The short answer: a Colorado settlement that pays only if you file

If Progressive declared your car a total loss on a Colorado policy in the last few years, the postcard or email about Curran v. Progressive is about a real settlement. As of September 30, 2026, the official site, COTotalLossClaim.com, run by the administrator Verita, says: “Total payments available are approximately $15,240,887. Members of the Settlement Classes who submit a valid and timely Claim Form are eligible for payment of 68% of the Projected Sold Adjustment (‘PSA’) Impact Amount for covered total loss claims.” The claim deadline is February 5, 2027. The deadline to opt out or object is November 5, 2026. Judge S. Kato Crews decides whether to approve the deal at a fairness hearing on January 6, 2027 in Denver.

This Progressive class action settlement is not automatic. The notice puts it in one line: “The only way to get Settlement Class Member Payment is to submit a timely and valid Claim Form.” It is also claims-made. Progressive does not fund a pot of $15.24 million; it pays the claims that are approved. The settlement agreement records that Progressive “would not have settled the Action except on a claims-made basis,” and money on checks nobody cashes goes back to the company. The $15,240,887 is the parties' estimate of what is “available to be claimed” — what Progressive actually pays depends on how many class members file.

The notices are out. The site now tells class members: “If you have already been identified as a Settlement Class Member from Progressive’s claims data, you have received an email notice and/or a postcard notice.” The schedule filed with the settlement gave Verita 75 days after preliminary approval to carry out the notice program. Preliminary approval came on July 8, 2026, so that deadline fell on September 21, 2026 (our arithmetic; the administrator has not published mailing dates).

Who is in the class, and who is not

There are two classes, one for each Progressive company in the case, and both are limited to Colorado. In the official wording, the Progressive Direct Class is “All persons who made a first-party claim for property damage to a motor vehicle on a policy of personal automobile insurance issued by Progressive Direct Insurance Company to a Colorado resident where the claim was submitted from April 12, 2019, through July 8, 2026, and Progressive Direct determined that the vehicle was a total loss and based its claim payment on an Instant Report from Mitchell where a Projected Sold Adjustment was applied to at least one comparable vehicle.” The Progressive Preferred Class is the same for policies issued by Progressive Preferred Insurance Company, with claims submitted from December 19, 2021 through July 8, 2026.

Four things follow from that definition. It is first-party only: the claim had to be on your own Progressive personal auto policy, so a car totaled and paid for by the other driver's Progressive policy falls outside it (our reading). It is Colorado-resident policies only, and only those two Progressive companies. The valuation must have come from a Mitchell report with a Projected Sold Adjustment on at least one comparable car — you do not have to work that out yourself; the notices went to people identified from Progressive's claims data. And the end date of July 8, 2026 is not arbitrary: the agreement defines the class period as running “through the date a Preliminary Approval Order is entered.” The class the court originally certified in 2023 covered only Progressive Direct claims through December 18, 2023; the settlement extends it by two and a half years and adds Progressive Preferred.

If you had more than one qualifying total loss, you file once: “A Claim Form submitted for a Settlement Class Member who has more than one claim shall constitute a Claim Form for all claims that meet the criteria.” If you think you qualify but received nothing, call the administrator at 1-888-808-1463 and ask for a claim form. A blank form needs your name, your current address and the address at the time of the loss if different, and the claim number or your policy number from the time — and “The name, address, and claim/policy number must match Progressive’s records in order for the claimant to be eligible for a Claim Payment.”

How much: 68% of a fixed share of your car's value

The payment is a formula, not a share of a pool. The settlement fixes the “PSA Impact Amount” at 2.75% of your vehicle's actual cash value for Progressive Direct policies and 2.25% for Progressive Preferred, and pays 68% of that. The value used is the one in Progressive's own data — the agreement names the column, “Valuation_ACVAmt” — not a new appraisal and not what you think the car was worth. In effect a claimant receives about 1.87% (Direct) or 1.53% (Preferred) of that value. By our arithmetic:

  • car valued at $10,000: about $187 (Direct) or $153 (Preferred)
  • car valued at $20,000: about $374 or $306
  • car valued at $30,000: about $561 or $459

That is the whole payment. The agreement says it is “the only payment to which Settlement Class Members are entitled” and is “deemed to be inclusive of any claims for any potentially applicable penalties and/or interest and/or fees.” Of the $15,240,887, the parties estimate $12,514,840 is available to the Progressive Direct Class and $2,726,047 to the Progressive Preferred Class.

