Zyn Lawsuit: Where the Nicotine Pouch Litigation Actually Stands

Zyn, the nicotine pouch brand Philip Morris International acquired when it bought Swedish Match in 2022, faces two separate kinds of legal action: individual product-liability and deceptive-marketing lawsuits from people who say they became addicted to nicotine as minors, and government enforcement actions — led by the City of Baltimore — accusing the companies of deliberately marketing to teens. As of August 2026, there is no nationwide settlement, no certified class action, and no federal MDL. The first case set for trial, filed by Alannah Friedman, goes before a jury on December 7, 2026.

What the Lawsuits Allege: Deceptive Marketing to Minors

Two distinct types of legal claims target Philip Morris International, Swedish Match North America, and related entities over Zyn nicotine pouches. Personal injury lawsuits — filed individually, not as a certified class action — claim the companies marketed Zyn as a "tobacco-free" alternative to cigarettes using appealing flavors, social media influencers ("Zynfluencers," #Zynbabwe), and loyalty rewards programs that appealed to teenagers and young adults, causing users to become addicted to nicotine as minors. The complaints allege design defect, failure to warn, negligence and, as of a December 2025 ruling, deceptive trade practices tied to the "tobacco-free" label — since Zyn's nicotine is chemically derived from tobacco leaf. Separately, government enforcement actions — led by the City of Baltimore, which cites an internal Philip Morris strategy it calls "Project Sunrise" — accuse the companies of deliberately building "a new generation of nicotine users" as cigarette smoking declines. Baltimore's suit does not seek money for individual consumers; it seeks civil penalties and marketing restrictions. The District of Columbia settled a related investigation for $1.2 million in December 2024, and San Francisco has separately extracted several million dollars from online retailers of flavored nicotine pouches, including Zyn, since late 2025.

Case Details

The personal injury cases are proceeding individually in the U.S. District Court for the Southern District of Florida before Judge William P. Dimitrouleas — including Kelly v. Philip Morris International Inc. (No. 0:24-cv-60437), Palmer v. Philip Morris International Inc. (No. 0:24-cv-60522), and the cases of Nicholas Lendinara and Alannah Friedman. Judge Dimitrouleas ordered the four cases informally coordinated for shared discovery on May 30, 2025 — this is not a federal MDL (Multidistrict Litigation); as of the Judicial Panel on Multidistrict Litigation's August 3, 2026 report, no Zyn or nicotine-pouch MDL has been created. Separately, the City of Baltimore's enforcement suit — Mayor and City Council of Baltimore v. Philip Morris International, Swedish Match North America LLC, and Swedish Match USA, Inc. — is pending in Baltimore Circuit Court. There is no settlement administrator, official claims website, or class-wide hotline for either track, because no settlement or certified class exists yet.

Current Status: Active Litigation, Trial Set for December 2026 — No Settlement

As of August 2026, Zyn litigation remains a scattered set of individual and government lawsuits — not a consolidated mass settlement. The lead personal injury case, filed by Alannah Friedman, is scheduled for trial on December 7, 2026, with fact discovery closing June 26, 2026 and pretrial motions due July 24, 2026; the court has ordered mediation before trial. On December 16, 2025, Judge Dimitrouleas denied Philip Morris's motion to dismiss a deceptive-trade-practices claim over the "tobacco-free" label, letting that theory move forward. A separate antitrust lawsuit over nicotine-pouch pricing was dismissed in Philip Morris and Swedish Match's favor in September 2025 — unrelated to the youth-marketing allegations. Adding a wrinkle: on June 30, 2026, the FDA authorized Philip Morris to market 20 Zyn products with modified-risk claims stating that using Zyn instead of cigarettes lowers the risk of mouth cancer, heart disease, lung cancer, stroke, emphysema, and chronic bronchitis. Public health researchers and some physicians have criticized the timing, noting the authorization addresses relative risk for adult smokers and does not resolve — or even address — the separate allegations that Zyn was marketed to minors. No trial has concluded, no settlement fund exists, and no MDL has been formed.

