The Boston Scientific lawsuit in the news right now is a data breach class action filed after the August 25, 2026 cyberattack that stalled the company’s manufacturing and shipping. Separately, investors are suing over a February 2026 stock drop, and patients with spinal cord stimulators have a federal MDL. As of October 2026 none of these has a settlement, a fund, a claim form or a deadline.

What the Lawsuits Are About
There are three different cases, and they involve different people.
The cyberattack suits. On August 25, 2026 Boston Scientific identified a cybersecurity incident that, in its own words, caused “a global disruption” to operations, including the ability to process and ship customer orders. Its September 7, 2026 SEC filing said unauthorized activity on its systems caused a network outage that also hit manufacturing. Data breach class actions followed within a week. The suits allege the company failed to protect information on its systems; those are allegations, not findings.
The investor suit. Shareholders allege that the company made false and misleading statements about guidance and growth in its U.S. electrophysiology business before the stock fell on February 4, 2026.
The spinal cord stimulator cases. Patients allege they were injured by Boston Scientific SCS devices and that the company failed to warn of and concealed the risks. That litigation has its own page: spinal cord stimulator lawsuit.
Case Details
Data breach: In re Boston Scientific Data Breach Litigation, No. 1:26-cv-14017, U.S. District Court for the District of Massachusetts, Judge Julia E. Kobick, first complaint filed September 1, 2026. A second Massachusetts suit, Maniscalco v. Boston Scientific Corp., No. 1:26-cv-14038, is docketed under that lead case. A third, O’Hara v. Boston Scientific Corp., No. 0:26-cv-03951, was filed September 9, 2026 in the District of Minnesota before Judge Donovan W. Frank.
Securities: In re: Boston Scientific Corporation Securities Litigation, No. 1:26-cv-40075 (D. Mass.), Judge Julia E. Kobick, filed March 5, 2026 as Troike v. Boston Scientific Corporation under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934. Four shareholder derivative suits in the same court repeat those allegations; two also raise the safety of batteries in Accolade devices.
Spinal cord stimulators: In re Boston Scientific Corporation Spinal Cord Stimulator Products Liability Litigation, MDL No. 3181, No. 2:26-ml-03181-JLS-E, Central District of California, Judge Josephine L. Staton.
Status: Early Stage, No Settlement
The cyberattack suits are weeks old. The company’s own position cuts against them: on September 22, 2026 it published a summary of CrowdStrike’s forensic investigation, which found the attacker reached “a limited portion” of its on-premises IT and found “no evidence” that customer or patient data was accessed, staged or exfiltrated from the systems it reviewed, including email and HR and employee-benefits systems. The plaintiffs have not conceded that, and no court has ruled on it.
In the investor case, the court appointed the Indiana Public Retirement System as lead plaintiff on May 20, 2026, and an amended complaint was filed July 20, 2026. Boston Scientific said two of the four derivative suits (Valen and Feder) were consolidated and stayed until the anticipated motion to dismiss in the securities case is finally resolved. The SCS MDL is in pretrial proceedings.

Who Could Be Affected
Cyberattack suits: the class definitions in the complaints were not public in documents we could read. Lawyers recruiting for these cases are seeking current and former employees, affiliated providers and patients. As of October 2026 we found no individual breach notice from Boston Scientific. If you get one, keep it: it is the document that says what of yours was involved.
Investor suit: people who bought Boston Scientific stock (BSX) during the class period alleged in the complaint. You do not need to sign up; if there is ever a settlement, notice goes to shareholders of record through brokers.
SCS cases: patients implanted with a Boston Scientific spinal cord stimulator who say they were injured. These are individual injury claims, not a class you are automatically in. Details are on our spinal cord stimulator lawsuit page.
Is There a Boston Scientific Settlement or Payout?
The settlements people sometimes find under “Boston Scientific settlement” are older: in its mid-2026 quarterly report the company says it has entered into individual and master settlement agreements to resolve the majority of its transvaginal mesh claims. Those are negotiated through the injured women’s own lawyers and have nothing to do with the 2026 cyberattack.
For context only: breach class actions that do settle usually pay documented losses plus a small flat amount, and only where personal data was actually exposed. The data breach settlement calculator shows typical ranges.

Three Things to Watch For
A widely reported cyberattack with no claim form is the gap scammers use:
“Boston Scientific breach settlement” claim pages
There is no settlement and no claims site. A page asking for your Social Security number or bank details to “claim your share” is collecting data, not filing anything.
Calls about your implanted device
Patients with stimulators, pacemakers or other implants are an easy target for callers who say the cyberattack affected your device. The forensic summary found no compromise of medical device maintenance systems. Check anything about your device with your doctor, not a caller.
Fake shareholder “recovery” offers
Investors may get pitches to recover BSX losses for an upfront fee. A securities class action charges nothing upfront, and no settlement exists to recover from.
Boston Scientific Lawsuit — Questions People Actually Ask
Is there a class action lawsuit against Boston Scientific?
Yes, several. Data breach class actions over the August 2026 cyberattack were filed in September 2026 in Massachusetts and Minnesota, and an investor class action has been pending in Massachusetts since March 5, 2026. Spinal cord stimulator injury cases are consolidated in MDL No. 3181, which is not a class action.
Is there a Boston Scientific lawsuit payout or settlement?
Not as of October 11, 2026. No Boston Scientific class action has a settlement, fund, claim form or deadline. Anyone telling you otherwise is wrong or selling something.
Was my personal data stolen in the Boston Scientific cyberattack?
Not according to the company. Its September 22, 2026 update says CrowdStrike found no evidence that customer or patient data was accessed, staged or exfiltrated from the systems reviewed. The lawsuits dispute how well Boston Scientific protected its systems; no court has decided anything.
Why is Boston Scientific struggling?
Two reasons are on the public record. The stock fell on February 4, 2026 after fourth-quarter results, which triggered the investor suit. Then the August 25, 2026 cyberattack disrupted manufacturing and shipping, and on September 7, 2026 the company said it was unlikely to meet its third-quarter and full-year 2026 guidance.
I have a Boston Scientific spinal cord stimulator. Which lawsuit is mine?
Not the breach or investor cases. Injury claims over Boston Scientific SCS devices are consolidated in MDL No. 3181 before Judge Josephine L. Staton. See our spinal cord stimulator lawsuit page.
Do I need to sign up to be part of the Boston Scientific class action?
No. If a class is certified or a settlement is approved, members are notified and included unless they opt out. Nothing needs to be filed now.
Was the J&J patent suit a lawsuit against Boston Scientific?
No, the reverse. The patent case made public on October 8, 2026 was brought by Boston Scientific against Atraverse Medical, a Johnson & Johnson unit, in Delaware federal court over its Hotwire heart device. It does not involve patients or consumers.
What is worth doing right now?
Keep any letter or email from Boston Scientific about the incident. If you are a current or former employee or a patient and are worried, a credit freeze at the three bureaus is free and reversible. Watch for a court-approved notice, which would name the case number.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