The lawyers are paid on top, not out of the claimants' share. Class counsel will ask for up to $4,572,199 in fees — “30% of the total amount of funds made available to the Settlement Classes” — plus up to $200,000 in costs and service awards of $10,000 for Michael Curran and $5,000 for Andrew Rodriguez, the two class representatives. The notice: “These payments will not reduce the amount of money available to Settlement Class Members as they will be paid separately by Progressive. The Court may award less than these amounts.”

When the money comes: after the 2027 deadline, and Progressive can challenge claims first

Nobody is paid before the claim deadline has passed and the court's approval is final. The agreement's “Effective Date” requires, among other things, a final judgment, that “The Claims Submission Deadline has passed,” that the court has resolved the fee request, and that the judgment has become final. Then the claims go through several checks, each with its own clock:

  • An unsigned or illegible form, or one missing the claim or policy number, gets a deficiency letter and 30 days to fix it.
  • Within 30 days after the deadline (or the last cure deadline), Verita sends Progressive and class counsel the list of valid claims.
  • Progressive then has 30 days to flag claimants “it believes are not Eligible Class Members or are otherwise not eligible for a Claim Payment”; if it flags none by the 31st day, the list is final. Verita has 15 days to decide each challenge, Progressive may appeal a decision to the court, and it “shall not be required to pay any claim that is appealed to the Court unless and until the Court resolves the appeal in favor of the claimant.”
  • Progressive funds the approved claims within 30 days, and Verita pays within 60 days after that.

Every step is a maximum (“no later than”), so things can move faster. But if each one uses its full time starting from February 5, 2027, the last payments would go out around July 21, 2027 — our count, before any cure letters or appeals, which would push it later. Payment comes by check unless you choose an electronic method on the claim form, which asks for an email address where Verita can send “a link regarding electronic payment options.” Checks are valid for 180 days; you can ask for a new one within 30 days of the void date, and after that “any residual funds remaining in the Escrow Account due to uncashed checks shall be returned to Defendants.” If you move before then, tell the administrator, or “you may not receive your Settlement Class Member Payment.”

What to do, and the dates that matter

To claim (deadline February 5, 2027). Online at COTotalLossClaim.com with “your Claimant ID or Total Loss Claim Number and unique PIN” from the postcard or email, by 11:59 p.m. ET on February 5, 2027. The claim portal offers two routes, and both start with the Claim ID and PIN: file online, or download a personalized form to print and mail. Or sign the tear-off claim form attached to the postcard and mail it, postmarked by February 5, 2027, to Curran v. Progressive Settlement Administrator, P.O. Box 301132, Los Angeles, CA 90030-1132.

To opt out (postmarked by November 5, 2026). A signed letter to the same P.O. Box with the case name (Curran, et al. v. Progressive Direct Ins. Co., et al.), your full name, current address, phone number and a clear statement such as “I request exclusion from the Settlement Class.” You get nothing from the settlement but “will keep your right to sue Progressive separately in another lawsuit.” Each person must opt out individually, not as a group.

To object (postmarked by November 5, 2026). A Notice of Intent to Object with the case name and number, your name, address, phone number, signature and specific reasons. You cannot both object and opt out. To speak at the hearing you must write “Intention to Appear” on the letter and list your witnesses and legal authority.

If you do nothing, you get no money and still give up the claims: “If you do nothing, you will be bound by the terms of the Settlement and will release any legal claims against Progressive relating to the facts and circumstances alleged in the Class Action, including any legal claims arising out of Progressive’s settlement of a total-loss claim, even if you do not submit a Claim Form.” The release does not reach “any legal claims for personal injury, medical payment, uninsured motorist or underinsured motorist.”

