As of October 6, 2026, we found no class action or settlement accusing Fairview Health Services of sending website or MyChart data to Meta or Google. The wiretap suit — Niesen v. University of Minnesota Physicians — names M Physicians, the doctors' group that shares the Fairview MyChart login, not Fairview. There is no M Health Fairview settlement, no fund and no claim form.

What Is Actually on Record
People searching for an M Health Fairview MyChart lawsuit are usually mixing up three different things.
A tracking lawsuit — against M Physicians, not Fairview. On July 28, 2026 Margie Niesen sued University of Minnesota Physicians in federal court; the docket lists the federal Wiretap Act as the cause. M Physicians is one of the organizations listed on the same Fairview MyChart login page as M Health Fairview, which is why the two get confused. The details are on our M Physicians lawsuit page.
A data-breach case where Fairview was the plaintiff. After the February 2024 Change Healthcare ransomware attack, Fairview sued Change Healthcare to recover about $7 million in lost billing, mostly anesthesia. That was a business dispute, not a patient case, and Fairview dropped it in 2025.
An $84 million malpractice verdict. In early October 2026 the Star Tribune reported an $84 million malpractice verdict against Fairview in Hennepin County District Court over the handling of a patient's chest pain. That is an individual malpractice case. It has nothing to do with data or MyChart and creates no payment for other patients.
Case Details
Wiretap case (M Physicians): Niesen v. University of Minnesota Physicians, No. 0:26-cv-03438, U.S. District Court for the District of Minnesota, filed July 28, 2026, assigned to Judge Donovan W. Frank with Magistrate Judge Douglas L. Micko. The docket lists the cause as the Wiretap Act (18 U.S.C. § 2510 et seq.). The defendant's answer was due August 24, 2026.
Change Healthcare (Fairview as plaintiff): Fairview's suit started in Ramsey County District Court, moved to federal court and joined In re: Change Healthcare, Inc. Customer Data Security Breach Litigation, MDL No. 3108, before Judge Frank. On August 19, 2025 he dismissed Fairview's case (Civil No. 25-1457) without prejudice after Fairview voluntarily withdrew it. Patients whose data was in the Change breach have their own track in that MDL — see our Change Healthcare page.
A search of federal dockets on CourtListener for Fairview Health Services with pixel, wiretap and privacy terms returned no tracking or data-breach class action against Fairview. State-court filings are not covered by that search.
Status: No Fairview Tracking Case, No Settlement
Two things are worth knowing. First, the M Health Fairview Patient App privacy policy (effective January 23, 2022) says the app uses Google Analytics and may use cookies and pixel tags for usage and device data. That disclosure is not an admission of wrongdoing, and the policy says it does not cover HIPAA-protected health information. Second, on February 26, 2026 a dark-web monitoring blog reported a forum seller claiming to offer 70,000+ Fairview records from an internal employee directory, not a patient portal. Fairview has not confirmed that claim, as far as we found.
The organization itself is changing. Fairview, the University of Minnesota and M Physicians approved a new 10-year agreement in June 2026, taking effect January 1, 2027, and the M Health Fairview name is being phased down. A brand change does not end or move any legal claim.
Could You Be Affected?
If you used Fairview MyChart or the Fairview website: there is no Fairview class to be in. Nothing exists to join, and no deadline is running.
If you are an M Physicians patient: the docket does not say who, if anyone, the Niesen case covers, and no class has been certified. Our M Physicians page tracks it.
If your data went through Change Healthcare: that is a separate MDL, not a Fairview case.
What you can check yourself: the form on this page asks whether you used the website or MyChart, what you did there (booked an appointment, searched a condition, paid a bill, read results) and when you last did it. Those three facts are what decide eligibility in every hospital tracking settlement so far, so they are worth writing down now. Also keep any breach notice letter from Fairview or a Fairview vendor, with the envelope. And note: Fairview Hospital in Great Barrington, Massachusetts belongs to Berkshire Health Systems. Its June 3, 2025 employee-snooping incident is not an M Health Fairview data breach.
What Comparable Hospital Cases Paid
• Wellstar (Georgia): $4.25 million, claims due November 10, 2026 — Wellstar page.
• Christ Hospital (Ohio): $7,000,000 for more than 323,000 people, final approval granted — Ohio page.
• Cone Health: $1.765 million, of which $618,333 comes off the top before anyone is paid — our Cone Health report.
• SSM Health: paid $31.50 per claimant, claims closed November 25, 2025 — SSM Health page.
The pattern: as our MyChart payout report found, real portal checks have run about $15 to $50, not thousands. The MyChart settlement calculator shows how class size and fees shape that number.

Three Things to Watch For
A heavily searched MyChart name with no real settlement behind it attracts imposters:
“M Health Fairview MyChart settlement” claim sites
There is no Fairview tracking settlement, so there is no Fairview claim portal. A page asking for your MyChart login or Social Security number to “file” is collecting data, not filing anything.
Fake MyChart login pages and texts
Fairview MyChart is heavily searched, which makes lookalike login pages profitable. Type mychart.fairview.org yourself; for help, the number on the official login page is 1-855-513-5513.
Using the $84 million verdict as bait
The malpractice verdict comes from one individual case. Messages saying patients can “claim a share” of it, or that it funds a data payout, are false.
M Health Fairview Lawsuit — Questions People Actually Ask
Is there an M Health Fairview MyChart lawsuit?
Not against Fairview, as of October 6, 2026. The wiretap case filed July 28, 2026 (No. 0:26-cv-03438) names University of Minnesota Physicians, which uses the same MyChart login. See our M Physicians lawsuit page.
Has there been an M Health Fairview data breach?
We found no notified Fairview patient-data breach with a class action attached. Fairview was hit indirectly by the 2024 Change Healthcare attack, and a February 2026 dark-web listing claimed Fairview employee-directory data. That claim is unconfirmed. The Massachusetts Fairview Hospital incident involves a different health system.
What is the M Health Fairview lawsuit in the news right now?
Most likely the $84 million Hennepin County malpractice verdict reported in early October 2026. It is a single-patient case and pays nothing to other patients.
Is Fairview's patient portal MyChart?
Yes. It runs at mychart.fairview.org and one login covers M Health Fairview, University of Minnesota Physicians, Fairview Range and several affiliated clinics.
Does the app use Google or Meta tracking?
The M Health Fairview Patient App privacy policy says it uses Google Analytics and may use cookies and pixel tags. It does not mention Meta. No lawsuit has tested those practices.
Is there anything to sign up for?
No. There is no Fairview settlement or deadline. If a case is filed and settles, a court-appointed administrator notifies class members. Our MyChart claim form guide explains how real portal claims work.
Does the 2027 rebrand affect any claim?
No. The new partnership starts January 1, 2027 and renames hospitals, but a rebrand does not by itself end or move a legal claim.
What is worth doing now?
Note when you last used MyChart or the website and what you did there, keep any breach letter, and check our data breach settlement calculator if you received one from Fairview or a vendor.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
