How Long Does It Take for a Settlement to Pay Out?
Reference Guide
There is no single number, because the clock depends on what kind of settlement it is. A class action pays only after a judge approves it, the appeal window closes and the administrator processes claims — the $152.2 million tuna settlement paid on September 8, 2026, nearly two years after final approval. A one-on-one injury settlement is faster: Pennsylvania and New York give the defendant 20 and 21 days after the signed release. Here is how each clock works, with real dates.

How Are Settlements Paid Out? Two Very Different Clocks
How are lawsuit settlements paid out? Either through a court-supervised fund (class actions) or as a lump sum from the defendant or its insurer to your lawyer (individual cases). The two run on different rules.
Class actions. Money goes into a fund run by a court-appointed administrator such as JND, Kroll or Angeion. Under Federal Rule of Civil Procedure 23(e)(2), a judge may approve the deal “only after a hearing” and only on finding it “fair, reasonable, and adequate.” Payments are tied to the date that approval becomes final, not to the hearing itself.
Individual cases. You sign a release, the defendant or insurer pays, and the money usually goes to your attorney first. Fees, costs and liens come out before you receive the rest. If Medicare paid any of your medical bills, those payments “must be repaid to Medicare when a settlement, judgment, award, or other payment is made,” according to CMS. That repayment often decides when your share can be released.
Case details
Class action: the steps that set the date. Under the Class Action Fairness Act, 28 U.S.C. Section 1715(d), final approval cannot come earlier than 90 days after federal and state officials are served with notice of the deal. Any class member may object (Rule 23(e)(5)). Once the judgment is entered, anyone with standing has 30 days to appeal under Federal Rule of Appellate Procedure 4(a)(1)(A), or 60 days if the United States is a party.
Settlement agreements then set an “Effective Date.” In the $177 million AT&T data breach settlement (MDL No. 3114, N.D. Tex.), it is 10 days after the appeal time runs out. If anyone appeals, it is 30 days after the last appellate ruling. AT&T then has 15 days to fund the rest of the settlement, and Kroll must pay no later than 60 days after the Effective Date.
Individual cases: state prompt-payment rules. Pennsylvania Rule of Civil Procedure 229.1 requires the defendant to deliver the money “within twenty calendar days from receipt of an executed release.” If it pays late, it owes interest at prime plus one percent from the twenty-first day. New York CPLR 5003-a gives a settling defendant 21 days after the signed release is tendered, and 90 days for municipalities. If it pays late, the plaintiff can enter judgment with interest. Other states have their own rules or none.
How Long Does It Take for a Settlement to Pay Out? The Short Answer
Class action: payments start only after final approval, the appeal window and the Effective Date. Three real examples from 2026:
— 23andMe: claims closed February 17, 2026. The court approved a final amount of $46.75 million on July 7, 2026, and payments went out September 29 and 30, 2026. See our 23andMe payout page.
— Tuna: final approval came November 22, 2024, but payments began September 8, 2026, because the court held the money until the companies paid their last installments. See our tuna payout report.
— AT&T: final approval came October 2, 2026. As of October 12, 2026, no payment date had been announced. A status conference is set for October 30, 2026. See our AT&T payout page.

How Do Settlements Get Paid Out to You?
How do settlements get paid out in practice? In a class action, you get money only if you filed a valid claim by the deadline, unless the notice says payments are automatic. The administrator pays by check or by the electronic method you chose on the claim form. Filing late does not get you into a payment round. In the AT&T case, final approval did not reopen filing after the December 18, 2025 claims deadline.
In an individual case, the check or wire usually goes to your attorney’s trust account first. You then get a closing statement showing the gross amount, the fee, costs and any liens, and the net that is paid to you.
What to do next: find the official settlement website named in your notice. Its “Important Dates” or FAQ page is where a payment date first appears. Keep your claim ID and update your address with the administrator if you move. For open claims, see our list of open class action settlements.
Why Payments Get Delayed
Appeals. One objector’s appeal pushes the Effective Date back until the appeals court rules. In the tuna case, a side appeal was not dismissed by the Ninth Circuit until May 1, 2026.
Installment payments. In the tuna case, StarKist’s last installment arrived in December 2025 and Chicken of the Sea’s parent paid its last one in March 2026. The judge’s July 27, 2026 order says payments were “held until all settlement amounts have been paid.”
Bankruptcy. 23andMe’s final amount was set by the bankruptcy court rather than by the original agreement.
Claim review and liens. Administrators check for fraud and cure defective claims. In individual cases, Medicare sends a demand letter automatically if no response comes within 30 calendar days of its notice.

