The shareholder complaint alleges the IPO documents promised “rigorous safety standards” while concealing systemic safety problems. Case Details
The lead case is In re KinderCare Learning Companies, Inc. Securities Litigation, No. 25-cv-01424-AR, in the U.S. District Court for the District of Oregon. It began as Gollapalli v. KinderCare Learning Companies, filed August 12, 2025. Defendants are KinderCare, its IPO-era officers and directors, majority owner Partners Group Holding AG, and the IPO underwriters (Goldman Sachs, Morgan Stanley, Barclays and UBS). The consolidated complaint, filed February 6, 2026, claims violations of Sections 11, 15 and 12(a)(2) of the Securities Act of 1933. The lead plaintiff is the City of Dearborn Police & Fire Revised Retirement System.
A shareholder derivative suit was filed in the same court on March 24, 2026; it is stayed until the court rules on the motion to dismiss.
Parent suits are in state courts: one filed July 21, 2026 against a Culpeper, Virginia center, seeking $33,209,116 on 10 counts including fraud and the Virginia Consumer Protection Act; and one in Cook County Circuit Court, Illinois, announced June 16, 2026, involving the Crème de la Crème Glenview center.
