What the Lawsuit Says Happened

The lawsuit alleges that Wellstar Health System, Georgia’s hospital network, installed tracking pixels, cookies and similar tools on its public website and its patient portal, and that these sent patients’ personally identifiable and protected health information to third parties — including Meta and Google — without consent. Per ClassAction.org’s summary of the complaint, the tools named are Google Analytics, the Meta Pixel and Google Tag Manager.

The amended complaint pleaded invasion of privacy, breach of confidence, negligence, negligence per se, breach of implied contract, breach of contract, unjust enrichment and violation of the federal Electronic Communications Privacy Act. Wellstar denies the allegations, and the court has not decided who is right. This is not a hacking case: nobody broke in. The claim is that the website itself passed data along.

Case Details

Doe v. Wellstar Health System, Inc., No. 1:24-cv-01748, U.S. District Court for the Northern District of Georgia, before Judge J.P. Boulee. A plaintiff using the name Jane Doe filed it on April 23, 2024; an amended complaint added three more Doe plaintiffs on August 2, 2024. On August 21, 2025 the court granted Wellstar’s motion to dismiss in part and denied it in part: the unjust enrichment and federal wiretap (ECPA) claims went forward. The parties then exchanged discovery, and the settlement agreement was filed on July 22, 2026. Judge Boulee granted preliminary approval on July 28, 2026. Epic Systems, which makes the MyChart software, is not a defendant. This is the only Wellstar MyChart class action we found.

Why this is in the news: a widely indexed guide titled “Wellstar MyChart Settlement ($4.25M): Status & Claim Info” says claims “closed on February 20, 2026,” names a different website, and describes a $75 flat payment. Who Is in the Settlement Class

The class is “all persons residing in the United States whose information was disclosed to a third party between February 19, 2020 and July 22, 2026 through Tracking Technologies on Wellstar’s Web Properties” — meaning wellstar.org and the Wellstar MyChart portal. The parties estimate about 870,000 people. Judges and their staff, Wellstar’s officers and directors, and class counsel are excluded.

The practical test is your inbox. Under the settlement agreement, the main notice goes by email to the address you used on Wellstar’s web properties; people without a usable email address get a letter. The notice carries a Unique ID and PIN for the online claim form. A paper claim form is also available from the official site. How Much the Wellstar Settlement Pays

There is no fixed amount per person. The $4,250,000 fund is non-reversionary, so none of it returns to Wellstar. Out of it come notice and administration costs, attorneys’ fees of up to one third (about $1,416,666.67, if the court grants the full request), litigation costs, and service awards of $2,500 for each of the four class representatives. What is left is split in equal, pro rata shares among the people who file valid claims. If you do nothing, you get nothing and are still bound by the settlement.

The documents publish no per-person estimate, because the share depends on how many people file. With about 870,000 class members, the figure is small if many file and larger if few do. Any page promising a specific dollar amount — including a “$75 flat payment” — is not quoting the court-approved notice. Money left over after uncashed checks goes to a court-approved charity; the parties propose Good Samaritan Health Center of Cobb. At least one widely indexed guide says Wellstar claims closed on February 20, 2026 and names a different website. The court-approved notice sets November 10, 2026. Check dates only at WellstarDataPrivacySettlement.com or by calling 1-877-417-7863.

Look-alike Wellstar settlement domains

The only website named in the court notice is WellstarDataPrivacySettlement.com. A site with “mychart” in its address, or one asking for your Social Security number, card number or a fee, is not the claim form. Type the address yourself instead of clicking a link.

“Guaranteed” payout amounts

This settlement pays equal shares of what remains after costs and fees, divided among people who file. No one can promise $75, $500 or any other figure. A caller or ad quoting a fixed amount, or offering to file for a cut, is not from the administrator.
