What the Norton Healthcare Class Action Was About
According to Norton, an unauthorized third party was inside its network between May 7 and May 9, 2023, including network storage devices holding patient and employee files. Norton spotted the activity on May 9, 2023. The attackers claimed they leaked about 4.7 terabytes of data; Norton said the ransom was not paid.
Notification letters began going out on December 8, 2023. Norton told the Department of Health and Human Services that 2.5 million people were affected. The exposed fields included names, contact details, dates of birth, Social Security numbers, health and health-insurance information, driver's license numbers and financial information.
The Norton Healthcare class action lawsuit alleged negligence, breach of implied contract, unjust enrichment and intrusion upon seclusion. Norton denies all of the claims and admitted no wrongdoing in the settlement.
Was MyChart part of it? No. Norton said its medical record system and Norton MyChart, its patient portal, were not accessed. This was a network breach, not a tracking case.
Case Details
The case that settled is Abby Berthold, et al. v. Norton Healthcare, Inc., et al., Case No. 23-CI-003349, in Jefferson Circuit Court, Division Two, in Louisville, before Judge Annie O'Connell. The defendants are Norton Healthcare, Inc. and Norton Hospitals, Inc. This is a Kentucky state court, not a federal court.
Federal suits were filed too. A suit for one of the later class representatives was filed in federal court in summer 2023. Gerrett v. Norton Healthcare Inc. was filed on December 14, 2023 in the U.S. District Court for the Western District of Kentucky. The settlement went through the state case. Norton had moved to dismiss, but the court never ruled on that motion before the parties settled after mediation.
The court-appointed class counsel are J. Gerard Stranch, IV of Stranch, Jennings & Garvey and Lynn A. Toops of CohenMalad. The settlement administrator is Kroll Settlement Administration.
Status: Settled, Claim Deadline Passed
Final approval was granted on July 31, 2026, according to the claims site ClaimDepot. We could not open the official settlement website to confirm that date, so treat it as reported, not verified.
When the money arrives. Under the settlement agreement, the Effective Date is the 31st day after final approval, provided no objection is made and no appeal is filed. Valid claims are due to be paid 45 days after that, about 76 days after final approval. If final approval came on July 31, 2026 and nobody appealed, that puts payments around mid-October 2026. An appeal would push this back. We have not seen a report of an appeal either way.
If you missed the May 18, 2026 deadline, you cannot file now. If you did nothing, you are still bound by the settlement's release of claims.
Who Was in the Norton Healthcare Settlement
The class is everyone whose personal information may have been compromised in the May 2023 incident and who appears on the class list Norton provided. In practice, that means people who received a notice letter from Norton Healthcare or Norton Hospitals. Court documents estimate about 2,487,683 current and former patients and employees. Officers and directors of Norton and the judge's staff are excluded.
The practical test is your mail. If you got a Norton breach letter in or after December 2023, you were in the class. If you filed a claim before May 18, 2026, keep your Class Member ID and confirmation. If you never got a letter, you were probably not on the list.
Worried about the website or Norton MyChart instead? No tracking lawsuit exists against Norton that we could find. Our form on this page asks whether you used the Norton website or Norton MyChart, what you did there and when you last used it. That helps if a tracking case is ever filed. You can also use the MyChart class action claim form page.
What the $11 Million Norton Healthcare Settlement Pays
Medical monitoring: three years of CyEx Medical Shield Pro.
Out-of-pocket losses: up to $2,500 per person with documents, for losses fairly traceable to the breach between May 9, 2023 and May 18, 2026.
Lost time: $20 an hour for up to four hours, a maximum of $80.
Cash payment: a pro rata share of what is left, no less than $5. Filing any other claim also counted as a claim for the cash payment.

Three Things to Watch For
A closed claim period, a pending payout and 2.5 million leaked records are what scammers work with:
“Late Norton claim” or “reopen your claim” offers
The claim deadline was May 18, 2026. No site can file a Norton Healthcare settlement claim for you now. A page asking for your Social Security number to “add you” is collecting data.
Messages asking you to “release” your payment
Payments go electronically only to people who chose that in an online claim, or by paper check. The administrator does not charge a fee. It also does not need your bank login or full Social Security number to send money you already claimed.
Contacts that quote your leaked data
The data was posted online in 2023, and one lawsuit warned that patients could be contacted directly and threatened. A message quoting your diagnosis or your SSN is not proof that it is official. Do not pay, and report it.
Norton Healthcare Lawsuit — Questions People Actually Ask
Is there a Norton Healthcare settlement?
Yes. The Norton Healthcare settlement is $11 million, for the May 2023 ransomware attack, in Berthold v. Norton Healthcare, Case No. 23-CI-003349, Jefferson Circuit Court. Claims closed May 18, 2026.
Is there a Norton Healthcare MyChart lawsuit?
Not that we could find, as of October 8, 2026. We found no Norton Healthcare MyChart lawsuit or website tracking case over Meta Pixel, Google Analytics or similar tools. Norton said Norton MyChart was not accessed in the 2023 breach. Do not trust anyone selling a “Norton MyChart settlement” claim.
Can I still file a claim?
No. The deadline was May 18, 2026. The opt-out and objection deadline was April 20, 2026. Late claims are not accepted, and you are still bound by the release.
When will Norton settlement payments arrive?
Final approval was reported for July 31, 2026. The agreement pays valid claims 45 days after the Effective Date, which is the 31st day after final approval if no appeal is filed. If no appeal was filed, that points to around mid-October 2026. An appeal would delay it.
How much will I get?
It depends on what you claimed. You could get documented losses up to $2,500, lost time up to $80 and a cash share of no less than $5, plus three years of medical monitoring. The cash share depends on how many people filed. You can also try the payout calculator.
Was the Norton Healthcare data breach letter I got real?
Norton began mailing breach notices on December 8, 2023. The settlement notice came from Kroll Settlement Administration and named NortonDataIncidentSettlement.com. If a letter points you to a different site or asks for payment, treat it as suspect.
Who is suing Norton Healthcare, and in which court?
Class representatives Abby Berthold, Charlotte D'Spain, Lanisha Malone, Deloise Simmson and Alexandra Schachtner sued Norton Healthcare, Inc. and Norton Hospitals, Inc. in Jefferson Circuit Court, Division Two, before Judge Annie O'Connell. Separate federal suits were filed in 2023, including Gerrett in the Western District of Kentucky.
What is worth doing now?
If you filed a claim, watch for a payment or check and your monitoring enrollment code. Either way, freeze your credit at all three bureaus. Also read your insurer's explanation-of-benefits statements, because Social Security numbers and health data were in the files.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
