Most Sued Cities and Counties: Federal Civil Rights Lawsuits in FY2025

Original analysis of 159,692 records from the Federal Judicial Center, FY2016–FY2025. Published October 23, 2026.

Download the dataKey findings

We counted every new federal lawsuit filed under nature of suit 440, Other Civil Rights, in fiscal year 2025 and grouped those that name a city, county or other local government first by the government named.

What the court records show

New York City was the first-named defendant in 275 new federal Other Civil Rights lawsuits filed in fiscal year 2025, more than any other local government; second-ranked Los Angeles County was named first in 118. The City of Los Angeles followed with 74 and the City of Chicago with 71. Across the country, 4,788 of 21,110 new Other Civil Rights suits (22.7%) named a city, county or other local government, or its police or sheriff's department, as the first defendant.

  • 275Other Civil Rights suits naming NYC first, FY2025
  • 4,788New civil rights suits naming a local government, FY2025
  • 23%Local-government share of new civil rights suits, FY2025
  1. New York City leads by a wide margin

New York City was named first in 275 new suits, 5.7% of all suits naming a local government first; in 43 of them the defendant name referred to the NYPD or the city's police department.

  2. California leads among states

Los Angeles County ranks second with 118 suits, and California federal courts saw 840 suits naming a local government first, more than any other state; state counts are not adjusted for population.

  3. Most localities are named only once

2,274 distinct local-government names, grouped by our place-name rule, were named first at least once, and 71% of them in only a single suit. Only 44 were named first in ten or more. Leftover fragments of shortened names can form entries of their own, so the single-suit share is approximate.

  4. Police and sheriff's departments named directly

In 735 suits (15.4% of the local-government total), the first-named defendant was identified by the word police or sheriff, usually a police department or sheriff's office rather than the city or county itself.

  5. Filings rose, the local share fell

Other Civil Rights filings rose 23.8% from FY2024 to 22,522 in FY2025. Suits naming a local government first rose 18.3%, more slowly than new suits overall, so their share of new suits fell to 22.7%, from 24.1% in FY2024 and 31.3% in FY2016.

Which Cities and Counties Are Sued Most in Federal Civil Rights Cases

Local governments named as the first defendant in at least 3 new Other Civil Rights lawsuits filed in federal district courts from Oct. 1, 2024, to Sept. 30, 2025.

New York City (275) leads, followed by Los Angeles County (118), the City of Los Angeles (74), the City of Chicago (71) and the City of Philadelphia (52). The ten largest totals together account for 16.4% of all suits naming a local government first.

Nature-of-suit code 440, Other Civil Rights, covers civil rights claims that fall outside the more specific civil rights categories and are not related to prison. The federal judiciary's own code description gives as its example an "Action alleging excessive force by police incident to an arrest." Section 1983 makes liable "Every person who, under color of any statute, ordinance, regulation, custom, or usage" of a state deprives someone of constitutional rights.

In FY2025, 4,788 new suits in this category named a city, county, town, village, borough, township, parish or the District of Columbia, or one of their police or sheriff's departments or other offices, as the first defendant. A police or sheriff's department is grouped with a city or county when its name carries the same place name. The District of Columbia's Metropolitan Police Department counts with the District, which is included alongside cities and counties. Consolidated city-counties (Denver, Honolulu, San Francisco, Philadelphia, Jacksonville, Nashville and Louisville) count once when a suit names the city, the county or their police under that place name; names using a separate county name, such as Davidson County (Nashville) or Jefferson County (Louisville), are not added to them. The Las Vegas Metropolitan Police Department, which serves both the City of Las Vegas and Clark County, is listed on its own. Each suit counts for the state of the federal court where it was filed.

A few rankings reflect repeat filers rather than many different plaintiffs. The City of New Lisbon, Wisconsin, ranks 15th with 19 suits, all brought by the same first-named plaintiff. The CSV shows the number of distinct first-named plaintiffs for every jurisdiction; New York City's 275 suits came from 222.

Counts are new suits (original filings and removals from state court) with the government as first-named defendant. Suits listing it further down the caption are not counted. Counts are not adjusted for population or police force size.

