RCI Lawsuit: What Happened, and Why There Is No Claim Form Now

RCI is the timeshare exchange company owned by Travel + Leisure Co. The well-known RCI class action lawsuits are old: a Weeks members’ case settled in 2010, and the Points case, Glenz v. RCI, ran into trouble in court in 2012 and 2013. What is new is a settled SEC action filed against the parent company on September 30, 2026 — about timeshare loan disclosures, not exchanges. As of October 2026 there is no open RCI settlement, no claim form and no deadline.

What the RCI Class Action Lawsuits Alleged
Every major lawsuit against RCI from its members makes the same core complaint. Owners deposit their timeshare weeks into RCI’s exchange pool expecting other members to get them. The lawsuits allege RCI instead rented a share of those weeks, including prime ones, to the general public for profit, leaving fewer good exchanges for members.
The Points case, Glenz v. RCI, was filed in January 2009. The complaint alleged a “fraudulent, deceptive and unconscionable marketing scheme” and sought damages under New Jersey’s Consumer Fraud Act, for breach of the implied covenant of good faith and fair dealing, and for breach of fiduciary duty. RCI denied wrongdoing.
Separately, a December 2023 proposed class action, Stone v. RCI, LLC, alleges unwanted telemarketing calls to numbers on the National Do Not Call Registry, under the Telephone Consumer Protection Act.
Case Details
Points members: Glenz v. RCI, LLC, No. 9-cv-378 (PGS), U.S. District Court for the District of New Jersey, before Judge Peter G. Sheridan, filed January 27, 2009.
Weeks members: an earlier New Jersey class action over the Weeks program settled in 2010; per Wikipedia, the settlement took effect July 28, 2010 after appeals were resolved.
Telemarketing: Stone v. RCI, LLC, No. 4:23-cv-00291-WMR, a federal case in Georgia filed December 11, 2023.
Parent company: Securities and Exchange Commission v. Travel + Leisure Co., No. 26-cv-62760, U.S. District Court for the Southern District of Florida, filed September 30, 2026.
United Kingdom: Abbott & Ors v RCI Europe [2016] EWHC 2602 (Ch), High Court, London.
Status as of October 2026: No Open RCI Settlement
Glenz (Points): a 2012 proposed RCI settlement would have paid $12 to current and $10 to former Points members who filed a claim by August 24, 2012. That deadline passed long ago. An objector reported that the court denied the settlement after a December 6, 2012 fairness hearing, and on January 11, 2013 Judge Sheridan adjourned a further approval hearing until an independent expert could review the proposed changes. We could not confirm a final approval order or any payout after that, so treat claims that “everyone got $12” as unverified.
Weeks: settled in 2010. Closed.
Stone (telemarketing): we could not confirm its current status; we found no announced settlement.
SEC v. Travel + Leisure Co.: settled. Without admitting the allegations, the company consented to a judgment, subject to court approval, with a civil penalty of $975,000. A penalty goes to the government; it is not a consumer fund. See open class action settlements for cases that are actually taking claims.
Who Was Covered
Glenz: the proposed class was all U.S. residents who were members of the RCI Points Exchange Program, directly or through a vacation club, on or before April 25, 2012. The claim window under that proposal closed August 24, 2012.
Stone: the complaint seeks a class of people in the United States who got two or more RCI telemarketing calls in a 12-month period while their number was on the Do Not Call Registry. No class has been certified that we could confirm.
SEC case: no consumer class at all. The SEC alleges that from October 2019 to February 2021 the parent removed over 2,900 delinquent or defaulted timeshare loans, about $77 million in balances (roughly $34 million in default), through rescission without disclosing it to investors. If your loan was rescinded, that was a release from the loan, not a claim you can file now.

How cases like this one end
Our copy of the federal courts’ own case database covers 123,245 other contract casesclosed in U.S. federal district courts between 2015 and 2025, 5.8% of them filed as class actions:
- 30.9% ended in a settlement recorded by the court. Another 20.2% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 30.9% and 51.1%.
- 7.6% were decided on a motion before any trial.
- 1 in 71 reached a trial (1.4%), after a median of 29.3 months.
- Median time from filing to the end of the case: 7.6 months.
- Only 7,369 of them (6%) record a money award at all; the median of those is $402,000.

Three Things to Watch For
Timeshare owners are a heavily targeted group, and an RCI headline is an easy hook:
“Claim your RCI settlement money” calls
There is no open RCI settlement. A caller who says you are owed money from an RCI class action lawsuit and asks for an upfront fee or your bank details is not a settlement administrator.
“The SEC case cancels your timeshare”
The September 2026 SEC action is about what the parent told investors. It does not cancel, refund or rescind anyone’s contract, and the SEC does not hire exit companies to contact owners.
Exit firms promising “lawsuit-backed” refunds
Timeshare exit pitches often cite old RCI rulings to sound credible. The UK test claimants did not prove individual loss, and the Glenz deal offered $12 at most. Never pay upfront for a promised recovery.
RCI Lawsuit — Questions People Actually Ask
Is there an RCI class action lawsuit right now?
The main RCI class action cases from members are old: Weeks members settled in 2010 and the Points case, Glenz v. RCI, was filed in 2009. A telemarketing class action lawsuit against RCI, Stone v. RCI, LLC, was filed December 11, 2023; we could not confirm its current status. As of October 2026 none has an open claim process.
Is there an RCI settlement I can file a claim in?
No. The only RCI settlement claim form we found was for the Glenz Points deal, with a deadline of August 24, 2012. There is no current fund, administrator or deadline.
Did RCI members actually get paid $12?
That was the proposal: $12 for current and $10 for former Points members. But an objector reported the court denied the settlement after the December 6, 2012 hearing, and the judge delayed approval again on January 11, 2013. We could not verify a final approval or payment, so treat reports of a $12 payout as unconfirmed.
What was the class action lawsuit RCI members brought about?
The lawsuits allege that RCI rented out weeks members had deposited for exchange, including prime weeks, to the general public, while marketing the pool as for members. RCI denied wrongdoing.
What is the new SEC lawsuit against RCI’s parent?
On September 30, 2026 the SEC filed a settled action against Travel + Leisure Co., No. 26-cv-62760 in the Southern District of Florida. It alleges misleading disclosures about removing over 2,900 delinquent or defaulted timeshare loans from its portfolio. The company did not admit the allegations and agreed to a $975,000 civil penalty, subject to court approval. It is not a lawsuit against RCI’s exchange program.
Did the UK lawsuit against RCI Europe pay anything?
A group of about 500 UK members sued RCI Europe. The October 2016 High Court judgment, [2016] EWHC 2602 (Ch), found RCI was in breach of contract and had misled members, but the test claimants were not found to have proved individual loss. We found no confirmed payout.
I keep getting RCI sales calls. Do I have a claim?
That is what Stone v. RCI, LLC, No. 4:23-cv-00291-WMR, is about: calls to numbers on the National Do Not Call Registry. It is a proposed class, not a settlement. Keep a log of dates and numbers; if a settlement is ever approved, notice comes from a court-appointed administrator.
What should I do right now?
Nothing needs to be filed. Ignore anyone charging a fee to collect RCI settlement money, and check any notice against the court docket before giving out personal details.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
