What the Novant Health Lawsuit Was About
In May 2020 Novant Health ran a Facebook ad campaign to get more patients onto its patient portal, which is called Novant Health MyChart. To measure the ads, it placed a Meta tracking pixel on its website. In Novant’s own words the pixel “was configured incorrectly” and may have sent information from the website and MyChart to Meta.
On June 17, 2022 Novant determined that health information may have been sent. In August 2022 it notified 1,362,296 patients — reportedly the first health system to report a pixel problem to the HHS Office for Civil Rights. Depending on what a patient did, the data could include email address, phone number, IP address, emergency-contact and advance-care-planning entries, appointment type and date, the doctor selected, button clicks and text typed into free-text boxes.
The lawsuits alleged that this invaded patients’ privacy and broke promises Novant made about their records. Novant denied all wrongdoing and settled without admitting liability.
Case Details
The first complaint was filed on August 23, 2022 in the U.S. District Court for the Middle District of North Carolina as Curry v. Novant Health, Inc., No. 1:22-cv-00697. On October 19, 2022 the court consolidated four cases under that number as In re: Novant Health, Inc.; a fifth was added later. Chief District Judge Catherine C. Eagles presided.
Novant moved to dismiss on December 23, 2022. Per the court’s later order, only two state-law claims survived — breach of fiduciary duty and breach of implied contract. The parties settled soon after. The judge granted preliminary approval on November 6, 2023 and appointed Postlethwaite & Netterville (P&N) as settlement administrator.
Status: Settled, Paid Out and Closed
There is no Novant settlement claim to file today, and the case cannot be reopened for new claimants. If you were in the class and did not opt out, your claims over the pixel were released. As of October 8, 2026 we found no other Novant Health lawsuit over website or MyChart tracking, and no ransomware, insider or vendor breach case against Novant with a settlement or deadline.
Who Was in the Class
The class covered people living in the U.S. whom Novant identified as possibly having their personal or health information sent to a third party through tracking tools on Novant’s websites or MyChart portal between May 1, 2020 and August 12, 2022 — about 1,362,165 people. Notice went by email and postcard and reached 1,349,789 of them (99.2%).
The deadline to opt out or object was April 4, 2024. Only 37 people opted out, and there were no objections. The claim deadline was May 6, 2024, and about 11.7% of the class filed a valid claim.
If you used MyChart after August 12, 2022, you were not in this class. Our form on this page asks whether you used the Novant website or MyChart, what you did there and when you last used it. That helps us compare your situation with cases that are still open at other hospitals.
What the Novant Settlement Paid
The administrator paid $4,009,027.97 to 160,297 valid claims. That works out to about $25 per claim (our calculation from the administrator’s report; the court documents give no per-person figure). In mid-October 2024, $414,490.73 in payments had still not been cashed. By the end of November 2024 that had dropped to approximately $296,000, and the court later sent the leftover money to EPIC.
For comparison, the Advocate Aurora Health pixel case settled for $12.225 million and is also closed — see our Advocate Aurora page. To find hospital tracking settlements that are still taking claims, see MyChart class action claim forms.
How cases like this one end
Our copy of the federal courts’ own case database covers 111,990 other personal injury casesclosed in U.S. federal district courts between 2015 and 2025, 3.6% of them filed as class actions:
- 39.9% ended in a settlement recorded by the court. Another 13.8% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 39.9% and 53.7%.
- 5.7% were decided on a motion before any trial.
- 1 in 106 reached a trial (0.9%), after a median of 23.9 months.
- Median time from filing to the end of the case: 9 months.
- Only 771 of them (0.7%) record a money award at all; the median of those is $500,000.

Three Things to Watch For
A closed settlement that people still search for leaves room for misleading offers:
The old settlement website
The official site for this case was NHPrivacySettlement.com. When we checked it on October 8, 2026, that address showed a foreign online-casino page, not the settlement. Do not follow old links from 2024 articles, and do not enter personal information there.
“Recover your unclaimed Novant money” offers
There is no pool of unclaimed Novant settlement money waiting for you. The court sent the uncashed funds to EPIC, and on March 24, 2025 it found the fund fully spent. Anyone charging a fee to “recover” your share is selling nothing.
Requests for your MyChart login
No settlement administrator or court needs your MyChart username, password or medical records to check whether you qualify. A form or caller asking for them about a “new Novant settlement” is phishing.
Novant Health Lawsuit — Questions People Actually Ask
Is there a Novant Health MyChart lawsuit I can still join?
No. In re: Novant Health, Inc., No. 1:22-cv-00697, settled for $6,660,000. The claim deadline was May 6, 2024, final approval came June 17, 2024, and the court confirmed on March 24, 2025 that the fund was fully spent. As of October 8, 2026 we found no newer Novant tracking lawsuit.
How much did the Novant Health settlement pay per person?
About $25 per valid claim, based on $4,009,027.97 paid to 160,297 claims in the administrator’s October 2024 report. The amount was set by dividing the net fund equally among claimants. It was not tied to what data you shared.
I never got a payment. Can I still get one?
Almost certainly not. Checks and electronic payments had to be cashed by November 14, 2024. The court then sent leftover money to EPIC and closed the administration on March 24, 2025. If you filed a valid claim and believe a payment went astray, the court docket for No. 1:22-cv-00697 is the remaining official record.
What is Novant’s patient portal called?
Novant Health MyChart. The pixel at issue was a Meta tracking code that Novant placed on its website, and according to Novant it was configured incorrectly and may have sent information from the website and MyChart portal to Meta.
What information was sent to Meta?
Per Novant’s notice, it varied by patient. It could include email address, phone number, IP address, emergency-contact and advance-care-planning entries, appointment type and date, the doctor selected, button clicks and text typed into free-text boxes. If a patient typed a Social Security number or financial details into a free-text box, Novant said that patient’s letter would say so.
Did Novant admit wrongdoing?
No. Novant denied all claims and settled to end the litigation. The court did not decide whether Novant broke the law. Before the settlement it had only narrowed the case to two state-law claims.
Is there any other Novant data breach settlement?
As of October 8, 2026 we found none. We found no ransomware, insider or vendor breach case against Novant Health with a settlement, fund or deadline. Other North Carolina systems faced similar pixel suits, including WakeMed and Duke; for UNC, see our UNC Health page.
What can I do now if I used Novant’s website or MyChart?
You cannot claim in the closed Novant case. If you also used another hospital’s website or portal, check open MyChart claim forms and estimate a share with the MyChart settlement calculator. For a breach involving Social Security numbers, the data breach settlement calculator fits better.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