How Many Civil Rights Lawsuits Are Filed Each Year

Other Civil Rights filings in federal district courts per fiscal year, and how many new suits named a local government first.

Our count of federal court records shows 22,522 Other Civil Rights filings in FY2025 (official Table C-2: 22,509), up from 18,193 in FY2024 and 15,164 in FY2016. Suits naming a local government first rose to 4,788, but their share of new suits fell from 31.3% in FY2016 to 22.7%.

Our count of 22,522 filings for FY2025 is within 0.06% of the 22,509 reported by the Administrative Office of the U.S. Courts in Table C-2; for FY2024 we count 18,193 against the official 18,194. Our totals include reopened and transferred cases, which is how they line up with the official count. The ranking above uses only new suits: 21,110 in FY2025.

The jump in FY2025 came mostly from suits against other defendants. Suits naming a local government first grew 18.3% from FY2024, less than the 23.8% rise in all filings. The first-named defendant does not always identify every party sued, so this trend describes the lead defendant only.

Fiscal years run from Oct. 1 to Sept. 30. Local share is the share of new suits (not of all filings) naming a local government first. FY2026 is incomplete and not shown.

Which States See the Most Civil Rights Suits Against Local Governments

New Other Civil Rights suits in FY2025 by the state of the federal court, and how many named a local government first.

California federal courts received 840 suits naming a local government first (39.7% of the state's new Other Civil Rights suits), followed by New York with 493.

States are assigned by the federal district court where the suit was filed, even when the local government named is in another state. The counts are not adjusted for population, the number of local governments in a state or the size of their police forces, so larger states rank higher.

California accounts for 17.5% of all suits naming a local government first nationwide.

How We Measured

Data come from the Federal Judicial Center's Integrated Database (IDB) of federal civil cases, cumulative file with cases pending as of June 30, 2026, as loaded into our database on Oct. 10, 2026. We selected every case with nature-of-suit code 440 (Other Civil Rights) and a filing date from Oct. 1, 2015, through Sept. 30, 2025, a total of 159,692 records. FY2026 is incomplete in the file and is not counted.

Checked against published figures

  • Civil cases commenced under nature of suit 440 'Other Civil Rights', FY2025 (12 months ending Sept. 30, 2025): published 22,509, our count 22,522 (0.06% apart).Table C-2. U.S. District Courts—Civil Cases Commenced, by Basis of Jurisdiction and Nature of Suit (September 30, 2025)
  • Civil cases commenced under nature of suit 440 'Other Civil Rights', FY2024 (12 months ending Sept. 30, 2024): published 18,194, our count 18,193 (0.01% apart).Table C-2. U.S. District Courts—Civil Cases Commenced, by Basis of Jurisdiction and Nature of Suit (September 30, 2025)
Full method and limits of the data

Calibration: our count of 22,522 Other Civil Rights filings in FY2025 differs by 0.06% from the 22,509 cases commenced in Table C-2 of the Administrative Office of the U.S. Courts; for FY2024 we count 18,193 against 18,194. These totals include reopened cases, transfers and remands; counted this way, they match the official table closely.

For the ranking we kept only new suits, meaning IDB origin codes 1 (original proceeding), 2 (removed from state court) and 13 (multidistrict litigation originating in the district), and counted each docket once, keyed by circuit, district, office and docket number, with fiscal years taken from the filing date (FDATE); where a docket has more than one such record in FY2025, the records carry the same defendant name. That leaves 21,110 suits in FY2025; 1,412 records (6.3%) were reopenings, transfers, remands or repeat records of the same docket and are excluded.

