Broken Bone Settlement Amounts: What the Records Actually Show
Reference Guide
There is no official “average settlement for broken bone” in the United States — private settlements are confidential, and any single number you see online is an estimate. What is public: court rulings that put dollar values on specific fractures, and New York's workers' compensation claim records. A heel fracture with plate-and-screw surgery was valued at $275,000 by a New York appeals court in 2024. A femur fracture with lasting spine and knee damage supported $4.8 million in 2025. This page shows those records and what moves a broken bone settlement up or down.

What Decides a Fracture Settlement
A fracture settlement is not priced by the bone. It is priced by what the break does to your life, and by who is responsible and insured. In comparable court cases, four things drive the number:
Treatment. A cast-and-heal fracture is valued very differently from one that needs open reduction and internal fixation (ORIF) — plates, screws or a rod — or a second surgery to remove hardware.
Permanence. Arthritis, restricted motion, a limp or a future fusion are what turn a five-figure case into a six- or seven-figure one. New York's own workers' comp form says it plainly: a schedule award “is given not for an injury sustained, but for residual permanent physical and functional impairments.”
Liability and coverage. A clear-fault car crash or a broken ladder supplied by someone else is a different case from a fall nobody caused. In a broken bone car accident settlement, the at-fault driver's policy limit often sets the practical ceiling.
Documentation. Imaging, operative reports, physical-therapy notes and wage records are the evidence. Courts in New York test pain-and-suffering awards against “relevant precedent of comparable cases” — so the medical detail is what gets compared.
Case details
Two published New York appellate decisions show how courts value fractures with surgery. Both are state-court personal-injury cases, not class actions.
Heel fracture, plate and screws (2024). In Czechowski v Wisniewski, 2024 NY Slip Op 01658 (Appellate Division, Fourth Department, No. 737 CA 22-01778, decided March 22, 2024), a ladder broke and the plaintiff fractured his left calcaneus. The bone was rebuilt with a plate and screws; he could not bear weight for about 10 weeks and was left with 25% restricted motion from arthritis. A jury awarded $60,000 past and $16,000 future pain and suffering. The appeals court found that inadequate and ordered a new damages trial unless the defendant agreed to $150,000 past and $125,000 future.
Femur and rib fractures, rod and screws (2025). In Aguilar v Graham Terrace, LLC, 2025 NY Slip Op 02564 (Appellate Division, Second Department, Index No. 15431/12, decided April 30, 2025), a worker fell 15 to 20 feet. The femur fracture required a rod and screws, a later surgery removed a screw, and he developed knee and spine problems, a limp and worsening arthritis. The jury awarded $1,500,000 past and $2,500,000 future pain and suffering plus $800,000 future medical costs. The trial court cut those to $800,000, $1,000,000 and $400,000; the appeals court reinstated the jury's figures as not deviating materially from reasonable compensation.

Our own count from New York Workers' Compensation Board open data (queried October 2026) shows how common work fractures are: 8,293 of the 270,328 claims the Board assembled in 2024 were coded as fractures — about 3.1%. The most frequent sites were multiple body parts (1,141), fingers (1,096), ankle (850), foot (845) and wrist (583). Falls, slips and trips caused at least 3,305 of them, about 39.9%.
Which Kind of Claim You Have
Car crash. You claim against the at-fault driver's liability insurance, and sometimes your own uninsured-motorist coverage. Use the car accident settlement calculator; state pages such as the Kentucky car accident settlement calculator cover local rules.
Fall on someone else's property. You must show the owner knew or should have known about the hazard. See the slip and fall settlement calculator. Fractures from falls in care facilities are covered on our nursing home abuse lawyer page.
At work. Workers' comp pays regardless of fault, but usually bars a lawsuit against your own employer. A third party — a driver, a ladder supplier, a property owner — can still be sued. See the workers' compensation calculator and the workers' comp settlement chart by body part. If you were fired after reporting the injury, that is a separate claim: wrongful termination lawsuit.
Deadlines. Every state sets a filing deadline for injury suits and for workers' comp claims, and they differ. Check yours on statute of limitations by state and workers' comp deadlines by state — and report a work injury to your employer in writing right away.
Broken Bone Settlement Amounts: The Numbers You Can Cite
1. Workers' compensation lost-time claims for fracture, crush or dislocation injuries averaged $66,467 for accidents in 2022–2023, against $47,316 for all claims (NCCI data, published by the National Safety Council's Injury Facts).
2. Of 9,198 New York workers' compensation claims coded as fractures and assembled in 2022, 818 (8.9%) had a Section 32 settlement recorded and 1,477 (16.1%) a schedule loss of use award date (New York Workers' Compensation Board open data, queried October 2026).
3. Among those 2022 New York fracture claims, a Section 32 settlement was recorded in 23.9% of claims with an attorney or representative (775 of 3,240) and 0.7% without one (43 of 5,958). Represented claims also tend to be the more serious ones, so this shows association, not the effect of hiring a lawyer.
