The Anthropic Settlement Was Reported as $3,000 a Book. The First Payment Is $2,203.56 Per Work, Due by November 15 — and the Form That Went Out This Week Starts a 30-Day Clock on Who Gets What Share.

The $3,000 figure is real, and it is the court's. The final approval order describes “the estimated per-work payment of approximately $3,000” and calls it “four times the minimum statutory damages amount for willful infringement.” That estimate spreads the whole $1.5 billion across the roughly 500,000 works on the Works List, before fees and before anyone knew how many would be claimed. The first distribution cannot match it, because the whole $1.5 billion is not in the account yet.

The status report filed on September 2, 2026 (Docket 688) gives the balance: “The current balance in the escrow account, inclusive of July interest, is $1,074,903,166.44.” That is Anthropic's first $300 million, paid within five business days of preliminary approval; its second $300 million, paid within five days of final approval; and “Scheduled Payment 1” of $450 million, “paid on August 19, 2026” — plus interest on all three. The fourth and last instalment, “Scheduled Payment 2” of $450 million plus interest, “is due the earlier of September 25, 2027, or within 30 days of a qualifying funding event for Anthropic.” So the November distribution works from about 70% of the settlement.

From the roughly $1,083,000,000 counsel expects to be in the account by mid-November, including further interest, the following comes out first: 70% of the court's fee award of $101,561,111 — about $71,092,777.70, of which 10% (about $7,109,277.77) is held back until a post-distribution accounting is filed; $2,635,197.46 in court-approved expenses; $45,000 in service awards, $15,000 to each of the three named plaintiffs; and an $18,220,000 cost reserve for future administration, which cannot be spent without the court's approval. What is left, “approximately $991,007,024.84,” is divided over the final count of 449,731 claimed works: $2,203.56 per work, “subject to adjustments for further interest earned or late claims accepted.”

Two things follow. First, the remaining roughly 30% arrives in a later distribution, after Scheduled Payment 2, and only then does a work approach the $3,000 headline figure. Second, the fee award is smaller than the number that circulated during the objection period. Class counsel originally asked for 20% ($300 million), cut the request to 12.5% ($187.5 million), and were awarded $101,561,111 — “nearly 6.8% of the settlement fund” in the court's words, or about 3.75 times counsel's stated lodestar of $27,082,963.

Paragraph 6 of the status report is the one to read twice: “By September 4, 2026, the Settlement Administrator intends to send all claimants a consolidated form listing their percentage share of any settlement award(s), by work.” The shares “are based on the elections and determinations of the Class Members made during the claims process,” and the forms are going out “to ensure there is clarity prior to distribution. Claimants will have 30 days to contest the allocations.” Thirty days from a September 4 notice is about October 4; the operative date is the one on your own notice.

Paragraph 7 then splits claimants into two queues. “For works where all rightsholders are in agreement and where all necessary payment information is provided, the Settlement Administrator will process and send payments to Claimants on or before November 15, 2026.” For works “where multiple claimants do not (or do not yet) agree on the proposed per-work distribution,” the claimants go through “discussions facilitated by the Settlement Administrator or (absent agreement) utilization of the Court-appointed Special Master,” and their money “will be included in either the initial distribution or subsequent distributions.” A disagreement on one title does not hold up payment on your other titles; it holds up that title.

The Authors Guild's note of September 4 describes what the notice looks like — a Claim Number, a PIN and a link to a secure portal — and reports that some publishers had selected a 100% allocation by mistake and that the administrator was correcting those entries. TechCrunch reported on September 6 that authors had begun receiving emails showing publishers, and in some cases literary agents, claiming shares — including on works whose rights had reverted; the Authors Guild's chief executive, Mary Rasenberger, attributed the problems to bad record-keeping and a confusing process rather than intentional wrongdoing. We have not seen the individual forms and are reporting those accounts as theirs.

The default matters for the arithmetic. Under the plan of allocation as the Authors Guild summarises it, a work with a valid author claim and a valid publisher claim splits 50/50 by default; a self-published author who is the sole owner takes 100%. The final approval order describes the same mechanism as payment “based on either elected default splits (for non-education works only) or a percentage split determined by” the claimants. At the default split, a traditionally published author's share of the November payment on one book is $1,101.78.

The status report is unusually direct on this: “No Class Member or Objector filed a timely appeal.” What was filed, on August 18 and 19, were two notices of appeal by lawyers “who had been excluded from the fee award” — one from Edelson P.C. and Oppenheim + Zebrak, one from Cowan DeBaets Abrahams & Sheppard LLP. The Ninth Circuit has docketed them as Nos. 26-5391 and 26-5455. A separate document from objector Stacy Werner, styled a request to appeal or intervene and postmarked August 25, is described by class counsel as “not a notice of appeal,” with any notice she did file being untimely.

That distinction is the whole timeline. The settlement agreement's definition of the Effective Date (paragraph 1.15) carves out “appeal or appeals (other than ones solely with respect to the Fee Award and/or service awards).” Because both live appeals are about who gets fees, not about the settlement, “the Parties agree that the Effective Date of the Settlement has passed.” If the fee appeals needed money set aside, counsel notes, the outstanding $450 million “would be more than sufficient to cover it.”

One clause explains why the payment is November rather than September. The agreement says payments go out “within twenty-eight (28) days of the Effective Date, or such other subsequent date or dates as the Court may set or Class Counsel shall determine.” Thirty days after the July 20 judgment plus one business day would put the Effective Date around August 20, and 28 days after that is mid-September. The allocation forms and their 30-day window sit inside the “such other subsequent date” language, and that is what moves the first distribution to mid-November.

Open the notice, log into the portal with the Claim Number and PIN, and check the percentage share listed for each work. The Authors Guild says claimants whose shares are undisputed will simply be asked to confirm the details, and can update payment and address information there. The agreement offers three ways to be paid — Zelle, ACH direct deposit, or a check by mail — and anyone who chooses none of them is sent a check by First Class mail. If the split is wrong — a publisher claiming a reverted title, an agent listed where no agent has rights, a co-author's share entered backwards — contest it inside the 30 days. Nothing in the filing suggests the window will be extended.

Everything else is closed. The claim deadline was March 30, 2026; the opt-out and objection deadline was February 9, 2026; the re-inclusion deadline was March 9, 2026. Paragraph 11 of the status report says the administrator has received “late-claims requests from a small number of Class Members who missed the claims deadline” and that counsel will put those requests before the court “within the next two weeks.” That is a request, not a reopening.

The official website, anthropiccopyrightsettlement.com, still described the settlement as “preliminarily approved” when we read it on September 7; paragraph 10 of the status report says counsel will ask the court to approve updates to the home page and to the payment-timing FAQ.
