Pfizer’s $44 Million Chantix Settlement Won Final Approval on October 13, 2026 — but 3,581,486 Consumer Claims Share a Pool Capped at 20%, and No Payment Date Has Been Set

In re Chantix (Varenicline) Marketing, Sales Practices and Products Liability Litigation (No. II), No. 22-MD-3050 (KPF), United States District Court for the Southern District of New York, Judge Katherine Polk Failla. After a fairness hearing on October 13, 2026, Judge Failla signed the judgment granting final approval of Pfizer’s $44,000,000 settlement with people and health plans that paid for Chantix between September 29, 2015 and September 17, 2021; it was entered on the docket on October 14, 2026. There were no objections and one request for exclusion. The same day the court awarded class counsel $14,666,666.67 in fees and $144,340.20 in expenses. The administrator, A.B. Data, had logged 3,581,486 consumer claims and 17,885 health-plan claims, none of them validated as of September 28, 2026 — and all consumer payments together are capped at 20% of the net fund. The settlement pays only after the judgment becomes final, and as of October 19, 2026 no payment date has been announced.

Pfizer’s $44 Million Chantix Settlement Won Final Approval on October 13, 2026 — but 3,581,486 Consumer Claims Share a Pool Capped at 20%, and No Payment Date Has Been Set — key figures at a glance

Affected by this? Pfizer Lawsuits and Settlements: Where Each Case Stands →

The answer: approved on October 13, 2026 — paid later, date not set

The hearing our Pfizer lawsuit tracker was watching happened as scheduled. Judge Katherine Polk Failla held the fairness hearing on October 13, 2026, and the judgment she signed that day says: “this Court hereby fully and finally approves the Settlement set forth in the Settlement Agreement in all respects” and finds it “fair, reasonable and adequate.” The judgment was filed on October 14, 2026 as Document 152. It records that “there were no objections to the Settlement or the allocation plan and one request for exclusion.” The judge dismissed the claims against Pfizer with prejudice and told the clerk to close the case.

Final approval is not the same as payment. If you are searching for a Pfizer settlement payment date: as of October 19, 2026 there isn’t one. The settlement agreement says payments to people with approved claims “shall be made as soon as practicable after the Effective Date,” and that date only arrives after the judgment becomes “Final” — which means the time to appeal has run out, or any appeal is over. When we checked on October 19, 2026, the official site, ChantixSettlement.com, had posted the judgment on its Court Documents page, but its home page still showed the old notice about the October 13 hearing and gave no payment date.

How long does it take to receive payment from a class action lawsuit? In this case, three clocks run first

The court notice answers “When will I get my payment?” with this: “If the Court approves the Settlement, there may be appeals. It is always uncertain when appeals will be resolved, and even if no appeals are filed, it also takes time for the Settlement Administrator to process all claims and make payments. Please be patient.” The documents set out the order of steps:

  • The appeal window. In a federal civil case, a notice of appeal “must be filed with the district clerk within 30 days after entry of the judgment” (Federal Rule of Appellate Procedure 4(a)(1)(A)). The judgment was entered on October 14, 2026.
  • “Final,” then the Effective Date. The agreement defines “Final” as one business day after the appeal time runs out (or after any appeal ends with the judgment upheld). The Effective Date is “the date ten (10) Days after” that.
  • Pfizer’s money. Pfizer was required to pay a $500,000 advance for administration costs within 20 days of preliminary approval, and must pay “the remaining amount of the Settlement Fund ($43,500,000) within twenty (20) Days after Final Judgment.”
  • Claim review. As of September 28, 2026, A.B. Data said: “None of the claims received have yet been validated, and the figures reported above are necessarily preliminary.” Claims with fixable problems get a chance to be corrected.

The judgment says the separate fee order “shall not affect or delay the Effective Date.”

Who gets what: consumers share at most 20%, health plans get the rest

The $44,000,000 fund is “non-reversionary” — no money goes back to Pfizer. Before anyone is paid, the agreement takes out administration costs, service awards, taxes and the fee award. Judge Failla’s October 13 order gives class counsel $14,666,666.67 in fees (one third, the most the notice said they would ask for) and $144,340.20 in expenses, plus $15,000 to each health-plan plaintiff and $5,000 to each consumer plaintiff. Nobody objected to the fees.

