What the Kentucky Lawsuit Says

According to the complaint, baptisthealth.com carried third-party tracking tools — Google’s DoubleClick, Microsoft Clarity and Bing, and Adobe’s tools — that sent visitors’ activity to those companies without consent. The plaintiffs allege this covered searches for doctors and specialties, booking appointments, calls placed through the site, and access to the patient portal, including clicks that took a patient to the MyChart login page.

One example in the complaint: the trackers allegedly learned that a user had searched for an English-speaking neurosurgeon in Illinois who sees adults 65 and older. The complaint names Google, Microsoft and Adobe as the recipients — not Meta. These are allegations; no court has found them true.

The plaintiffs plead a federal wiretap claim (18 U.S.C. § 2511), breach of confidence, intrusion upon seclusion, unjust enrichment and breach of implied contract, and they ask for statutory damages among other relief.

Case Details

R.B. v. Baptist Healthcare System, Inc., No. 3:26-cv-00295, U.S. District Court for the Western District of Kentucky, before Judge Claria Horn Boom. Filed April 22, 2026 by four plaintiffs identified only by initials, who say they sue anonymously to protect their health information. One of them is an Illinois resident; the complaint describes Baptist as having locations in Kentucky, Indiana and Illinois.

On June 5, 2026 Baptist filed a Rule 12(b)(6) motion to dismiss, and it filed its reply brief on July 9, 2026. The public docket is on CourtListener.

Status: Motion to Dismiss Pending, No Settlement

Active, at the pleading stage. As of October 6, 2026, the latest filing we could confirm in the Kentucky case is Baptist’s July 9, 2026 reply brief; we could not confirm a ruling on the motion. No class has been certified. There is no settlement, no fund, no administrator, no claim form and no deadline.

The fight is over federal wiretap law. Baptist argues that one party to a communication — itself — consented, and that the “crime-tort exception” does not apply because advertising is a “non-criminal, non-tortious purpose.” It also argues the claims fail under Kentucky or Illinois common law. In its words, the Wiretap Act has been “weaponized by plaintiffs’ class action attorneys to sue health care providers.” The same question is on appeal in the Endeavor Health case.

Which Baptist Treated You? System by System

Baptist Health (Kentucky, Indiana, Illinois) — baptisthealth.com. This is the tracking case. The proposed nationwide class is “all individuals residing in the United States who used Defendant’s Website” and had information intercepted by the tracking tools, with a Kentucky subclass. Its portal is called MyChart; the app is MyHealth.

Baptist Health South Florida. No tracking case found. It is a defendant in the Oracle Health (Cerner) breach litigation — the Baptist Health data breach most people in Florida got a letter about. See below.

Baptist Health (Arkansas) — baptist-health.com. No tracking case found. Becker’s reported that Baptist Health Medical Center-Drew County found unauthorized access between April 22 and July 8, 2024; we found no class settlement tied to it.

Baptist Memorial Health Care (Tennessee, Missouri, Arkansas). No tracking case or patient-breach settlement found. Its one settlement we found was for job applicants, and it is closed.

Baptist Health Jacksonville. No case found. Its portal is called My Baptist Chart.

What Tracking Cases Like This Have Paid

Nothing is payable from any Baptist Health lawsuit as of October 6, 2026: no settlement, no fund, no claim form. For context only, not a prediction: Wellstar agreed to $4.25 million for about 870,000 patients, with claims due November 10, 2026. SSM Health’s MyChart settlement paid $31.50 per claim. The Christ Hospital in Ohio settled for $7,000,000 for more than 323,000 people. MemorialCare’s fund was $750,000 for 182,303 people. Florida patients received real breach notices. Follow-up emails or texts asking you to “reactivate MyChart” through a link are a classic phishing pattern — type the portal address yourself.

Is there a Baptist Health MyChart lawsuit?

Yes, in Kentucky. R.B. v. Baptist Healthcare System, Inc., No. 3:26-cv-00295 in the Western District of Kentucky, alleges that baptisthealth.com shared visitors’ activity, including access to the patient portal, with Google, Microsoft and Adobe. It is at the motion-to-dismiss stage as of October 6, 2026.

Is there a settlement or a claim form?

No. No Baptist system has a tracking settlement, fund, administrator or claim deadline. If that changes, class members are notified by a court-approved administrator.

Did Baptist Health use the Meta Pixel?

The Kentucky complaint does not name Meta as a recipient. It names Google (DoubleClick), Microsoft (Clarity and Bing) and Adobe. We found no Meta Pixel lawsuit against any Baptist system as of October 6, 2026.

I’m a Baptist patient in Arkansas, Tennessee or Florida. Am I in the Kentucky case?

Probably not as a patient of those systems — they are separate organizations. The proposed class is anyone in the United States who used baptisthealth.com, the Kentucky, Indiana and Illinois system’s website. If you used that site, you could fit the definition wherever you live.

Is there a Baptist Health data breach settlement?

Not that we found. Baptist Health South Florida is a defendant in the consolidated Oracle Health breach case, Blount v. Oracle Health, Inc., No. 4:25-cv-00259 in the Western District of Missouri. Per reporting, the stolen data included names, Social Security numbers, dates of birth, medication details and diagnostic information. That case has no settlement.

I saw a Baptist Memorial settlement online. Is it real?

It was real but it is closed. Stewart v. Baptist Memorial Health Care Corporation, No. 2:21-cv-02377 in the Western District of Tennessee, paid job applicants over background-check disclosures: up to $26 or up to $500. The claim deadline was July 29, 2024.

Do I need to do anything now?

No. Under Rule 23 you do not sign up for a class. It helps to note when you last used baptisthealth.com or MyChart and what you did there, and to keep any breach letter. Baptist Health’s MyChart support line is 502.253.4820.

What happens next in the Kentucky case?

Judge Claria Horn Boom decides the motion to dismiss. If the wiretap claim survives, the case moves to discovery and, later, class certification. If it is dismissed, there is nothing to pay. Either way, a settlement is not near.
