“AAA” is three different defendants in the news. As of October 2026: a AAA class action lawsuit over a driving-school data breach is pending with no settlement; a $4.15 million AAA settlement over New Mexico car insurance closed to claims on April 29, 2026; and a separate antitrust case targets the American Arbitration Association, which is not the auto club. None of them has an open claim form today.

The Three AAA Cases, Separated
1. The AAA data breach (AAA Northeast driving school). AAA Northeast’s Driver Training School told students in March 2026 that its driving-school software vendor had been accessed by an unauthorized third party in December 2025. A Massachusetts filing dated March 5, 2026 lists 25,247 affected people in that state alone. Exposed fields, per the notice and press reports: names, phone numbers, addresses, dates of birth and driver’s permit or license numbers. The company says the incident was limited to one vendor system. A class action was reported filed against AAA Northeast on April 8, 2026; it alleges the club failed to protect student data.
2. The class action lawsuit against AAA insurance (New Mexico). The suit alleged that AAA’s insurer reduced underinsured motorist claims by the amount the at-fault driver’s insurer paid, in violation of New Mexico law. AAA denied wrongdoing and settled for $4.15 million.
3. The American Arbitration Association. A proposed class action alleges the arbitration provider holds an illegal monopoly over consumer arbitration. The complaint claims an 88% market share and that consumers lose 76% of the time. These are allegations, not findings.
Case Details
Insurance settlement: Smith v. Interinsurance Exchange of the Automobile Club, No. 1:22-cv-00447-WJ-JMR, U.S. District Court for the District of New Mexico, filed June 13, 2022.
Arbitration case: Stephens v. American Arbitration Association, No. 2:25-cv-01650, U.S. District Court for the District of Arizona, filed May 15, 2025.
Data breach suit: filed against AAA Northeast d/b/a AAA Driver Training School. We could not verify the docket number from a readable court record, so we do not print one. A related vendor incident at DanubeNet Inc. (Driving School Solutions) was reported by the Automobile Club of Southern California on March 9, 2026; we found no lawsuit filed over that notice.
Status as of October 2026
New Mexico AAA settlement: closed to claims. The opt-out deadline was March 30, 2026, the claim deadline was April 29, 2026, and the court granted final approval on May 26, 2026. Payments go out after claim processing; we could not confirm a payment date.
Arbitration case: active. On March 31, 2026 the Arizona federal court denied the association’s motion to dismiss, so the antitrust claims proceed. No class has been certified and nothing is payable.

Are You Affected?
Data breach: you are in the proposed class if you got a breach notice from AAA Driver Training School or AAA Northeast about the vendor incident. Former driving students, including teens whose parents enrolled them, are the typical group. Keep the letter: it lists your exposed fields and holds your monitoring code.
New Mexico insurance: the class covered people who bought a New Mexico AAA auto policy with uninsured/underinsured motorist coverage, or whose underinsured motorist claim AAA reduced, between Jan. 1, 2010, and May 4, 2022. Premium-only members did not need to file a claim to be paid.
Arbitration case: the proposed class is US residents whose contracts name the American Arbitration Association as the only forum. You do not register for it.
Is There Money, and How Much?
New Mexico AAA settlement: the $4.15 million fund pays people whose underinsured motorist claim was offset up to $25,000 each, pro rata, from a pool of up to $1,400,000. Everyone else in the class gets a partial premium refund that depends on what they paid. Attorneys’ fees of $1,383,195 come out of the fund. If you missed the April 29, 2026 deadline with an offset claim, that track is closed.
Arbitration case: nothing payable.

Three Things to Watch For
A familiar brand, a closed settlement and a breach with no fund are an easy mix for imposters:
“Claim your AAA data breach payment”
There is no breach settlement, so there is no claim site. A page asking for your driver’s license number to “verify” you is collecting the exact data that leaked.
Late “New Mexico settlement” claim offers
The claim deadline was April 29, 2026. Anyone offering to file a late claim for a fee is not the administrator. The real administrator’s number is 877-268-1879; check any letter against it.
Fake AAA membership refund calls
Callers mixing up the auto club, its insurer and the arbitration association may promise a “AAA class action” refund for members. No court has ordered any member-wide payment.
AAA Lawsuit — Questions People Actually Ask
Is there a AAA settlement I can claim right now?
No. As of October 2026 no AAA case has an open claim form. The New Mexico insurance settlement closed to claims on April 29, 2026, and the data breach suit has not settled.
What is the AAA data breach lawsuit about?
A vendor that runs software for AAA Northeast’s Driver Training School was accessed in December 2025, exposing names, contact details, dates of birth and license or permit numbers. The class action alleges the club did not protect that data. The claims are unproven.
I got a breach letter from AAA. What should I do?
Activate the monitoring code in the letter, place a free credit freeze at all three bureaus, and keep the letter. For a minor, a freeze is also available. You do not need to join the lawsuit.
Is there a class action lawsuit against AAA insurance?
Yes, in New Mexico: Smith v. Interinsurance Exchange of the Automobile Club, No. 1:22-cv-00447. It settled for $4.15 million and received final approval on May 26, 2026. The claim deadline has passed.
When will New Mexico settlement payments arrive?
After the administrator finishes processing claims following the May 26, 2026 approval. We found no published payment date. Offset claims can pay up to $25,000; premium refunds are smaller and vary.
Is the American Arbitration Association the same AAA?
No. It is an arbitration provider, unrelated to the auto club. Its case, Stephens v. American Arbitration Association, survived a motion to dismiss on March 31, 2026 and is pending.
Was the Southern California auto club breached too?
The Automobile Club of Southern California reported a breach at its driving-school vendor DanubeNet Inc. on March 9, 2026 and offered two years of monitoring through Epiq. We found no lawsuit filed over it.
Do I have to sign up for a AAA class action?
No. If a class is certified or a settlement is reached, the court-appointed administrator notifies class members. Law-firm sign-up pages are retainer offers, not registration.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