What comes next in court. Under the schedule filed with the settlement, class counsel's papers for final approval and fees are due 30 days after the notice date — about October 21, 2026 — and responses to objections 60 days after it, about November 20, 2026 (both our arithmetic from July 8). The fairness hearing is set for January 6, 2027 at 10:00 a.m. in Courtroom A641 of the District of Colorado courthouse, 901 19th Street, Denver, CO 80294. Class members do not need to attend. The site warns that the court “may change the date or time of the Fairness Hearing without further notice.”

Is the postcard or email real?

A genuine notice points you only to the official channels: the site COTotalLossClaim.com (its footer reads “© Verita 2026”), the claim portal it links to on veritaconnect.com, the toll-free number 1-888-808-1463, the email address admin@COTotalLossClaim.com, and P.O. Box 301132 in Los Angeles. The administrator named in the settlement papers is Verita Global, LLC, “formerly known as KCC Class Action Services, LLC.” The notice states that “A court authorized this Notice. This is not a solicitation from a lawyer. You are not being sued.” Nothing in the notice or on the official site asks you to pay anything to file.

Three practical checks. The official claim portal will not open a claim without the Claim ID and PIN from the notice; if you have no ID, request a form from Verita rather than typing your details into another website. Do not call the court or Progressive — the notice says in capitals not to contact “THE COURT, THE CLERK OF THE COURT, OR PROGRESSIVE OR PROGRESSIVE’S COUNSEL REGARDING THIS NOTICE.” And do not be confused by the case number: court filings end in SKC-TPO, while the notice and website print SKC-TKO. It is the same case, 1:22-cv-00878 in the District of Colorado.

One detail for readers who check the documents: the file the site labels “Preliminary Approval Order” is the plaintiffs' unopposed motion of July 1, 2026 with a proposed order attached, its date line left blank. The court's docket, as indexed by CourtListener, shows an order on a class-certification motion on July 8, 2026, the date the class period ends. We have not seen the signed order itself; the deadlines on the official site match the proposed schedule counted from July 8.

How Colorado got here, and why the deal is claims-made

The case was filed on April 12, 2022. It alleges that Progressive's total-loss valuations, produced with Mitchell's WorkCenter Total Loss software, applied “an improper adjustment called the projected sold adjustment” — described in the Mitchell valuation method quoted by the court as “an adjustment to reflect consumer purchasing behavior (negotiating a different price than the listed price)” — so that policyholders were paid less than the actual cash value their policy promised, which the policy ties to “the market value, age, and condition of the vehicle at the time the loss occurs.” The two Progressive companies “deny and continue to deny all material allegations,” and they settled without admitting wrongdoing.

This was not a quick settlement. District Judge Nina Y. Wang certified a Progressive Direct class on December 18, 2023. The case moved to Judge Crews on January 19, 2024. He denied Progressive's motion for summary judgment, the Tenth Circuit declined to review the certification, and on May 27, 2026 he refused to decertify the class. Progressive had leaned on Clippinger v. State Farm, 173 F.4th 817, in which the Sixth Circuit, sitting en banc in 2026, reversed certification of a similar class over State Farm's “Typical Negotiation Adjustment.” Judge Crews was “not persuaded by the majority’s analysis in Clippinger” and wrote that the case “remains set for a jury trial to begin on June 22, 2026.” The settlement agreement is dated June 29, 2026, and the unopposed motion for preliminary approval followed on July 1.

That history explains the claims-made structure. Progressive's position, written into the agreement, is that its defenses are meritorious and “its chances of success on appeal in related cases are significant” (the agreement does not say which cases). Class members get a fixed percentage if they ask for it; the company keeps what nobody claims. Colorado is one state in a longer fight: in the May 27 order, Judge Crews relied on earlier rulings in Progressive cases over the same adjustment in Alabama (Reynolds), Georgia (Brown) and New York (Volino).