4. In 2024 a New York appeals court valued a surgically repaired heel fracture with lasting arthritis at $275,000 in pain and suffering ($150,000 past, $125,000 future), up from a $76,000 jury verdict (Czechowski v Wisniewski, 2024 NY Slip Op 01658).
5. In 2025 a New York appeals court reinstated $4,000,000 in pain-and-suffering damages plus $800,000 future medical costs for a femur fracture repaired with a rod and screws that led to knee and spine surgery (Aguilar v Graham Terrace, LLC, 2025 NY Slip Op 02564).
In New York workers' comp, a permanent loss is paid against a fixed number of weeks: up to 312 for an arm, 288 for a leg, 244 for a hand and 205 for a foot (Board Form C-500). A partial loss gets a percentage of those weeks.
How a Fracture Claim Unfolds
Day of Injury — Imaging and Records
X-rays or CT scans fix the fracture type in the record. Photograph the scene, keep the crash or incident report, and get names of witnesses.
First Days — Notice and Claim
Report a work injury to your employer in writing; notify the at-fault driver's insurer or the property owner. Deadlines vary by state and claim type.
Healing Period — Months, Not Weeks
New York's Form C-500 lists healing periods of 40 weeks for a leg and 32 weeks for an arm, hand or foot. Settling before you know the outcome risks leaving permanent damage unpaid.
Maximum Medical Improvement
Once your doctor says you have healed as far as you will, lasting loss — restricted motion, arthritis, hardware — can be rated. That rating drives the value.
Offer, Schedule Award or Demand
Workers' comp may issue a schedule award; in a liability claim you or your lawyer send a demand with bills, wage loss and the medical record.
Settlement or Trial
Most cases settle. If one goes to trial, the jury's figure can still be raised or cut on appeal, as both New York cases above show.
Three Things to Watch For
Fracture claims attract quick offers and confident-sounding numbers:
An early offer with a full release
An insurer offering a check while you are still in a cast usually wants a signed release of all future claims. If arthritis or a second surgery follows, a signed release generally ends the claim.
“Average broken bone settlement” charts without a source
Charts listing a flat dollar range per bone rarely name a dataset, year or court. Ask where a number comes from — court decisions and agency data name themselves.
“Check if you qualify for fracture compensation” forms
There is no broken bone class action or fund. Online forms with that pitch are lead generators that sell your contact and medical details to whoever pays for them.
Broken Bone Settlement — Questions People Actually Ask
Short answers to the questions people ask most about this case.
What is the average settlement for broken bone injuries?
No court or agency publishes a national average, because most settlements are private. The closest documented figure is from workers' comp: lost-time claims for fracture, crush or dislocation averaged $66,467 for 2022–2023 accidents (NCCI, via the National Safety Council). Liability cases range far wider — from $275,000 to $4.8 million in the two New York appellate decisions above.
How much does a fracture cost?
For work injuries, the NCCI figure covers medical and wage benefits together: $66,467 per lost-time claim for fracture, crush or dislocation, versus $47,316 for all claims (2022–2023 accidents). We have not found a primary source for the medical bill of a fracture alone; your own hospital and insurer statements are the number that counts in a claim.
What is the average insurance payout for a broken leg?
There is no published average for a broken leg alone. In New York workers' comp, a permanent leg impairment is paid as a percentage of up to 288 weeks of benefits (Form C-500). In a liability case, the 2025 Aguilar femur-fracture verdict of $4.8 million is an outlier driven by later knee and spine surgery, not a typical figure.
Does surgery change what a fracture settlement is worth?
Usually, yes — but permanence matters more than the operation itself. In Czechowski (2024) the court stressed that the heel was rebuilt with a plate and screws and left 25% restricted motion; it raised a $76,000 verdict to $275,000. Plates, rods, hardware removal and arthritis are all documented in the record that gets compared.
How is a broken bone car accident settlement calculated?
Medical bills, lost wages and future care are added up; pain and suffering is negotiated on top, and fault and policy limits cap what is collectible. Our car accident settlement calculator walks through those inputs. No formula is binding on an insurer or a jury.
Do I need a lawyer for a fracture claim?
Not legally. In New York's 2022 fracture claims, 35.2% were represented, and those claims recorded a Section 32 settlement far more often — 23.9% versus 0.7%. That gap partly reflects that serious cases attract lawyers. Contingency fees and when representation pays off are covered on personal injury lawyer cost.
What is an injury settlement?
An agreement in which the responsible party or its insurer pays money and you give up the right to sue over the injury, usually by signing a release. In New York workers' comp, the equivalent lump-sum agreement is called a Section 32 settlement and must be approved by the Board.
What evidence makes a fracture claim stronger?
Imaging reports, operative notes, discharge papers, physical-therapy records, proof of missed work and a record of daily limitations. Both appellate decisions above turned on medical specifics: how many pieces the bone broke into, what hardware went in, and whether arthritis followed.
