How Much of a $20k Settlement Will I Get? The Math, Line by Line

Reference Guide

Get a free case reviewCase status

Short answer: with a lawyer on a standard one-third contingency fee, $20,000 becomes $13,333.33 before case costs and medical liens; at 40% it becomes $12,000. Costs and liens come out of what is left, so many people take home well under that. Below is every deduction in order, with the rule that controls it. In Iowa, $20,000 is the minimum liability coverage per injured person — an offer of exactly $20,000 there is often the at-fault driver's whole policy.

The $20,000 Settlement, Deduction by Deduction

Take a $20,000 car-accident settlement, a lawyer, $1,000 in case costs (records, filing fees) and a $4,000 medical lien. These are example figures, not averages — swap in your own.

1. Attorney fee. One-third of $20,000 is $6,666.67, leaving $13,333.33. At 40% the fee is $8,000, leaving $12,000. Florida's bar rule is a useful benchmark: up to 33 1/3% is presumed reasonable before the defendant files an answer, and up to 40% after.

2. Case costs — before or after the fee? This changes your check. Fee first, then costs: $13,333.33 minus $1,000 = $12,333.33. Costs first: the fee is one-third of $19,000, or $6,333.33, and you keep $12,666.67 — $333.33 more. At 40% the gap is $400 ($11,000 versus $11,400). Your written fee agreement must say which method applies.

3. Liens. A health insurer, hospital or Medicaid that paid your accident bills is repaid from the settlement. With a $4,000 lien paid in full, the one-third, fee-first example leaves $8,333.33. Liens are often negotiable; Iowa, for example, makes a hospital that collects from a settlement bear its pro rata share of the legal expenses.

4. Tax. Usually nothing — see below.

Case details

Fee agreements. Most states follow ABA Model Rule 1.5(c). Iowa's version, Rule 32:1.5(c), requires a contingent-fee agreement signed by you that states the percentage and “whether such expenses are to be deducted before or after the contingent fee is calculated.” At the end, the lawyer must give you a written statement showing what you received and how it was calculated.

Medicare. If Medicare paid any accident bills, 42 CFR 411.37 cuts its claim by its share of your procurement costs. Example: a $4,000 Medicare claim; fee plus costs of $7,666.67 is 38.33% of $20,000; 38.33% of $4,000 is $1,533.33; Medicare recovers $2,466.67 and you net $9,866.67. Because $20,000 is under $25,000, you may qualify for the CMS Self-Calculated Conditional Payment Amount: physical-trauma injury, treatment finished at least 90 days earlier, accident at least six months earlier — in exchange you give up the right to appeal the amount. The Fixed Percentage Option tops out at $10,000, so it does not apply.

Taxes. Under 26 U.S.C. 104(a)(2), damages for personal physical injuries are not income. IRS Publication 4345 adds the exception: the part that repays medical expenses you deducted in an earlier year is taxable, and punitive damages always are. More on this at are personal injury settlements taxable.

Is 20k a Good Settlement for a Car Accident?

It depends on four things: the injury, your medical bills, your lost wages and the at-fault driver's policy limit. If your bills alone approach $20,000, it is thin; for soft-tissue injuries that resolved in weeks, it can be fair.

For context, Settlement Insight's own data covers 60,783 paid car-accident claims from 2009–2026, paid by public payers (the U.S. Judgment Fund for federal-vehicle crashes, New York City and Chicago), including property-damage-only claims. The median payment was $5,000 and the mean $38,616. Only 16.2% of those payments (9,837) reached $20,000 or more; 13.6% reached $25,000. These are public payers, not all U.S. car accidents.

The policy limit matters most. Iowa requires $20,000 per injured person ($40,000 per accident). Louisiana and Pennsylvania require only $15,000; most states $25,000. If $20,000 is the driver's whole policy, more money usually has to come from your own underinsured-motorist coverage or the driver's personal assets. Test the number with the car accident settlement calculator or the Iowa calculator.

Who This Math Applies To

Anyone settling a personal-injury claim — car, truck, slip-and-fall — for $20,000 with a lawyer on contingency. Without a lawyer there is no fee: $20,000 minus a $4,000 lien leaves $16,000, though unrepresented claimants negotiate their own liens and their own number.

Medicare beneficiaries: the 411.37 reduction and the self-calculation option apply only to you. Employment cases are different: lost-wage money there is taxable wages under Publication 4345, as our page on retaliation settlements explains.

