What the Lawsuit Said Happened

The lawsuit alleged that Duke University Health System embedded tracking tools, including the Meta Pixel, on its public website, the Duke MyChart patient portal and the MyDuke Health app. It alleged that these tools sent personal and health-related information to Meta when patients used Duke's online services.

The case traces back to a 2022 report by The Markup on pixel tracking at large hospital systems. At the time, Duke Health said it “did not transmit any of its patients' protected health information to Meta.” Duke denies all claims and all wrongdoing. The settlement ends the dispute without a ruling on who was right.

Case details

The case was filed on September 1, 2022 in the U.S. District Court for the Middle District of North Carolina as No. 1:22-cv-00727, before Judge William L. Osteen Jr. The original suit named Meta, Duke and WakeMed. The claims against Meta moved to In re Meta Pixel Healthcare Litigation in California (see our Meta Pixel lawsuit page). The claims against WakeMed went into a state court case (see WakeMed MyChart lawsuit).

What remained became Afrika Williams v. Duke University Health System, Inc. After the motion-to-dismiss ruling, claims for breach of contract and negligence went forward. Duke answered the amended complaint on May 20, 2024.

Status: Claims Closed, Judgment Entered August 27, 2026

Settled; the claim window closed on August 16, 2026. The opt-out and objection deadline was July 20, 2026. Both dates have passed, so you cannot file a new claim, and you cannot exclude yourself.

Judge Osteen granted preliminary approval on March 19, 2026. The final approval hearing was set for August 27, 2026. That same day, August 27, 2026, the docket shows entry 88, a “Judgment and Order.” As of October 15, 2026 we could not read that order or confirm a payment date: the official settlement website blocked our access. Money is paid only after final approval and the end of any appeal. We found no report of an appeal, but we could not rule one out.

Our deadline report from August 15, 2026 has the claim-filing details.

Who Is in the Settlement Class

You are a class member if you lived in the United States and Duke Health identified you as having logged into the Duke MyChart patient portal or the MyDuke Health app at least once between February 18, 2019 and June 17, 2022. Per court documents, that is 872,634 people.

Being in the class is not the same as getting paid. Only class members who filed a claim by August 16, 2026 get money. The official notice put it plainly: “IF YOU DO NOTHING, you will not receive Settlement benefits, but you will still be bound by the Settlement.”

How Much the Duke MyChart Settlement Pays

The fund is $3,743,600. Out of that come attorneys' fees of up to $1,235,388 (33%), expenses of up to $30,000, a $7,500 service award for the class representative, and notice and administration costs. That leaves roughly $2.47 million before administration costs.

Whatever remains is split pro rata among valid claims, so your check depends on how many people filed. The administrator has not published an estimate. Our own arithmetic, as upper bounds: about $28 per person if 10% of the class filed, $57 at 5%, $94 at 3%. If all 872,634 had filed, it would have been $2.83. Each class member gets at most one payment. People who filed online could choose an electronic payment (Venmo, PayPal or ACH). Mail-in claims are paid by check.

How cases like this one end

Our copy of the federal courts’ own case database covers 83,315 other statutory actions casesclosed in U.S. federal district courts between 2015 and 2026, 11.8% of them filed as class actions:

  • •25.6% ended in a settlement recorded by the court. Another 22.4% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 25.6% and 47.9%.
  • •7.4% were decided on a motion before any trial.
  • •1 in 156 reached a trial (0.6%), after a median of 21.8 months.
  • •Median time from filing to the end of the case: 4.9 months.
  • •Only 1,756 of them (2.1%) record a money award at all; the median of those is $199,500.

These are base rates for this type of case (federal other statutory actions cases) — not a prediction about this lawsuit, and not legal advice. Source: Federal Judicial Center, Integrated Database (civil), analysed by Settlement Insight. Cases heard in state courts are not included.

Three Things to Watch For

A closed claim window and a pending payment are exactly when imposters show up:

“Late Duke claim” or “reopen your claim” offers

The deadline was August 16, 2026. No site can add you now. Anyone charging to “get you into” the Duke MyChart settlement is selling something that does not exist.

Messages asking for your MyChart login or a fee

The administrator, Epiq, works from the Unique ID and PIN on your notice. Filing required only the Unique ID and PIN from your notice, so be wary of anyone who asks for more. If you are unsure about a message, call the number on the official site, (888) 893-8721, not the one in the message.

“Sign up for the MyChart lawsuit” ads

There is no national MyChart class action to join. Epic, which makes MyChart, is not the defendant here; Duke is. Ads promising a MyChart payout for any patient are usually collecting leads. See why your hospital is the defendant, not MyChart.

Duke MyChart Settlement — Questions People Actually Ask

Short answers to the questions people ask most about this case.

What is the Duke MyChart settlement?

It is the $3,743,600 class action settlement in Williams v. Duke University Health System, Inc., No. 1:22-cv-00727 (M.D.N.C.). It resolves claims that the Meta Pixel on Duke's website, Duke MyChart and the MyDuke Health app shared patient information with Meta. Duke denies wrongdoing.

Can I still file a Duke MyChart claim?

No. The deadline was August 16, 2026. The opt-out deadline was July 20, 2026. Both have passed. If you did not file, you get no payment, but you are still bound by the settlement.

Has the Duke MyChart settlement been approved?

The court granted preliminary approval on March 19, 2026. On August 27, 2026, the scheduled final approval date, the docket shows a “Judgment and Order” (entry 88). As of October 15, 2026 we could not read the order itself, so check the official site for the confirmed wording.

When will Duke MyChart settlement payments be sent?

No payment date has been confirmed to us as of October 15, 2026. Payments go out only after final approval and after the time for any appeal has run out. Online filers who chose Venmo, PayPal or ACH are paid that way. Everyone else gets a paper check at the address they gave.

What were the settlement amounts in the MyChart class action lawsuit?

There is no single MyChart lawsuit; each hospital settled its own case. Duke's fund is $3,743,600 for 872,634 class members. For comparison, Advocate Aurora Health's was $12.2 million for more than 2.5 million people (approved July 2024), and Novant Health's was $6.6 million for about 1.3 million patients (approved June 2024). Individual checks are a pro rata share, typically in the tens of dollars.

How much will I get from the Duke MyChart settlement?

It depends on how many valid claims were filed. After fees, expenses and the service award, about $2.47 million is left before administration costs. Our upper-bound arithmetic gives about $28 per person at a 10% claim rate and $57 at 5%. The administrator has not published a figure.

I lost my postcard. How do I check whether my claim went through?

Contact the administrator, Epiq, at (888) 893-8721 (weekdays) or by mail at Williams v. Duke University Health System, Inc., Settlement Administrator, P.O. Box 4214, Portland, OR 97208-4214. Your claim is tied to the Unique ID on the notice you received.

Did Duke admit it shared my data with Meta?

No. Duke denies all claims and all wrongdoing. In 2022 it said it “did not transmit any of its patients' protected health information to Meta.” The settlement is not a finding against Duke.
