Car Accident Lawyer Fees: What the Lawyer Takes and What You Keep

Reference Guide

Get a free case reviewCase status

Most car accident lawyers work on a contingency fee: no fee unless money comes in, then a percentage of it. One-third is the common starting rate, and it often rises to 40% once a lawsuit is under way. A few states cap the percentage by rule or statute, and federal law caps it at 20% or 25% when the at-fault driver worked for the U.S. government. The second number that matters is whether costs come out before or after the fee.

How a Car Accident Attorney Fee Works

A car accident attorney fee is almost always a contingency fee: the lawyer is paid only if there is a settlement or verdict, and the pay is a percentage of it. Michigan’s court rule describes it as compensation that is “dependent or contingent in whole or in part upon successful prosecution or settlement or upon the amount of recovery.”

Where the percentage starts and how it climbs is set by your contract, not by a national rule. Florida’s bar rule shows the typical shape: up to 33 1/3% before the defendant files an answer to a lawsuit, and up to 40% after that through judgment. Most car accident lawyer fees follow a similar step from one-third to 40% when a case moves from negotiation into litigation.

For the general picture across all injury cases, see what a personal injury lawyer costs. This page stays with car crashes: the caps that apply, the costs question, and what is left of a typical car accident settlement after lawyer fees.

Case details

Most states have no fixed percentage for car accident cases; the fee only has to be reasonable. These are the rules that set hard numbers, checked against their text:

Federal vehicles (USPS, military, VA): under the Federal Tort Claims Act, 28 U.S.C. 2678 caps the fee at 20% of an administrative settlement with the agency and 25% of a judgment or settlement after suit is filed. Charging more is a crime, punishable by a fine of up to $2,000 or up to one year in prison.

Michigan: MCR 8.121 sets the maximum at one-third of the amount recovered, computed after case disbursements are deducted. It covers personal injury and no-fault benefits claims, and the one-third covers all lawyers on the case together.

Florida: Rule 4-1.5(f)(4)(B) presumes a fee excessive above 33 1/3% of the first $1 million before an answer, or 40% after it, unless a court approves.

New Jersey: Rule 1:21-7 allows 33⅓% of the first $750,000, then 30%, 25% and 20% on each next $750,000, computed on the net after case expenses.

Connecticut: C.G.S. 52-251c allows 33 1/3% of the first $300,000, then 25%, 20% and 15% on each next $300,000, and 10% above $1.2 million. It also covers property damage claims, and a client may waive the cap in an unusually complex case.

Costs Before or After the Fee: The Line That Moves Your Check

Case costs — police reports, medical records, filing fees, expert witnesses — are separate from the fee. Your contract decides whether the percentage is taken from the gross settlement or from what is left after costs.

Example on $25,000 with $1,000 in costs at one-third: fee on the gross is $8,333, and after costs you keep $15,667. Fee on the net ($24,000) is $8,000, and you keep $16,000. The difference is $333 — bigger as costs grow.

Michigan and New Jersey require the net method for capped fees. California’s Business and Professions Code 6147 requires the contract to state how costs “will affect the contingency fee and the client’s recovery.” Medical liens are a different item: New Jersey’s rule says no deduction need be made for hospital or doctor liens before the fee is calculated, so they come out of your share.

Which Rule Applies to Your Crash

The state where the case is handled and who hit you decide which cap, if any, applies.

Hit by a federal driver — a mail truck, a military vehicle, a VA car: the federal 20% / 25% caps apply, and you must first file a written claim with the agency within two years (28 U.S.C. 2401(b)). If the agency does not decide within six months, you may treat that as a denial and sue. See suing the federal government.

In Michigan, Florida, New Jersey or Connecticut: the state limits above apply. State estimates: Michigan, Florida, New Jersey, Connecticut.

Everywhere else, including California: the percentage is negotiated. California makes the contract say so in writing — the fee “is not set by law but is negotiable.” If you have just been in a crash, start with what to do after a car accident.

Car Accident Settlement After Lawyer Fees: Real Numbers

Percentages hide how small most car crash settlements are. In our records of 60,783 real car accident payouts the median was $5,000, and only about 14% (9% + 5%) reached $25,000 or more (calculator and data; why the average misleads).

