The 'Average' Car-Accident Settlement Is Misleading: Half of 60,820 Real Payouts Were Under $5,000

We analyzed 60,820 government payout records. The $38,561 'average' is propped up by a handful of catastrophic cases — the median claimant got a fraction of it. Here is the real ladder, and what actually moves a claim up it.

The number everyone quotes is not the number most people get

Search for the average car-accident settlement and you will find figures between $20,000 and $40,000 repeated across law-firm websites. Our own payout database — 60,820 real traffic-accident payments from U.S. Treasury, NYC Comptroller, and City of Chicago records, totaling $2.35 billion — produces a similar 'average': $38,561.

But the median payout in the same records is $5,000. Half of all real claimants received less than that. The average is more than seven times the median, because a small number of catastrophic-injury cases pull the arithmetic upward while the typical fender-bender claim resolves for a few thousand dollars.

The real payout ladder

Percentiles are the honest way to read settlement data. In our 60,820-record dataset:

  • 25th percentile: $2,978 — quick, minor-injury resolutions
  • Median: $5,000 — half of all payouts fall below this line
  • 75th percentile: $11,259 — documented injuries, some negotiation
  • 90th percentile: $35,000 — serious injury, typically with representation
  • 95th percentile: $95,000 — severe or permanent injury

In other words: the widely quoted 'average' sits near the 90th percentile of what real claimants actually received.

The $23,000 preparation gap

A second dataset sharpens the picture. The National Association of Insurance Commissioners (NAIC) puts the national average insured bodily-injury claim at $28,919 (2022) — more than five times our records' median. The two datasets measure different worlds: government payout records include many unrepresented claimants filing directly against cities and agencies, while NAIC claims are negotiated against insurers, usually with documentation and often with an attorney.

Same category of injuries — a roughly $23,000 gap. Documentation, medical follow-through, and representation are not side notes in settlement math. They are most of it.