One Real Settlement, Start to Payment: Tuna
November 22, 2024 — Final Approval
Judge Dana M. Sabraw (S.D. Cal., No. 3:15-md-02670-DMS-MSB) approves the StarKist and Lion Companies settlements. Together with Chicken of the Sea, consumers are covered by $152.2 million.
December 31, 2024 — Claims Close
The claim deadline passes. From this point on nobody new can join the payment.
December 2025 to March 2026 — Last Installments
StarKist makes its final installment in December 2025 and Chicken of the Sea’s parent in March 2026. Until then the court holds payments to avoid paying for multiple distributions.
May 1, 2026 — Last Appeal Dismissed
The Ninth Circuit dismisses a side appeal over the administrator’s deficiency letters, clearing the last obstacle.
July 27, 2026 — Disbursement Order
The court orders the money sent to JND Legal Administration within ten days, with payments to start within thirty days after that.
September 8, 2026 — Payments Issued
Checks and electronic payments go out. Uncashed money goes to a court-approved charity, not back to the companies. Counsel reports to the court at 120 days and files a final accounting at 180 days.
Three Payout Scams to Watch For
The waiting period is exactly when fake payout messages work best:
“Pay a fee to release your check”
Court-appointed administrators pay you out of the fund. They do not charge you a fee to release a payment. A message asking for a processing fee, gift cards or crypto before you are paid is not part of any court process.
“Your payment is ready” before any date exists
In the AT&T case, no payment date had been announced as of October 12, 2026, even after final approval. A call or text saying your payment is waiting before the official site announces a date is not describing the court’s process. Check the settlement website yourself.
Fake “replacement check” emails
When real checks bounce, as some tuna checks did because of a bank processing issue, the administrator reissues them. It does not need your online banking password to do that. Type in the official site’s address yourself instead of clicking a link, and do not re-deposit a returned original.
Settlement Payouts — Questions People Actually Ask
Short answers to the questions people ask most about this case.
How long does it take for a settlement to pay out?
It depends on the type. In an individual case, Pennsylvania gives the defendant 20 days and New York 21 days after receiving your signed release, and your lawyer then deducts fees and liens. In a class action, payment comes after final approval, a 30-day appeal window and the Effective Date. In 2026, that meant almost three months after the court set the final amount for 23andMe, and almost two years after final approval for tuna.
How are lawsuit settlements paid out?
Class settlements are paid by a court-appointed administrator, by check or the electronic method you chose on your claim form. Individual settlements are usually paid as a lump sum to your attorney’s trust account. Fees, costs and liens are deducted, and the rest goes to you.
How long does it take to get paid after suing someone?
Winning or settling does not mean being paid that day. If you settle, state rules like Pennsylvania’s 20 days or New York’s 21 days count from the signed release. Without such a rule, the timing is whatever your settlement agreement says. Getting to a settlement takes longer; our demand-letter timeline covers that stage.
Why has my class action payment not arrived after final approval?
Final approval starts the countdown. Payments usually wait for the 30-day appeal period, any appeal and the Effective Date in the agreement. In AT&T’s case, Kroll has no more than 60 days after that Effective Date to pay. Funding in installments or bankruptcy can add more time.
How long can a lawyer hold your settlement check?
Your lawyer has to account to you for the money and cannot keep it indefinitely. A common legitimate reason for a delay is a lien that must be resolved first. Medicare conditional payments, for example, must be repaid out of the settlement. Ask for a written closing statement showing every deduction. If money is still being held, ask what it is waiting for. Your state bar handles complaints about client funds.
What happens if a defendant pays late?
In Pennsylvania, interest at prime plus one percent runs from the twenty-first day, plus attorneys’ fees. In New York, the plaintiff can enter judgment for the settlement amount with interest from the date the release was tendered. In a class action, late or missed funding is a matter for the judge supervising the settlement.
What if my settlement check bounces or I lose it?
Contact the administrator named on the official settlement site; it reissues checks. In the tuna settlement, replacement checks included an extra $20 for bank fees, and class members were told not to re-deposit the original. Checks do expire, so act before the void date printed on the check.
Are settlement payouts taxed?
It depends on what the payment is for. Compensation for physical injuries is treated differently from lost wages or punitive damages. See our guide on whether personal injury settlements are taxable.
