 15, 2027, and when money could move
The final approval hearing is set for January 15, 2027, at 9:00 a.m. in Department 8A. The new filings name Judge Jill H. Talley, while FAQ 1 on the website still names Judge Richard K. Sueyoshi. The hearing address also differs on the site. FAQ 8 and the proposed order point to 500 G Street, but FAQ 19 still lists the Hall of Justice at 813 6th Street. As of October 20, 2026, the court-filed papers are the safer guide, and the hearing can be moved without new notice.
Class counsel drafted the amended proposed order, which was served on October 16, 2026. Besides the fees and the service award, it does three things. First, it would send any uncashed or untransferred money, plus interest, to the Electronic Privacy Information Center (EPIC), after a report due 150 days after the Effective Date. Second, it would schedule a settlement compliance hearing for May 14, 2027, at 10:30 a.m., with class counsel reporting on distribution at least 15 days before. Third, it notes that as of October 8 there were no objections and one exclusion. This is a draft. The judge can change it or refuse to sign it.
The FAQ says approved claimants get paid “45 days after the Settlement has been finally approved and/or any appeals process is complete.” The proposed order sets the compliance hearing for May 14, 2027 and requires class counsel to file a status declaration on the distribution by then. That fits with payments in spring 2027 if the court approves the settlement on January 15 and nobody appeals. That is our reading, not a promised date. An appeal could delay payments by months.
