What an Employment Lawsuit Can Be About

Federal law makes it illegal to discriminate against an applicant or employee because of race, color, religion, sex (including pregnancy, transgender status and sexual orientation), national origin, age (40 or older), disability or genetic information — and to retaliate against someone who complained, filed a charge or took part in an investigation. That covers hiring, pay, promotion, firing and harassment.

A second, separate family of claims is about wages: unpaid overtime, miscalculated pay rates, late paychecks. These run under the Fair Labor Standards Act and state wage laws, not through the EEOC.

An employment class action is either kind of claim brought for a whole group of workers at once. Wage cases are the most common employment class action lawsuit, because one payroll rule touches everyone paid under it. A class action employment lawsuit over discrimination — what searchers call a class action lawsuit employment discrimination case — usually attacks a company-wide practice — a pay structure, a hiring test, a promotion system. Case Details

Discrimination: the EEOC comes first. To sue under federal law for discrimination or retaliation, you first have to file a charge with the EEOC. The deadline is generally 180 calendar days from the discriminatory act, extended to 300 days where a state or local agency enforces a similar law. Each event has its own clock — a demotion and a later firing are two deadlines. For ongoing harassment, the clock runs from the last incident. Federal employees generally must contact an agency EEO Counselor within 45 days.

Once the EEOC issues a Notice of Right to Sue, you have 90 days to file in federal or state court. You can request that notice early; after 180 days from your charge, the EEOC must give it if you ask. Age claims can go to court any time after 60 days from the charge.

Equal pay and wages: straight to court. Equal Pay Act claims need no EEOC charge; the deadline is two years from the last discriminatory paycheck, three if willful. Federal overtime and minimum-wage claims under the FLSA (29 U.S.C. 255) also carry a two-year limit, three years for willful violations. State wage laws may differ.

Status: Two Employment Settlements in the News, October 2026

1. Calderon v. Public Partnerships, LLC — U.S. District Court, Eastern District of New York, No. 1:25-cv-02320. Home care personal assistants paid through Public Partnerships LLC (PPL), the fiscal intermediary for New York’s CDPAP program, alleged they were paid late or inaccurately and received benefits that did not comply with the Home Care Worker Wage Parity Act. PPL denies the allegations. On July 1, 2026, Magistrate Judge Lara K. Eshkenazi granted preliminary approval of a proposed $162 million settlement and appointed Atticus Administration. Notices went out by email and text on July 21. The final approval hearing is set for November 10, 2026. Official site: publicpartnershipssettlement.com.

2. Featherstone v. FCA US, LLC — U.S. District Court, Eastern District of Michigan, No. 2:23-cv-10362, before Judge Linda V. Parker. Hourly workers allege FCA miscalculated their regular rate when computing overtime; FCA denies it. Judge Parker granted preliminary approval of a $3,795,000 settlement on May 1, 2026 and set the final approval hearing for August 25, 2026. Are You Part of an Employment Class Action?

Calderon (PPL): about 200,000 personal assistants paid through PPL for work in New York City, Long Island or Westchester County between March 1, 2025 and April 30, 2026. Per the plaintiffs, eligible workers do not need to take any action now.

Featherstone (FCA US): current and former hourly employees of FCA US, LLC in the United States between February 10, 2020 and May 12, 2025 — about 68,000 people. The deadline to opt out was June 22, 2026 and the deadline to dispute your payroll data was June 10, 2026; both have passed. If you did nothing, you stay in.

Everyone else: in employment cases, the employer’s payroll records usually identify the class, so the notice finds you. If you have your own claim against your own employer, no class action will file it for you — the EEOC and wage deadlines above are yours to meet.

What an Employment Settlement Pays

Class wage settlements pay from payroll data, not receipts. In Featherstone, the $3,795,000 gross amount first pays court-approved attorney fees, service awards and administration costs; the rest is divided by a formula, and your estimate is on the mailed postcard. Payment comes only after final approval, final judgment and any appeal.