Who Can File — and What 'Eligibility' Actually Means Here

Unlike a settled mass tort, there is no claim form to fill out and no deadline to meet — because no settlement exists yet. If you (or your child) began using Zyn as a minor and believe deceptive marketing — flavors, social media influencers, rewards programs, or the "tobacco-free" label — contributed to nicotine addiction or related health effects, the current path is to consult a personal injury or product liability attorney about filing an individual lawsuit, not to register for a payout. Most personal injury attorneys evaluate cases like this for free and work on contingency, so there's no upfront cost to have that conversation. Courts in the Southern District of Florida have so far allowed design defect, failure to warn, negligence, and deceptive-trade-practices claims from individual plaintiffs to proceed past initial motions to dismiss. An attorney can also tell you whether your state's statute of limitations still allows a claim — this varies by state and by when the alleged injury was discovered. Cities and states (Baltimore, the District of Columbia, San Francisco) have their own separate enforcement actions, but those do not create any right to a payment for individual consumers.

How Much Could a Zyn Lawsuit Be Worth?

Honest answer: nobody knows yet — there is no established payout structure, because no jury has ruled and no settlement has been reached in the personal injury cases. Unlike a class-action settlement fund with defined tiers, an individual Zyn lawsuit would be resolved through a jury verdict or a private settlement specific to that plaintiff's case, based on facts like age at first use, extent of addiction, documented health effects, and state law. The real dollar figures on the table so far went to governments, not consumers: the District of Columbia's $1.2 million settlement (December 2024) and San Francisco's multi-million-dollar recoveries from online flavored-tobacco retailers (late 2025 into January 2026) both resolved regulatory investigations, not individual injury claims. The first trial that could produce a real verdict number — Alannah Friedman's case — is set for December 7, 2026. Until then, any website or caller quoting you a specific settlement amount for a Zyn claim is not describing anything that currently exists.

Timeline: From First Lawsuits to the December 2026 Trial

  1. 1

March 2024 — First Zyn addiction lawsuits filed

Individual plaintiffs, including Zachary Kelly and Kovadis Palmer, sue Philip Morris International, Swedish Match North America, and related entities in the U.S. District Court for the Southern District of Florida, alleging deceptive marketing caused their nicotine addiction as minors.

  2. 2

    December 13, 2024 — D.C. Attorney General settlement

D.C. Attorney General Brian Schwalb announces Zyn's manufacturer will pay $1.2 million to resolve a government investigation into its marketing and sales practices — a regulatory settlement, not a consumer payout.

  3. 3

March 19, 2025 — Motion to dismiss mostly denied

Judge William P. Dimitrouleas allows the Kelly and Palmer plaintiffs' design defect, failure to warn, and negligence claims to proceed; fraudulent concealment and medical monitoring claims are dismissed without prejudice.

  4. 4

May 7-30, 2025 — Baltimore sues; four federal cases coordinated

The City of Baltimore sues Philip Morris and Swedish Match in Baltimore Circuit Court, citing an internal "Project Sunrise" strategy. Days later, Judge Dimitrouleas orders informal coordination of four individual federal lawsuits (Kelly, Palmer, Lendinara, Friedman) for shared discovery — not a formal MDL.

  5. 5

September 19, 2025 — Separate pricing lawsuit dismissed

Philip Morris and Swedish Match defeat an unrelated antitrust lawsuit over nicotine pouch pricing. This ruling does not affect the pending youth-marketing and addiction claims.

  6. 6

December 16, 2025 — Deceptive trade practices claim survives

Judge Dimitrouleas denies a second motion to dismiss, allowing a deceptive trade practices claim over Zyn's "tobacco-free" marketing label to move forward toward trial.

