The short answer: this is a pilots’ settlement, and nobody has to file a claim

If you searched for the Alaska Airlines settlement because you fly with Alaska, this one is not for you. The $500,000 deal covers only Alaska pilots, and only a specific group of them: “all current and former Alaska pilots who took military leave lasting between 31 and 60 consecutive days at any time from October 10, 2004, through March 31, 2026, and who did not accrue vacation during those military leaves,” in the words of the official settlement site. Excluded are people who already settled or won a judgment on the same claims. Class counsel, working from Alaska’s data, “has identified 163 Class Members.”

As of October 11, 2026, the settlement has preliminary approval only. Judge Robert S. Lasnik signed the preliminary approval on August 17, 2026, notices went out by mail on September 16, 2026, and the court will decide whether to grant final approval at a hearing at 11:00 a.m. on December 10, 2026, at the federal courthouse at 700 Stewart Street in Seattle. Pilots who are in the class get paid automatically: “No claim form is required to receive a payment.” If the court does not approve the deal, the site says, the agreement “will become null and void, and the parties will resume their former positions in the lawsuit.”

Who gets what: paid by the month of vacation accrual you lost

The money is not split evenly. The official FAQ explains that each pilot gets a pro rata share of the net fund based on the number of monthly bid periods in which they did not accrue vacation because of a qualifying 31-to-60-day military leave, as shown in Alaska’s records. “The 163 Class Members collectively experienced 666 such months.” The formula is “(the Class Member’s number of non-accrual months ÷ 666) × the net Settlement Fund.” Each mailed notice included an individual statement of the pilot’s non-accrual months and an estimate of the award; that estimate, not any number in the news, is the figure to rely on.

Before anything is divided, the fund pays court-approved attorneys’ fees and litigation expenses, settlement administration costs, any taxes owed by the fund and a service award to the class representative, a retired Air Force Reserve lieutenant colonel and former Alaska pilot. Class counsel “will not seek fees exceeding $247,500.00, plus reimbursement of litigation expenses,” and the service award request is capped at $5,000. Some news reports describe the $247,500 as covering fees and expenses together; the official FAQ says expenses come on top. Counsel say they spent “more than 1,000 hours” over more than seven years, and note that USERRA lets winning service members recover fees from the employer, so no fees can be charged to class members personally.

By our arithmetic, if the court awards the full $247,500 in fees and the full $5,000 service award, at most $247,500 is left, before expenses, administration costs and taxes, none of which have been published. That is just over $371 per lost month and an average of no more than about $1,518 per pilot. Actual payments will be lower than these ceilings. “No portion of the Settlement Fund will revert to Alaska.” According to Bloomberg Law, the plaintiffs’ preliminary approval motion said the amount “meets or exceeds” the estimated value of the vacation accruals the pilots say they were denied.

When the money arrives is not stated on the official site or in the notice as of October 11, 2026. Simple Flying reported that payments come only “after final approval and resolution of any appeals,” which would mean not before December 10, 2026 at the earliest. The official site does not say whether payments will be treated as wages for tax purposes.

What to do and the deadlines: October 31 for opt-outs and objections

Pilots in the class have three options. Do nothing, and you will be paid under the plan of allocation. Exclude yourself, and you get nothing from the settlement but keep your right to sue Alaska yourself over these claims. Object, and the judge will consider your objection at the hearing. You cannot both opt out and object. Exclusion requests and objections must be in writing, sent to the settlement administrator, and postmarked on or before October 31, 2026. Both need your name, address, email address and telephone number, the case title Synoracki v. Alaska Airlines, Inc., Case No. 2:18-cv-01784-RSL (W.D. Wash.), and your signature and date. An exclusion request needs a statement that you want to be excluded; an objection needs your grounds and whether you plan to appear at the hearing.

Staying in has a price: pilots who do not opt out release their right to sue Alaska “for the failure to accrue vacation time under USERRA in connection with military leaves of up to 90 days taken while employed at Alaska through March 31, 2026,” plus other claims arising from the same facts. That release is wider than the 31-to-60-day leaves that are paid, because the amended complaint originally sought accrual for leaves of 31 to 90 days. The full release is in Section XIII of the settlement agreement. You do not have to attend the December 10 hearing. The FAQ warns that it “may be continued to another date or conducted remotely without further notice to the Class; any changes will be posted on this website.”

Real or scam: a mailed notice to a short list of pilots

The settlement is real and the website is genuine. AlaskaMilitaryLeaveSettlement.com names the case, the court and the case number, and its contact page lists “Synoracki v Alaska Airlines c/o Simpluris, Inc.” as the administrator. The court-ordered notice states: “A federal court authorized this Notice. This is not a solicitation from a lawyer.” Because the 163 class members were identified from Alaska’s own records, there is nothing to sign up for. A message offering “Alaska Airlines settlement” money to passengers or the general public, or asking you to file a claim or pay a fee for this case, does not match the official terms. If in doubt, call the administrator’s number above. Do not use the number in the message.

Many people searching for an Alaska Airlines settlement have a cancelled or delayed flight in mind. This case does not cover that. Under the Department of Transportation’s rule, 14 CFR 260.6, a U.S. airline “must provide a full and prompt refund of the airfare” when it cancels or significantly changes a flight and the passenger turns down the alternative. Those requests go to the airline first and, if refused, to the Department of Transportation. Another common question, which airline Alaska bought: Alaska’s purchase of Hawaiian Airlines was completed on September 18, 2024, according to AirlineGeeks. Hawaiian employees are not part of this settlement, which is limited to Alaska pilots.

How a 2018 lawsuit got here

The suit was filed on December 12, 2018. It claimed that USERRA requires service members on military leave to be treated no less favorably than employees on comparable leave, and that Alaska pilots stopped accruing vacation in months when military leave left them below the minimum compensation threshold, while pilots on jury duty kept accruing. Alaska answered on February 7, 2019, denying the claims. The court certified classes of pilots who did not accrue sick or vacation time during military leave on May 22, 2020, then granted summary judgment to Alaska in 2022.

The Ninth Circuit revived part of the case. In an order filed October 16, 2024, it vacated the judgment in part and sent the case back in light of Clarkson v. Alaska Airlines, Inc., 59 F.4th 424 (9th Cir. 2023), a related military-leave case against the same airline. As settlements go, this is a small one, and its main effect is for the few pilots involved. The next date on the record is the October 31, 2026 postmark deadline, followed by the December 10, 2026 hearing. We will update this story once the court rules on final approval and fees.
