What the Levoit Lawsuit Claims
The lawsuit alleges that Vesync made false or misleading “True HEPA,” “HEPA” and “H13” claims about Levoit-branded Core and EverestAir air purifiers and their replacement filters. According to the amended complaint, independent testing by the plaintiffs’ lawyers showed the filters “do not meet HEPA standards, nor do they capture 99.97% of particles at 0.3 microns as promised.”
Those are allegations. No court has tested them. Vesync “unequivocally denies all allegations,” and in the settlement agreement it says the HEPA statements “are, in fact, true.” The case is about what the box promised, not about the purifiers being dangerous. Nobody is being asked to stop using one.

The settlement runs through Sen et al. v. Vesync (US) Corp., Index No. 510627/2026, in the Supreme Court of the State of New York, Kings County (Brooklyn), before Judge Katherine Levine. That case was filed to carry the settlement. It folds in three earlier federal suits: Chen v. Vesync Corp., No. 3:23-cv-04458 (N.D. Cal.); Tepper v. Vesync Corp., No. 7:24-cv-08430-NSR (S.D.N.Y.); and Menter v. Vesync Corp., No. 3:24-cv-12786-MGM (D. Mass.).

Who Can Claim
You are in the class if you bought a Levoit Core or EverestAir air purifier, or a replacement filter, labelled “True HEPA,” “HEPA” or “H13” in the United States between August 29, 2019 and August 4, 2023. Filters count on their own, even if the purifier was bought earlier.
Three common reasons you are not in:
— You bought after August 4, 2023. Most recent buyers are outside the window.
— You bought a different Levoit line, not Core or EverestAir.
— You bought directly from Vesync’s or Levoit’s own website or app. The court’s order excludes those buyers because they agreed to arbitration and a class-action waiver.

How Much the Levoit Settlement Pays
Total payments are capped at $15,000,000. That covers 1.5 million claims at $10. If more people claim, everyone’s payment is cut proportionally. Attorneys’ fees of up to $5,244,500 and service awards of $11,500 are paid separately by Vesync and do not come out of the $15 million.
Proof is required. The claim form asks for evidence showing the original purchase date, such as an Amazon order record. There is no no-receipt option.
Timing: under the agreement, payments go out within 60 days of the settlement becoming final, or 30 days after all claims are processed, whichever is later. The notice warns appeals can take more than a year. Realistically, that is no earlier than 2027.