The IDB records only the first-listed defendant (field DEF), shortened to at most 30 characters; names ending in ", ET AL" keep 23 characters plus that suffix. So that anyone can reproduce the count exactly, we classified the name by its words alone, where a word is any unbroken run of the letters A to Z (the field is in capitals). An apostrophe before a final S is dropped, so "Sheriff's" is the word SHERIFFS and "Prince George's" the words PRINCE GEORGES; other apostrophes, periods, hyphens, slashes, ampersands, parentheses and commas split words, so "Miami-Dade" is MIAMI DADE. A suit names a local government first if the defendant name contains at least one of the words CITY, COUNTY, TOWN, VILLAGE, BOROUGH, TOWNSHIP, PARISH, POLICE, SHERIFF, SHERIFFS, SHERRIF, SHERRIFF, SHERRIFFS, NYPD, LAPD or NYC, or one of the phrases DISTRICT OF COLUMBIA, METROPOLITAN GOVERNMENT, LAS VEGAS METROPOLITAN, LAS VEGAS METRO or LVMPD, and none of the words STATE, STATES, SCHOOL, SCHOOLS, EDUCATION, UNIVERSITY, COLLEGE, HOUSING, AUTHORITY, TRANSIT, COURT, COURTS, SUPERIOR, CIRCUIT, PROBATE, FAMILY, CLERK, ATTORNEY, PROSECUTOR, DEFENDER, PROBATION, CHILD, CHILDREN, HOSPITAL, MEDICAL, OFFICER, OFFICERS, INC, LLC, INDEPENDENT, UNIFIED, ISD, USD or DIOCESE, no word beginning with EDUC and not the word ED directly after OF ("Board of Ed"). Only whole words count otherwise: a cut-off word such as "Sher" or "Poli" matches nothing. Other offices of a city or county, such as a truncated "New York City Departmen", count with it.

For the ranking, each of these suits is assigned to one government, keyed by the state of the federal district court where it was filed (without exception, also for New York City), a type and a place name. Names containing the phrase NEW YORK CITY or CITY OF NEW YORK or the word NYC or NYPD are New York City; so are names that reach New York City through the general place rule below, i.e. the city-type place NEW YORK in a New York court, such as "New York Police Dept." or the truncated "New York Police Departm" (the place runs to the stop word POLICE; two FY2025 suits), whereas "New York County" is a county and not counted for the city; names containing DISTRICT OF COLUMBIA, or METROPOLITAN POLICE in a District of Columbia court, are the District of Columbia; names containing LAPD are the City of Los Angeles; names containing LAS VEGAS METROPOLITAN, LAS VEGAS METRO or LVMPD are the Las Vegas Metropolitan Police Department, a unit of its own; METROPOLITAN GOVERNMENT in a Tennessee court is Metro Nashville. Otherwise the type is county if the name contains COUNTY or PARISH; else township, borough, village, town or city, checked in that order, if the name contains that word; else county if it contains a sheriff word; else city. The place name is read from the name without a trailing ", ET AL", before the first comma. Below, stop words are CITY, COUNTY, TOWN, VILLAGE, BOROUGH, TOWNSHIP, PARISH, the police and sheriff words above, DEPARTMENT, DEPT and OFFICE. If the name contains CITY, COUNTY, TOWN, VILLAGE, BOROUGH, TOWNSHIP or PARISH directly followed by OF, the place is the words after the first such pair up to the next stop word, where one CITY after the first place word belongs to the place ("City of Kansas City"); this reading is discarded if the place is a state name or the beginning of one ("Muncie City of Indiana"), or if it reaches the end of a shortened name and has fewer than 4 characters. Otherwise leading THE, AND, OF and stop words are dropped and the place runs to the next stop word; a CITY directly after the place belongs to it unless AND or OF follows ("Sioux City", "Oklahoma City Police Department"). A trailing postal code of the court's state, a full state name, or the first three or more letters of the court state's name are then dropped ("Roswell Geo" is Roswell). A name is shortened if it has 29 or more characters; if the place reaches its end, a last word that is the beginning of a longer stop word is dropped ("Philadelphia Po"). A place beginning with BOARD ("Board of County Commiss") gives no place. A place that reaches the end of a shortened name and does not also occur in full (not at the end of a shortened name) for the same court state and type is completed: if it is the beginning of such full places that are all beginnings of the longest of them, and it has at least 4 characters, it becomes that longest place ("San Bernardin" is San Bernardino); if such places exist otherwise, the suit counts for no single government; if none exist and dropping its last word gives a full place, it becomes that place ("Los Angeles Met"). One place with no full spelling in FY2025, Huntington Beac in California, is completed to Huntington Beach. A place with CITY after its first word becomes the words before CITY if those occur as a full place ("Chicago City Hall" is Chicago). City and county names of the consolidated governments of Denver (Colorado), Honolulu (Hawaii), San Francisco (California), Philadelphia (Pennsylvania), Jacksonville (Florida), Nashville (Tennessee) and Louisville (Kentucky) form one unit each when the place is that name or begins with it as a word, and in names containing CITY AND COUNTY (or CITY & COUNTY) also when the place is the beginning of that name ("City and County of San"). Names that leave no place name, such as "Sheriff's Office", or that cannot be matched (29 suits) count in the local-government total but not for any single government. The local-government share uses all 21,110 new FY2025 suits as the denominator; shares of individual governments use the 4,788 suits naming any local government first.

