What the Endeavor Health Lawsuit Alleges
Two patients, Arnold Stein and Diane Miller, sued Edward-Elmhurst Health in Cook County Circuit Court in 2023. The lawsuit alleges that the Meta Pixel was embedded in web portals patients use to book appointments and find care, and that it sent “every click, keystroke and detail about their medical treatment” to Facebook, tied to each user's Facebook ID.
According to the plaintiffs, the purpose was marketing. Later reporting describes the alleged recipients as third parties such as Meta and Google. The plaintiffs say they used both the website and the patient portal. The sources we found do not name the portal; Edward-Elmhurst's portal has been Edward-Elmhurst MyChart.
Endeavor Health and hospital groups supporting it argue that the alleged purposes, such as improving website functionality, were lawful. None of the allegations has been proven.
Case Details
The case was removed to the U.S. District Court for the Northern District of Illinois on October 4, 2023: Stein v. Edward Elmhurst Health, No. 1:23-cv-14515, before Judge Steven C. Seeger. An amended complaint followed on February 20, 2024.
On February 21, 2025 Judge Seeger let two claims proceed — the federal Electronic Communications Privacy Act (wiretap) claim and an Illinois negligence claim — and dismissed the rest. In March 2026 he refused to reconsider, but certified the wiretap question for an immediate appeal. The appeal is No. 26-8004 at the U.S. Court of Appeals for the Seventh Circuit. The plaintiffs are represented by Almeida Law Group and Stephan Zouras.
Status: Appeal Pending, No Settlement
The fight is over the “crime-tort exception.” Federal wiretap law lets one party to a conversation consent to recording — unless the interception is for a criminal or tortious act. Judge Seeger held that a disclosure allegedly violating HIPAA can qualify. The U.S. Chamber of Commerce (May 27, 2026), the American Hospital Association and the Illinois Health and Hospital Association filed briefs urging reversal.
If the Seventh Circuit reverses, the wiretap claim could fall. If it affirms, the case returns to Judge Seeger. Either way, nothing is payable now.

Who Could Be Affected
The lawsuit is a proposed class action on behalf of people who used Edward-Elmhurst's website and patient portal. Until a court certifies a class or approves a settlement, nobody is formally in or out. You do not need to sign up to stay included.
Which Endeavor portal did you use? Endeavor Health was formed in 2022 from NorthShore University HealthSystem and Edward-Elmhurst Health. Patients currently see several portals: Edward-Elmhurst MyChart, NCH MyChart, NorthShoreConnect and the new MyEndeavor. The pending lawsuit names Edward-Elmhurst only. We found no tracking lawsuit about NorthShore, NorthShoreConnect or NCH MyChart.
Our form on this page asks whether you used the website or MyChart, what you did there, and when you last used it. Those details — booking an appointment, searching a condition, logging in to view results — are what tracking cases turn on.
What Patients Can Expect
For context only, other hospital tracking cases have settled. Wellstar Health agreed to $4.25 million, with claims due November 10, 2026. The Christ Hospital in Ohio paid a $7,000,000 fund for more than 323,000 people. SSM Health's claims closed November 25, 2025, and payments began March 31, 2026. These are other hospitals' cases, not a prediction for Endeavor Health — see open MyChart claim forms and our MyChart settlement calculator.
The $55 million NorthShore settlement is a different case. In re NorthShore University HealthSystem Antitrust Litigation, No. 1:07-cv-04446, is about inpatient prices after the Highland Park Hospital merger, not tracking. It covers people who paid NorthShore directly for inpatient care from February 10, 2000 to December 31, 2015. The claim deadline, April 4, 2024, has passed. The court approved the settlement on May 6, 2024, and the official site says claims are still being processed.
How cases like this one end
Our copy of the federal courts’ own case database covers 133,968 insurance casesclosed in U.S. federal district courts between 2015 and 2025, 1.1% of them filed as class actions:
- 46.4% ended in a settlement recorded by the court. Another 19.7% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 46.4% and 66%.
- 6.7% were decided on a motion before any trial.
- 1 in 148 reached a trial (0.7%), after a median of 22.8 months.
- Median time from filing to the end of the case: 8.8 months.
- Only 1,306 of them (1%) record a money award at all; the median of those is $317,000.

Three Things to Watch For
Three things about this case make Endeavor patients easy targets right now:
“Claim your Endeavor Health MyChart settlement”
There is no Endeavor Health or Edward-Elmhurst tracking settlement and no claims site. A page asking for your MyChart login, date of birth or Social Security number to “reserve your share” is collecting data, not filing a claim.
The $55 million NorthShore notice resurfacing
The NorthShore antitrust settlement is real, but its claim deadline passed on April 4, 2024. Anyone offering to file a late NorthShore claim for a fee — or presenting it as a MyChart payout — is misleading you.
Fake MyEndeavor switch emails
Edward-Elmhurst MyChart and NCH MyChart move to MyEndeavor on November 7, 2026. Expect real emails about usernames — and fakes. Type my.endeavorhealth.org yourself instead of clicking a login link.
Endeavor Health Lawsuit — Questions People Actually Ask
Is there an Endeavor Health MyChart lawsuit?
Yes. Stein v. Edward-Elmhurst Health, No. 1:23-cv-14515 in the Northern District of Illinois, alleges that tracking tools on Edward-Elmhurst's website and patient portal sent patients' information to Meta. Edward-Elmhurst is now part of Endeavor Health. As of October 2026 it is on appeal at the Seventh Circuit, No. 26-8004.
Is there a settlement or claim form?
No. As of October 6, 2026 there is no settlement, no fund, no administrator, no claim form and no deadline. If that changes, a court-approved notice will name the administrator and the official website.
Was there an Endeavor Health data breach?
We found no Endeavor Health data breach lawsuit — no ransomware, insider or vendor breach case — as of October 6, 2026. The tracking lawsuit is about data allegedly shared through website code, not a hack. If you received a breach letter, keep it; it names the entity and the data involved.
Did NorthShore have a pixel settlement?
Not that we could find. NorthShore's $55 million settlement resolved an antitrust case over inpatient prices, No. 1:07-cv-04446. Its claim deadline was April 4, 2024. We found no tracking lawsuit naming NorthShore or NorthShoreConnect.
What is the appeal actually about?
Whether federal wiretap law's crime-tort exception applies when a hospital allegedly shared health data for advertising. Judge Seeger said a disclosure that allegedly violates HIPAA can count. Endeavor Health and hospital groups argue the alleged purposes were lawful. The Seventh Circuit's answer decides whether the wiretap claim survives.
I used NorthShoreConnect or NCH MyChart. Am I covered?
The pending lawsuit names Edward-Elmhurst Health only, and its proposed class is tied to Edward-Elmhurst's website and patient portal. We found no tracking case about NorthShoreConnect or NCH MyChart as of October 2026.
Do I need to do anything now?
No filing is possible. Note when you used the Edward-Elmhurst website or MyChart and what you did there — booking, searching a condition, viewing results. Our form records exactly that, so you can act quickly if a settlement is ever announced.
Will the MyEndeavor switch affect the lawsuit?
Not as far as any public filing shows. Edward-Elmhurst MyChart moves to MyEndeavor on November 7, 2026, and messaging stops on November 5. The lawsuit concerns past tracking, so your eligibility, if a class is ever certified, would not depend on which portal you use later.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
