What the Siding Case Said, and What the New Cases Say
The homeowner case. The hardie board siding lawsuit most people mean was the federal multidistrict litigation In re: HardiePlank Fiber Cement Siding Litigation. Homeowners alleged that their HardiePlank siding faded and delaminated early. Those were allegations; they were never proven to a class-wide standard.
The investor cases. The James Hardie suits filed in 2025 and 2026 are about statements to the stock market. The U.S. complaint alleges that James Hardie made misleading statements about the strength of its North America Fiber Cement business “despite alleged customer inventory destocking” by distributors. The company says the claims are without merit. None of these cases claims your siding is defective.

The Minnesota siding MDL ended without a class: on January 2, 2018 the judge ruled that a proposed class of homeowners claiming premature fading and delamination could not be certified, and the court closed the MDL on August 31, 2018.
In the U.S. securities case, James Hardie filed a motion to dismiss on June 22, 2026, and the company said briefing was scheduled to be completed by October 5, 2026. As of October 8, 2026 we found no public ruling on that motion. Even if that case settles one day, the money would go to people who bought the stock, not to homeowners.

Three Things to Watch For
Investor-suit headlines that say “James Hardie class action” are easy to repackage as a homeowner payout:
“Claim your Hardie siding settlement” sites
There is no hardie board siding settlement and no claims portal for homeowners. A page that asks for your address, photos and Social Security number to “file” is collecting data, not filing anything.
Contractors pitching “free replacement through the lawsuit”
No class case pays to replace siding. Door-to-door or phone offers that tie a re-siding job to a lawsuit or settlement are sales pitches. Get the warranty answer from James Hardie in writing before you sign anything.
Shareholder ads that sound like they are for homeowners
Ads about the 2025 investor case are about stock purchases. You do not need to sign up to be in a class, and owning a house with Hardie siding does not make you a class member.
Hardie Board Siding Lawsuit — Questions People Actually Ask
Is there a class action suit against Hardie Board siding right now?
Not for homeowners. As of October 2026 there is no open hardie board siding class action in the U.S. The federal case over HardiePlank siding, MDL No. 2359 in Minnesota, closed on August 31, 2018 after class certification was denied.
What happened to the HardiePlank siding MDL?
On January 2, 2018, Senior Judge Michael J. Davis ruled that a proposed class of homeowners alleging premature fading and delamination could not be certified. Without a class there was no class-wide settlement, and the court closed the MDL later that year.
Is there a Hardie Board siding settlement or claim form?
No. There is no settlement, no fund, no administrator, no claim form and no deadline for siding owners. If you get a letter or email about one, check the case name and court before you reply.
Then what is the James Hardie class action in the news?
It is a shareholder case: Laborers’ District Council and Contractors’ Pension Fund of Ohio v. James Hardie Industries plc, No. 1:25-cv-13018 (N.D. Ill.), filed October 24, 2025. It alleges misleading statements about demand in the North American fiber cement business. There are related investor cases in Illinois state court and in Australia.
Can I join the investor case?
Only if you bought James Hardie common stock from May 20, 2025 through August 18, 2025. Class members do not need to register now. If there is ever a settlement, notice goes out through a court-appointed administrator.
My Hardie siding is cracking or peeling. What can I do?
Start with James Hardie’s written warranty for your product and installation year, and file a warranty claim with photos and your purchase and installation records. Installation errors are a common dispute in siding claims, so keep the installer’s paperwork. For a large loss, a construction-defect attorney in your state can tell you about deadlines.
Was there ever a Hardie siding settlement that paid homeowners?
We found none for HardiePlank siding. The New Zealand Harditex class action settled in August 2021 with no compensation for homeowners: the litigation funder paid James Hardie NZ$1.25 million.
Is Allura or another fiber cement siding settlement the same thing?
No. Settlements over other brands of fiber cement siding do not cover James Hardie products. Check the manufacturer name in any notice against the brand stamped on the back of your boards.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
