What the Atrium Health Class Action Alleges
According to the court-approved notice, Atrium Health used pixel technology on its website and, between January 1, 2015 and July 31, 2019, inside its patient portal. The plaintiffs allege this sent personal and health-related information to third parties, including Meta and Google. Atrium denies that the technology is the basis for any claim.
When Atrium reported the tracking to federal regulators, it counted up to 585,959 patients, assuming every portal user in that window was affected. The data involved IP addresses and cookie identifiers, plus anything typed into web forms. The claims were breach of contract, breach of the implied duty of good faith, negligence, breach of fiduciary duty and unjust enrichment.
This is the “Atrium Health data breach” most people are searching for, but it is not a hack. A separate 2024 phishing incident is covered further down.
Case Details
The case is Julie Roberts, et al. v. The Charlotte-Mecklenburg Hospital Authority, No. 25CV057073-590, in the Superior Court of Mecklenburg County, North Carolina — a state court, not a federal one. The Charlotte-Mecklenburg Hospital Authority is the legal entity that does business as Atrium Health. According to The HIPAA Journal, several suits were consolidated into it. Atrium’s motion to dismiss was partially successful, but the case went forward.
Class counsel are David Wilkerson (Wilkerson Justus), David Almeida (Almeida Law Group) and Brandon Wise (Peiffer Wolf Carr Kane Conway & Wise). The administrator is Kroll Settlement Administration. The official site is AtriumHealthPixelSettlement.com.
Atrium has been part of Advocate Health since December 2, 2022. The older Advocate Aurora Health pixel settlement is a different case with a different class.
Status: Settled, Claim Deadline Passed
The final approval hearing was set for September 30, 2026. As of October 8, 2026, we could not confirm the result: the official settlement site blocked our access and we found no report of a ruling. Under the notice, payments go out only after final approval and after any appeals are resolved.
If you filed a claim, there is nothing more to do. If you did not, you cannot file now, and if you did not opt out you are bound by the release.
Who Is in the Atrium Health Settlement Class
The class is everyone living in the United States who had a MyAtriumHealth or MyCarolinas patient portal account between January 1, 2015 and April 10, 2024. Atrium, its affiliates and officers, and the judges on the case are excluded.
The class split into two groups. Group 1: you actually used the portal between January 1, 2015 and July 31, 2019. Group 2: you had an account in the longer window but did not use it in that earlier period. The administrator checks both against Atrium’s own records.
The class definition names only those two portals. We found no separate tracking lawsuit naming Atrium Health Wake Forest Baptist, Navicent or Floyd as of October 8, 2026. If you are unsure which portal you used or when you last logged in, our MyChart claim-form guide asks exactly that: website or portal, what you did there, and when.
What the Atrium Health Settlement Pays
Group 2 gets a separate amount of up to $300,000: up to $10 per person, reduced pro rata if too many people claim.
No per-person Group 1 figure has been published that we could confirm. It depends on how many valid claims came in. Some listing sites describe a $2.1 million settlement; the court notice says up to $1,800,000. Our MyChart settlement calculator shows how pro rata funds of this size shrink as claim counts grow.

Three Things to Watch For
A settled pixel case, a separate breach and a lot of copycat listings create easy openings:
“Late Atrium claims still accepted”
The claim deadline was September 28, 2026. A site or message offering to file a late claim for a fee, or asking for your Social Security number to “reopen” one, is not the administrator. The real claim form used the class member ID printed on the Kroll notice.
Fake MyAtriumHealth login links
Texts or emails saying you must log into MyAtriumHealth to “verify your settlement payment” are a phishing pattern. The administrator verifies portal use from Atrium’s records, not from your password. Go to the portal by typing the address yourself.
“Atrium phishing breach settlement” offers
We found no settlement in the 2024 phishing-incident lawsuits. Anyone collecting bank details for that “payout” is describing something we could not find. The only Atrium settlement with a claim process was the pixel case.
Atrium Health Lawsuit — Questions People Actually Ask
Is the Atrium Health MyChart lawsuit real?
Yes. Roberts v. The Charlotte-Mecklenburg Hospital Authority, No. 25CV057073-590, in Mecklenburg County Superior Court, settled for up to $1,800,000 over tracking pixels on Atrium’s website and patient portal. Atrium denies wrongdoing. The notice came from Kroll Settlement Administration and pointed to AtriumHealthPixelSettlement.com.
Is Atrium’s portal called MyChart?
Atrium’s portal is called MyAtriumHealth; it was formerly MyCarolinas. The settlement class is defined by those two names, which is why people searching “MyChart” land on this case.
Can I still file a claim?
No. The claim deadline was September 28, 2026 and has passed. The opt-out and objection deadline was August 31, 2026.
How much will I get?
Group 2 claimants get up to $10, possibly less if many people claimed. Group 1 claimants (portal used between January 1, 2015 and July 31, 2019) split what remains of $1,500,000 after fees, expenses, service awards and costs. No per-person Group 1 amount has been published that we could confirm.
When will payments arrive?
Only after the court grants final approval and any appeals are resolved. The hearing was set for September 30, 2026. As of October 8, 2026, we could not confirm the ruling, so no payment date exists yet.
Was there an Atrium Health data breach that was a hack?
Yes, separately. Between April 29 and April 30, 2024, a phishing campaign gave an outsider access to some employee email accounts; Atrium reported up to 32,120 people to HHS and offered credit monitoring. At least seven federal suits followed. All were closed on the federal docket by April 16, 2025, and we found no settlement.
I was treated at Wake Forest Baptist, Navicent or Floyd. Am I covered?
Only if you had a MyAtriumHealth or MyCarolinas account in the class window, and the administrator checks that against Atrium’s records. We found no separate tracking lawsuit naming those hospitals as of October 8, 2026.
Is this the same as the Advocate Aurora settlement?
No. Atrium joined Advocate Aurora to form Advocate Health on December 2, 2022, but the Advocate Aurora pixel settlement was a separate case with its own class, and it is also closed.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