What remains is split two ways. “Total payments to consumer Settlement Class Members will be capped at 20% of the Available Settlement Fund,” paid pro rata based on what each person paid for Chantix, and no consumer gets more than they paid. Third-party payors — insurers and health plans — split the rest, based on their documented payments.

Our arithmetic, not a court or administrator figure: $44,000,000 minus the fees and expenses leaves $29,188,993.13, before administration costs, service awards and taxes. Twenty percent of that is $5,837,798.63, the most that all consumers together could receive. Divided across the 3,581,486 preliminary consumer claims, that averages about $1.63 per claim. Real payments will depend on how many claims are approved and how much each person paid, and neither figure has been published. You choose payment “by check or electronic payment”. If payments go unclaimed for 180 days after they are issued, the money is redistributed pro rata to the people who did claim.

What to do now — and what is already closed

If you filed a claim by September 14, 2026: you don’t need to do anything new to stay in line. Keep your mailing and email details up to date with the administrator, and answer it if it asks for documents — the agreement lets A.B. Data “require documentation to support any claim.”

If you did not file: the claim deadline was September 14, 2026, the same date as the deadline to opt out or object. The official site states that if you did nothing, you “will receive no payment under the Settlement” and give up your right to sue Pfizer over these claims. One limit matters: the judgment says the release does “not encompass any claims for medical monitoring or personal injury related to the purchase or use of Chantix.” This settlement covers money paid for the drug, not health harm.

Real or a scam? How to check a Chantix settlement message

The genuine site is ChantixSettlement.com, “maintained by the Settlement Administrator” A.B. Data. Its toll-free number is 1-877-354-3912, and its mailing address is Chantix Settlement, c/o A.B. Data, Ltd., P.O. Box 173137, Milwaukee, WI 53217. The notice described filing as “completely free.” Claiming is closed, and there is no fee to release, speed up or “unlock” a payment. If a message asks for a payment, a gift card, or your full bank login, treat it as a scam. Check it by calling the number above yourself; don’t use a number or link from the message.

How much has Pfizer paid out in compensation? Is Depo-Provera part of this?

We can’t verify a total for everything Pfizer has paid across all its cases, so we won’t give one. For this case: the $44,000,000 is about 5.5% of the roughly $805.6 million in Chantix sales that class counsel’s final-approval brief used as the yardstick. Pfizer “believes it did nothing wrong and denies that it violated any law.”

Depo-Provera is a different case and is not part of this settlement. The brain-tumor (meningioma) lawsuits are consolidated as MDL No. 3140 in the Northern District of Florida. Judge M. Casey Rodgers’ Case Management Order No. 14 says Pfizer and the Pharmacia companies entered a settlement program in an “agreement dated July 22, 2026,” run by the administrator BrownGreer, with “no admission of fault or liability.” Its registration deadline is November 30, 2026, and it works through the injured person’s lawyer, not through ChantixSettlement.com. Details are on our Depo-Provera lawsuit tracker.

What happens next

These are the dated steps in the court record and settlement documents, as of October 19, 2026:

  • October 13, 2026 — fairness hearing held; final approval and fee order signed.
  • October 14, 2026 — judgment entered (Document 152). Under Appellate Rule 4(a)(1)(A), any notice of appeal is due within 30 days after entry of the judgment.
  • Within 20 days after Final Judgment — Pfizer’s deposit of the remaining $43,500,000.
  • Ten days after the judgment becomes Final — the Effective Date; service awards become payable.
  • “As soon as practicable after the Effective Date” — payments to approved claimants, by check or electronic payment.
  • 180 days after issuance — unclaimed payments are redistributed pro rata to claimants who cashed theirs.

The administrator has not published a calendar date for any payment. We will update our Pfizer case page when it does.

How a 2021 recall became a $44 million settlement

The buyers alleged that Pfizer’s quit-smoking drug Chantix contained an undisclosed nitrosamine, N-nitroso-varenicline, which led to a recall. Their claims were for economic loss: money paid for a drug they say they would not have bought, or would have paid less for. The cases were consolidated before Judge Failla in New York. After a full-day mediation on March 11, 2026, the parties signed a settlement in May 2026. Judge Failla granted preliminary approval on June 1, 2026, and notices went out from July 13, 2026. A.B. Data reported 131,167 unique visitors to the settlement website through August 31, 2026. On September 28, 2026 the parties fixed a scrivener’s error in the agreement’s exclusion language, and class counsel moved for final approval. The judgment closes the main case along with its member cases.