$5,000 settlement: one-third is $1,667, leaving $3,333 before costs and liens. At 40% the fee is $2,000, leaving $3,000.

$25,000 settlement: one-third is $8,333, leaving $16,667. At 40% the fee is $10,000, leaving $15,000. More detail: how much of a $25K settlement you keep.

$25,000 from a federal agency: the most a lawyer may take is $5,000 (20%) in an administrative settlement, or $6,250 (25%) after suit. Federal-driver claims in our data had a median of $6,090.

These are ceilings and examples, not predictions. Medical liens and unpaid bills can take a further share of what is left.

How the Fee Changes as a Car Accident Case Moves

  1. Signing — The Contract Sets Everything

Contingency agreements must be in writing in Michigan and Florida. In Florida you can cancel in writing within 3 business days and owe no fee for that period.

  2. Claim With the Insurer — Usually One-Third

Most car crash claims settle here, before any lawsuit. Florida's rule caps this stage at 33 1/3% of the first $1 million.

  3. Federal Driver — Agency Claim First

Against the U.S. government, a written claim goes to the agency within two years. A settlement at this stage caps the fee at 20%.

  4. Lawsuit Answered — Often 40%

Once the defense files an answer, Florida allows up to 40% of the first $1 million. Federal cases rise to a 25% cap after suit.

  5. Settlement — The Closing Statement

You should get a written statement showing the recovery, each cost and the fee. Florida clients may approve it before paying any money.

  6. Payout — Liens Come Out of Your Share

Hospital and doctor liens are paid from the client's share, not before the fee is computed under New Jersey's rule.

Three Things to Watch For

Fee problems in car accident cases rarely show up on the first page of the contract:

The silent jump to 40%

Many contracts step up from one-third once a lawsuit is filed or answered. Ask exactly what event triggers the higher rate and whether the lawyer must ask you before filing suit.

“No fee unless we win” — but costs?

No fee is not the same as no cost. Read whether costs are taken before or after the percentage and whether you owe them if the case is lost. California requires the contract to spell this out.

Signing at the hospital or the tow yard

A contract signed in the first days after a crash is still binding. You may compare lawyers and bargain on the percentage; in Florida you can also cancel within 3 business days in writing.

Car Accident Lawyer Fees — Questions People Actually Ask

Short answers to the questions people ask most about this case.

How much do lawyers take from car accident settlement money?

How much do lawyers take from car accident settlement checks? Usually one-third if the case settles before a lawsuit, and often 40% after. Hard caps exist in some places: one-third in Michigan, sliding scales in New Jersey and Connecticut, and 20% or 25% on claims against the federal government.

How much will I get from a $25,000 settlement?

At a one-third fee you keep $16,667 before costs and liens; at 40% you keep $15,000. If $1,000 in costs is taken after a one-third fee on the gross, you keep $15,667. Medical liens reduce it further.

Is $5000 a lot for a lawyer?

As a fee, $5,000 is what a one-third contingency costs on a $15,000 settlement, or 20% on a $25,000 federal agency settlement. As a settlement, $5,000 was the median car accident payout in our 60,783 records — and a one-third fee on it is $1,667.

Can I hire a lawyer and pay later?

Yes — that is what a contingency fee is. The fee is paid from the settlement or verdict. Michigan requires lawyers to tell you hourly fees are an alternative. Ask in writing whether you owe case costs if nothing is recovered.

How much do lawyers take from settlement in California?

California sets no percentage for a car accident case. Business and Professions Code 6147 requires the written contract to state that the fee “is not set by law but is negotiable” and how costs affect it. A contract missing those terms is voidable at the client’s option.

Are costs taken out before or after the lawyer's fee?

It depends on your contract, except where a rule decides it: Michigan and New Jersey compute capped fees on the net after case costs. On a $25,000 settlement with $1,000 in costs, the net method saves you $333 at one-third.

What if a mail truck or military vehicle hit me?

Claims against the U.S. government fall under the Federal Tort Claims Act. Fees are capped at 20% for an agency settlement and 25% after a lawsuit, and the written claim must reach the agency within two years of the crash.

Can I negotiate car accident lawyer fees?

Yes. Car accident lawyer fees are a contract term. Florida’s statement of client’s rights says you may bargain about the percentage, and Michigan allows fees below the cap. Get the final rate, the 40% trigger and the cost method in writing.
