What the Two Lawsuits Claim
1. The squeak case. Filed October 9, 2025, it alleges that On's CloudTec outsoles — the signature pods on the bottom of the shoe — emit “a loud, embarrassing and difficult-to-stop squeaking sound” with each step. The original complaint named 11 models, including the Cloud 5, Cloud 6, Cloudmonster, Cloudsurfer and Cloudrunner, and said the shoes retail for $140 to $180. It also claimed On treated the noise as “normal wear and tear” under its warranty. The later amended complaint was brought by Cloudsurfer buyers from New York, Pennsylvania and Massachusetts under those states' consumer-protection laws.
2. The tariff case. Filed May 24, 2026, it alleges On raised prices to pass along tariffs imposed under the International Emergency Economic Powers Act (IEEPA). The Supreme Court held on February 20, 2026 that IEEPA did not authorize those tariffs. According to the complaint, On filed its own refund action in the Court of International Trade four days later (Court No. 26-01178) but has not passed any refund on to customers. The original complaint pleaded the Oregon Unlawful Trade Practices Act, unjust enrichment and money had and received. Who Would Be in the Proposed Classes
