Haney v. Graco Children's Products, Inc., No. 1:26-cv-04471-TRJ, was filed in the Northern District of Georgia on August 7, 2026 — not September 3, which is the date the trade coverage carries and which is really just the day the story was written up. The complaint alleges that the Graco Slim Spaces Compact Baby Swing accelerates on its own to high speeds, that the speed controls stop responding when it does, and that in some cases the only way to stop it is to pull the batteries out. Parents searching for this are almost always asking one question: has it been recalled? We queried the Consumer Product Safety Commission's own recall service directly. The answer is no — and we ran two control queries to make sure the answer was real and not a broken search. Here is the entire record, including the three model numbers named in the complaint and the one date that actually matters next.

The question parents are actually asking

Searches for this case spike around the words recall and lawsuit together, which tells you what people want to know: is the swing in my living room subject to a safety recall, and is there something I am supposed to file? Both answers are no, and the second one is worth stating plainly because several content sites have already begun describing this case in language that sounds like a claims process.

What does exist is a filed complaint containing allegations that no court has ruled on, and a paper trail of consumer reports going back years. That is a real story, but it is a different story from a recall.

We queried the CPSC recall service directly — and control-tested the answer

A search that returns nothing is worthless unless you can show the search works. We queried the Consumer Product Safety Commission's public recall service at saferproducts.gov/RestWebServices/Recall three times in the same session:

Two independent sources agree. The complaint itself states that Graco “has not issued a recall, has not corrected its product listing or issued a warning to consumers.” And Consumer Reports, which has covered the swing since November 2024, reported that it asked the CPSC to investigate and that the agency declined to comment.

Graco's position, quoted in the complaint from a Newell Brands response to a CPSC complaint, is that it “does not believe that the specific product identified contains any defect that could create a substantial product hazard or unreasonable risks of serious injury or death.”

Which swings the complaint names

Footnote 1 of the complaint defines the products as the Graco Slim Spaces Compact Baby Swing, Model Nos. 2156182, 2231532, and PD349399E, “and all substantially similar infant swings sold by Graco.” That last clause is deliberate: plaintiffs write it so the list can grow during discovery. Treat the three numbers as what is named today, not as a closed list — and do not read a model number that is absent as a model number that is cleared.

The swing lists at about $109.99 on Graco's own site. The named plaintiff bought hers on Amazon on November 20, 2025 for $95.99. Distribution named in the complaint: Graco's website, Amazon, Target and Walmart.

What the complaint alleges, in its own words

The central allegation is that the swings “spontaneously … [accelerate] to high speeds without any user input—including when set on the lowest setting—rendering the speed controls completely inoperative.” According to the complaint the speed cannot be brought back down once this starts, the behaviour persists after a battery change, and in some cases the swing stops only when the batteries are removed.

The complaint pairs that with a marketing claim it says is false: that Graco advertises multiple swing speeds and states on its website that “[e]ven when the product's battery is low, the swing rate will not exceed the rate of the highest setting.”

On knowledge, the complaint points to one-star reviews across Graco's own site, Amazon, Target and Walmart, with posts on at least one retail platform going back to March 2020. It alleges that as of late October 2024, 42 percent of Walmart reviews for one colour variant were one-star, and that 82 reviews on Graco's product page contained the words “too fast.”

Nine counts are pleaded: California's False Advertising Law, the Consumers Legal Remedies Act and the Unfair Competition Law, plus breach of express and implied warranty, negligent misrepresentation, fraudulent misrepresentation and omission, breach of contract and unjust enrichment. Two classes are proposed — a nationwide class of purchasers and a California subclass.

None of this has been tested. No court has found a defect, and no agency has acted.

Where the case stands, and the only date that matters

Graco has not filed an answer and has not moved to dismiss. October 1 is when the case first shows its shape: an answer means a fight on the facts, a motion to dismiss means a fight on whether the claims can be brought at all. Either way, a consumer settlement — if one ever comes — is years away, and there would be a court-approved notice program long before anyone needs to fill in a form.

The case is before District Judge Tiffany R. Johnson in the Atlanta Division. Jurisdiction is federal under CAFA, 28 U.S.C. § 1332(d)(2), with the plaintiff pleading more than $5 million in controversy. The only defendant is Graco Children's Products, Inc. Newell Brands is named in the complaint as the parent company and as the author of a response to a CPSC complaint, but it is not a defendant.

What you can actually do right now

There is nothing to file and nothing to join. What there is:

  • Report it to the CPSC yourself at saferproducts.gov. The complaint cites three such reports by number (4685071, 4979436, 4897578), one of which was forwarded to Graco in April 2024. Reports are how an agency decides whether to open a case, and there is no cost to filing one.
  • Keep the swing, the box and the receipt. If a class is ever certified or a settlement ever reached, proof of purchase and the model number are what determine whether you are in it.
  • Be careful with anything that asks you to “register your claim” for this case. There is no claim process, so any site collecting your details for one is collecting them for something else.

Graco last issued a CPSC recall of any product on December 16, 2020. Its recall history does include swings: 140,000 Travel Lite swings in July 2004, and roughly seven million infant swings in April 2000 over a restraint system a child could slide out of. That history is context for how such a recall looks when it happens — not evidence that one is coming here.