Individual discrimination cases can include back pay, reinstatement and fees. Compensatory and punitive damages together are capped by employer size: $50,000 (15–100 employees), $100,000 (101–200), $200,000 (201–500) and $300,000 (more than 500). Age and Equal Pay Act cases get liquidated damages equal to back pay instead.

Scale: in fiscal year 2025 the EEOC recovered $660 million for 17,680 people — $528 million before any lawsuit, and only $27 million for 2,505 people through litigation. Most employment money changes hands before court. More on settlement amounts: discrimination settlement amounts.

How cases like this one end

Our copy of the federal courts’ own case database covers 77,206 fair labor standards act casesclosed in U.S. federal district courts between 2015 and 2026, 19.2% of them filed as class actions:

  • •53.2% ended in a settlement recorded by the court. Another 14.6% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 53.2% and 67.9%.
  • •3.9% were decided on a motion before any trial.
  • •1 in 116 reached a trial (0.9%), after a median of 25.7 months.
  • •Median time from filing to the end of the case: 8.6 months.
  • •Only 4,859 of them (6.3%) record a money award at all; the median of those is $71,000.

    Judge Linda V. Parker approves the $3,795,000 deal for notice and sets a final approval hearing for August 25, 2026.

    Magistrate Judge Lara K. Eshkenazi grants preliminary approval from the bench; notices go out by email and text on July 21.

Three Things to Watch For

Both live settlements notify workers by text, email or postcard — which is exactly what imposters copy:

Texts asking PPL caregivers to “verify” for the $162 million

Real Calderon notices went out on July 21 by email and text. Eligible workers do not need to act now. A message asking for your Social Security number, bank login or a fee to release your share is not from the court-appointed administrator.

“Claim your FCA overtime check” forms

Featherstone has no claim form: payments are calculated from FCA payroll records. A site asking hourly workers to register or pay a processing fee is not part of the settlement — check only the official site.

“Join the employment class action” sign-ups

You do not sign up to be in a class; if you are in the class definition, you are included unless you opt out. A retainer agreement is a real contract, not registration. Read it before signing.

What is an employment lawsuit?

A civil case a worker or applicant brings against an employer — for discrimination, harassment, retaliation, wrongful firing or unpaid wages. For how civil cases work in general, see what is a civil lawsuit.

How long do I have to file?

For federal discrimination claims, an EEOC charge within 180 calendar days, or 300 days where a state or local agency enforces a similar law. After a Notice of Right to Sue, 90 days to sue. Equal Pay Act and FLSA wage claims: two years, three if willful.

Is being treated differently discrimination?

Only if the different treatment is because of a protected trait: race, color, religion, sex (including pregnancy, transgender status and sexual orientation), national origin, age 40 or older, disability or genetic information — or retaliation for complaining. Unfair treatment for other reasons may be a bad job, but it is not discrimination under these laws.

Who fights for workers' rights?

For discrimination, the EEOC — the only federal agency authorized to investigate and sue private employers under federal anti-discrimination laws. It litigates only a small percentage of charges; in fiscal year 2025 it processed 88,201 new charges. Workers can also sue on their own after the EEOC step.

Is there an employment settlement I can claim right now?

Not by filing a form, as far as the sources show: Featherstone has no claim form, and in Calderon eligible workers do not need to take any action now. How much is an employment settlement worth?

It depends on the claim. Federal caps on compensatory and punitive discrimination damages range from $50,000 to $300,000 by employer size, on top of back pay. Class wage settlements divide a net fund by a payroll formula. Our guide to what a settlement means explains the steps.

When will the PPL and FCA settlements pay?

Not before final approval. The Calderon hearing is November 10, 2026. In Featherstone, the hearing was set for August 25, 2026, and as of October 11, 2026 no payment date is posted. Appeals can delay payment further.

What should I do right now?

Write down dates — every discriminatory act, complaint and paycheck — because each one can start a deadline. Keep pay stubs and any class notice. If a deadline is near, contact the EEOC or a licensed attorney before it passes.