What this data cannot tell you

  • Only the first-named defendant is recorded. A suit against a police officer that names the city second is not counted for the city, and a suit naming only an official by personal name, such as a mayor, is not counted at all. The totals therefore understate the full number of suits each government faced, although the word rule also counts a few names that are not governments (see below).
  • The word rule is deliberately mechanical. It leaves out most school districts, housing and transit authorities, courts, prosecutors and child-welfare agencies, but also a few places whose names contain an excluded word, such as College Station, Texas, and it counts a few names that only mention a city or county, such as a business with a city in its name. Truncated names whose excluded word is cut off, such as "Kansas City Kansas Public Scho", still count. Because cut-off words are not completed, some truncated names such as "Broward Sheriff's Offi" count while others such as "Los Angeles County Sher" count as the county rather than its sheriff. Place names are grouped by spelling, not checked against a gazetteer, so a few leftover fragments of shortened names form entries of their own.
  • Prisoner suits over conditions of confinement are filed under separate nature-of-suit codes and are not part of code 440, so many suits against county jails do not appear here.
  • The ranking counts lawsuits, not merit or outcomes. A filing says nothing about whether the claim succeeded, and one person can file many suits. Counts are not adjusted for population or police force size.
  • Courts report cases to the IDB with some delay, and later releases can add or correct FY2025 records. Our FY2025 total was within 0.06% of the official table as of this release.

Frequently Asked Questions

Which city gets sued the most for civil rights violations?

In federal court records for fiscal year 2025, New York City was the first-named defendant in 275 new Other Civil Rights lawsuits filed in New York federal courts, the most of any local government. Los Angeles County was second with 118.

How many civil rights lawsuits are filed each year?

Federal district courts recorded 22,509 Other Civil Rights cases commenced in FY2025, according to the federal judiciary's Table C-2, up from 18,194 in FY2024. This category covers civil rights claims outside the more specific categories, including police excessive-force suits, and excludes prisoner, employment, housing and disability claims.

How many lawsuits are filed against the City of New York?

In FY2025, 275 new federal Other Civil Rights suits filed in New York federal courts named New York City, one of its departments or the NYPD as the first defendant; in 43 of those the name referred to the police department. State-court claims and suits in which the city is not the first-named defendant are not included.

What share of civil rights lawsuits are against cities and counties?

In FY2025, 22.7% of new federal Other Civil Rights suits (4,788 of 21,110) named a local government, one of its offices or its police or sheriff as the first defendant. The share was 31.3% in FY2016.

Can you sue a city or county for a civil rights violation?

Yes. Federal law at 42 U.S.C. § 1983 allows suits against anyone who deprives a person of constitutional rights under color of state or local law, and federal courts classify such suits, including police excessive-force claims, under nature-of-suit code 440 when no more specific civil rights category applies. In FY2025, 2,274 distinct local-government names, grouped by our place-name rule, were named first in at least one such suit.

Which county is sued most often in federal civil rights cases?

Los Angeles County was the first-named defendant in 118 new Other Civil Rights suits in FY2025, the most of any county and second only to New York City among all local governments.