How Much Will I Get From a 20k Settlement? The Summary

Same example: $20,000, one-third fee, $1,000 costs, $4,000 lien.

No liens: $12,333.33 (fee first) or $12,666.67 (costs first).
$4,000 private lien, unreduced: $8,333.33.
$4,000 Medicare claim under 411.37: $9,866.67.
At 40%, fee first, no liens: $11,000.

So in this example the range runs from $8,333.33 to $12,666.67, and your lien is the biggest unknown. Ask for the lien amounts in writing before you sign. To split a figure into a payment schedule, use the settlement payment calculator; for a bigger case see how much of a $300k settlement.

From Accident to Check: The Steps

  1. The Accident — The Clock Starts

Iowa gives injury claims two years under Code 614.1; other states differ. If you are hospitalized in Iowa and give the hospital proof of your health-plan coverage within thirty days of discharge, it must bill the plan before filing a lien.

  2. Treatment and Medicare Notice

If Medicare pays bills, the case is reported to the BCRC. It sends a Rights and Responsibilities letter, then a Conditional Payment Letter within 65 days.

  3. Demand and Offer

Your lawyer sends a demand; the insurer answers. In Iowa, a $20,000 offer may be the full policy limit.

  4. Settlement and Release

You sign a release. Settlement date, amount and fees go to Medicare, which then issues a final demand; interest runs from the demand date.

  5. Check Into the Trust Account

The insurer's check goes into the lawyer's separate client trust account. See what a settlement check looks like.

  6. Liens Paid, Balance Released

Undisputed money must be paid out promptly; disputed lien money stays in trust until resolved. You get a written closing statement. Typical timing: how long a payout takes.

Three Things to Watch For

A $20,000 check attracts people who profit from the gap between settlement and payout:

“Pay Medicare now” callers

Medicare's real demand is a letter from the BCRC showing your name, Medicare Number, accident date and the payments it claims. A phone call demanding immediate payment is not how it starts: the BCRC first issues a formal demand letter.

Closing statements that skip the math

If your statement shows a fee but not whether costs came out before or after it, ask. The difference on $20,000 is $333.33 at one-third and $400 at 40%, and Rule 1.5(c) requires the method in writing.

“Sign today, it's the max” pressure

An offer may be the policy limit, but sign only after you know your lien totals. Once released, the claim is closed, even if a $4,000 lien turns into $8,000. See am I being lowballed.

$20k Settlement — Questions People Actually Ask

Short answers to the questions people ask most about this case.

How much of a 20k settlement will I get?

With a one-third contingency fee, $13,333.33 before case costs and liens; at 40%, $12,000. With $1,000 in costs and a $4,000 lien paid in full, a one-third deal leaves $8,333.33. Your closing statement must show the exact figures.

How much will I get from a 20k settlement if Medicare paid my bills?

Medicare's claim is reduced by its share of your fee and costs under 42 CFR 411.37. In our example, a $4,000 Medicare claim drops to $2,466.67 and you net $9,866.67. Because $20,000 is under the $25,000 limit, you may self-calculate the amount before settling.

What does a 20k settlement after lawyer fees look like?

$20,000 minus a $6,666.67 one-third fee is $13,333.33; minus an $8,000 fee at 40% is $12,000. Costs and liens come off after that — or costs come off first, which saves you $333.33 at one-third.

Is 20k a good settlement for a car accident?

Only you can judge against your bills, lost wages and recovery. In our data on 60,783 paid claims from public payers (including property damage), 16.2% reached $20,000 or more and the median was $5,000. If $20,000 is the at-fault driver's policy limit, as Iowa's minimum, ask about your own underinsured-motorist coverage.

Is a $20,000 car accident settlement taxable?

Usually not. 26 U.S.C. 104(a)(2) excludes damages for physical injuries. Taxable exceptions: the part covering medical expenses you deducted in a prior year (IRS Publication 4345) and punitive damages. Check with the settlement tax calculator.

What is a normal settlement offer?

There is no national norm. In our public-payer data the median paid car-accident claim was $5,000 and the mean $38,616 — a few large cases pull the average up. Your bills, wages lost and the policy limit decide what is normal for you.

How much will I get out of a 10k settlement?

One-third of $10,000 is $3,333.33, leaving $6,666.67 before costs and liens. At $10,000 or less, Medicare beneficiaries can also use the CMS Fixed Percentage Option.

How much will I get out of a 25k settlement?

The same steps on a larger base — see how much of a 25k settlement will I get. $25,000 is also the upper limit for Medicare's self-calculation option.