  7. 7

    June 30, 2026 — FDA authorizes reduced-risk marketing claims

The FDA authorizes Philip Morris to market 20 Zyn products with modified-risk claims comparing them favorably to cigarettes — a regulatory win critics say sidesteps the youth-marketing allegations still being litigated. Friedman's case remains on track for trial December 7, 2026.

Scam Alert: There Is No Zyn Settlement to Sign Up For

Because search interest in "Zyn lawsuit" is high but no group settlement exists, this is prime territory for misleading lead-generation sites and outright scams. Three patterns to watch for:

"Sign up now for your Zyn settlement payout" websites

Some sites and social ads imply a national Zyn settlement fund already exists and invite you to "register" with your name, address, and Social Security number. No such fund exists as of August 2026. These are typically lead-generation operations that sell your information to law firms — not a real claims process. Legitimate personal injury attorneys don't need your SSN for an initial conversation.

Robocalls and texts claiming you "qualify" for a set dollar amount

Mass-tort-adjacent spam calls and texts ("You may be owed up to $X from the Zyn lawsuit") follow the same script used for other addiction and injury litigation. No court or settlement has set any payout amount for Zyn claims — don't give personal or financial information to an unsolicited caller.

Fake "Zyn Settlement Administrator" emails

Because there is no settlement, there is no court-appointed administrator processing Zyn claims. Any email claiming to be one, asking you to "verify" bank details or pay a fee to "release" funds, is fraudulent. Report it at ReportFraud.ftc.gov.

Zyn Lawsuit FAQ

Is there a Zyn lawsuit settlement yet?

No. As of August 2026, no personal injury settlement or verdict has been reached in the Zyn addiction/marketing litigation. The first case scheduled for trial, filed by Alannah Friedman, is set for December 7, 2026. Two separate government settlements — $1.2 million to the District of Columbia (December 2024) and several million dollars to San Francisco (late 2025-January 2026) — resolved regulatory investigations and did not pay individual consumers.

Is there a Zyn class action or MDL?

There is no certified nationwide class action and, as of the Judicial Panel on Multidistrict Litigation's August 3, 2026 report, no federal MDL for Zyn or nicotine pouches. Four individual lawsuits are informally coordinated for shared discovery in the Southern District of Florida before Judge Dimitrouleas, but each plaintiff's case will be decided (or settled) on its own facts.

Can I still file a Zyn lawsuit?

If you began using Zyn as a minor and believe deceptive marketing contributed to nicotine addiction or related harm, you can consult a personal injury attorney about filing an individual lawsuit — there's no group claim form because no settlement exists. An attorney can also check whether your state's statute of limitations still allows you to file.

How much money will I get from a Zyn lawsuit?

Nobody can tell you an exact number yet. There is no settlement fund or payout schedule — any individual case would be resolved through a jury verdict or private settlement based on that plaintiff's specific facts. Be skeptical of anyone quoting a guaranteed dollar amount before a single case has gone to trial.

Did the FDA just say Zyn is safe?

No. On June 30, 2026, the FDA authorized Philip Morris to market 20 Zyn products with claims that using Zyn instead of cigarettes lowers the risk of several smoking-related diseases — a comparative claim aimed at adult smokers, not a declaration that Zyn is risk-free. It does not address, resolve, or relate to the separate allegations that Zyn was marketed to minors.

What is Baltimore's lawsuit about, and can I join it?

Baltimore's lawsuit, filed May 7, 2025, accuses Philip Morris and Swedish Match of an internal strategy ("Project Sunrise") to build "a new generation of nicotine users" through flavors, social media influencers, and rewards programs. It seeks civil penalties and marketing restrictions for the city — it does not create a payout for individual consumers, so there's nothing to "join."

Who are the defendants in the Zyn lawsuits?

Philip Morris International Inc., Swedish Match North America LLC, Swedish Match USA Inc., Philip Morris Global Brands Inc., and PMI Global Services Inc. Philip Morris International acquired Swedish Match, the original maker of Zyn, in 2022.
