Progressive Class Action Lawsuit Settlement: Which Case Is Open Now

There is no single Progressive settlement. As of October 2026 the one in the news is a Colorado total-loss case: about $15,240,887 for drivers whose totaled car was valued with a “Projected Sold Adjustment.” Claims are due by February 5, 2027; opting out closes November 5, 2026. A separate Texas PIP deal is also open. The New York and Georgia total-loss settlements have already paid out, and the Progressive Leasing data breach claim window closed January 22, 2026.

What the Progressive Lawsuits Are About
Most Progressive class actions are about one thing: how the company valued totaled cars. The Colorado lawsuit alleges that Progressive Direct and Progressive Preferred paid insureds less than actual cash value because their valuation came from a Mitchell “Instant Report” that applied a Projected Sold Adjustment to comparable vehicles — a deduction the plaintiffs allege is improper. The New York case (Volino) made the same challenge, and the Georgia case (Brown) is covered on its own page.
Two other matters use the Progressive name but are different. A Texas case alleges Progressive County Mutual paid personal injury protection (PIP) medical bills late without the interest Texas law requires. And Progressive Leasing — a lease-to-own company owned by PROG Holdings, not the car insurer — settled a lawsuit over a data incident around September 11, 2023. Progressive denies wrongdoing in each settlement.

Are You in One of the Classes?
Colorado: you are in a class if Progressive Direct insured you as a Colorado resident and you made a first-party total-loss claim submitted April 12, 2019 through July 8, 2026 — or Progressive Preferred, December 19, 2021 through July 8, 2026 — and the payment was based on a Mitchell Instant Report with a Projected Sold Adjustment on at least one comparable vehicle. Identified class members received an email and/or postcard with a Claimant ID and PIN. You still have to file a claim to be paid.
Texas PIP: a Texas-based Progressive policy, and a PIP medical bill line item that was paid more than 15 or 30 business days after Progressive received it, with an explanation-of-benefits print date between Aug. 30, 2016 and June 1, 2026.
New York: policyholders from July 28, 2015 to August 20, 2024, and third-party claimants from July 28, 2018 to August 20, 2024. No new filing is possible.
How Much the Progressive Settlements Pay
Texas PIP: per the published summary, payments are interest at 11.452% a year on the late line items, plus a 5% flat rate for the 30-day class. Most people will receive interest on specific bills, not a large sum.
Closed cases for scale: New York paid out of a $48,000,000 fund, at least $31,200,000 of it to class members; Georgia's fund was $43,000,000. Use the car accident settlement calculator for your own injury claim — that is a separate matter from these class actions.
How cases like this one end
Our copy of the federal courts’ own case database covers 140,562 insurance casesclosed in U.S. federal district courts between 2015 and 2026, 1.1% of them filed as class actions:
- 46.3% ended in a settlement recorded by the court. Another 19.7% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 46.3% and 66%.
- 6.7% were decided on a motion before any trial.
- 1 in 151 reached a trial (0.7%), after a median of 22.7 months.
- Median time from filing to the end of the case: 8.9 months.
- Only 1,353 of them (1%) record a money award at all; the median of those is $317,000.

Three Things to Watch For
Several Progressive settlements with similar names make it easy to mail the wrong people or pay the wrong site:
A “Progressive settlement” site asking for your SSN
The Colorado claim form asks for the Claimant ID or total-loss claim number and the PIN printed on your notice. If a site asks for your Social Security number or bank login to “check eligibility,” it is not the administrator. Type www.COTotalLossClaim.com yourself or call 1-888-808-1463.
Pay-to-file or “sign up” services
There is nothing to sign up for and no fee. The Colorado claim is free and takes your notice codes; you are already a class member if you meet the definition. A service that takes a cut of your payment adds nothing.
Old New York or Georgia checks “reissued”
The New York site says checks dated before May 1, 2026 will not be honored and second payments are not reissued. Anyone offering to “recover” an old Progressive check for a fee is selling something that does not exist.
Progressive Settlements — Questions People Actually Ask
Is there a Progressive class action lawsuit settlement I can file for right now?
Yes, two as of October 2026. The Colorado total-loss settlement takes claims until February 5, 2027 at COTotalLossClaim.com. The Texas PIP settlement takes online claims until January 19, 2027, per the published summary. Everything else listed here is paid or closed.
What is the Progressive class action lawsuit payout date?
For Colorado, none has been set: the court still has to approve the settlement, and claims run until February 5, 2027. For New York, payments went out May 12, 2025, November 4, 2025 and May 1, 2026. For Georgia, awards were sent September 4, 2025.
How much will I get from the Colorado settlement?
68% of 2.75% (Progressive Direct) or 2.25% (Progressive Preferred) of the actual cash value Progressive put on your totaled car. On a $20,000 car that is roughly $374 or $306. Nothing is paid until the court approves the settlement.
How much is the average class action settlement?
There is no meaningful average; it depends on the fund size, the number of claimants and the formula. Progressive's total-loss deals pay a percentage of your own car's value rather than an equal share. For a rough estimate on other cases, try the payout calculator.
Can I dispute my total loss claim?
That is a question about your own claim, not these class actions, and this page cannot answer it for your policy. Your policy and your state's insurance department set the dispute process. Note that joining the Colorado settlement releases claims about the Projected Sold Adjustment; anyone who wants to sue separately must opt out by November 5, 2026.
How do you file a complaint against Progressive Insurance?
A complaint is not a class action claim and does not get you a settlement payment. Complaints about how an insurer handled your claim go to your state's insurance department. To get money from a settlement, you file with that settlement's administrator by its deadline.
Is the Progressive Leasing settlement the same as Progressive Insurance?
No. Progressive Leasing is a lease-to-own company owned by PROG Holdings. Its $3,250,000 data breach settlement covered people who were sent a data-incident notice (notices began around October 23, 2023) after an incident around September 11, 2023. Claims closed January 22, 2026, and the court approved the deal on February 6, 2026.
I got a postcard or email about the Colorado settlement. Is it real?
The court-approved notice directs people to www.COTotalLossClaim.com and 1-888-808-1463, and to a mailing address at P.O. Box 301132 in Los Angeles. If the message points anywhere else, or asks for payment or your Social Security number, do not use it. Type the official address yourself rather than clicking a link.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
