ZOLL Data Settlement Payout Date: Where the Money Stands
Questions about this case?
AI Legal Assistant · free · answers in seconds · general information, not legal advice
As of October 12, 2026, no ZOLL data settlement payout date has been announced. The final approval hearing was set for September 23, 2026, and we could not confirm that the court has signed a final approval order. The settlement agreement does fix the order of steps: payment comes within 30 days after the Effective Date, which itself cannot come before the appeal window closes. Only people who filed a claim by September 2, 2026 will be paid.

ZOLL Settlement Update: The Short Answer
This page covers only the payment. For the breach, the class definition and the claim rules, see our main page on the ZOLL data breach settlement.
Is it paying yet? No. As of October 12, 2026, the official site, HeartDeviceDataSettlement.com, still shows the final approval hearing as the latest step and lists a Proposed Final Approval Order among its court documents, not a signed one. The court records available to us show filings through September 23, 2026 and a sealing order on October 9, 2026, but no final approval order we could verify.
Who gets paid? Only people who submitted a valid claim. The settlement site is explicit: “If you do nothing, you will not receive benefits from this Settlement.” There are no automatic payments.
Case Details
The case is Smith et al. v. ZOLL Medical Corporation, No. 1:23-cv-10575, in the U.S. District Court for the District of Massachusetts, before Judge Indira Talwani. The court granted preliminary approval on May 5, 2026 (ECF No. 75) and appointed EisnerAmper as Settlement Administrator. Plaintiffs moved for final approval on August 27, 2026. The hearing, first set for September 10, 2026, was moved to September 23, 2026 at 2:30 p.m. ET in Boston.

Status: Claims Closed, Waiting on Final Approval
1. Final approval order and judgment. The judge must sign them. Until then there is no clock running.
2. The Effective Date. The agreement’s schedule puts it at “+30 days, assuming no appeal has been taken” from the order granting final approval. An appeal would push it back until the appeal is resolved. As of August 26, 2026, one class member had objected.
3. Funding. ZOLL pays the rest of the fund within 15 days of the Effective Date.
4. Payment. “Payment of Valid Claims, whether via mailed check or electronic distribution, shall be made by the Settlement Administrator within thirty (30) days of the Effective Date.”
So once a final approval order is entered, payment under the agreement would come roughly two months later if nobody appeals. Before that order exists, any specific payment date you see is a guess.
Who Gets Money and How to Check Your Claim
Paid: class members who submitted a valid claim form by September 2, 2026, online or postmarked by that date. As of August 25, 2026, EisnerAmper had received 48,767 claims, a 5.75% claims rate in a class of roughly 850,000.
Not paid: anyone who did not file, and the eight people who opted out. Missing the claim deadline cannot be fixed now.
Check your status with the administrator directly: email info@HeartDeviceDataSettlement.com or call 1-844-518-0188, and have the claim confirmation or ID from your submission ready. If your claim was incomplete, the administrator must give you 14 days to fix it before rejecting it, so open any letter or email from the administrator promptly.
ZOLL Data Settlement Amount: Estimates, Not Payments
Pro rata cash: an estimated $100 for SSN Subclass members (people whose Social Security numbers were potentially exposed) and an estimated $50 for everyone else. SSN members get two shares, others one. The final number depends on how many valid claims there are.
Documented losses: up to $5,000 per person, only with receipts or similar proof.
The $3.5 million fund shrinks before pro rata shares are calculated. Taxes, administration costs, service awards, attorneys’ fees and expenses, and documented-loss claims come out first. Class counsel asked for $1,166,666.67 in fees (one-third), $41,204.41 in expenses and $15,000 in service awards ($1,500 each). The court decides those amounts, and they set the real pool.
How cases like this one end
Our copy of the federal courts’ own case database covers 16,001 other personal property damage casesclosed in U.S. federal district courts between 2015 and 2026, 11.3% of them filed as class actions:
- 32.5% ended in a settlement recorded by the court. Another 19.5% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 32.5% and 52.1%.
- 5.9% were decided on a motion before any trial.
- 1 in 90 reached a trial (1.1%), after a median of 27.5 months.
- Median time from filing to the end of the case: 8.4 months.
- Only 250 of them (1.6%) record a money award at all; the median of those is $443,000.

Three Things to Watch For
A settlement that has closed claims but not yet paid is when payment-themed scams show up:
“Pay a fee to release your ZOLL payout”
Administration costs come out of the settlement fund itself. EisnerAmper does not charge claimants to receive money. Real contact comes from info@HeartDeviceDataSettlement.com, 1-844-518-0188 or P.O. Box 4089, Baton Rouge, LA 70821. Anything else, check with the administrator before you reply.
The Shields settlement mix-up
Searches for the ZOLL settlement payout often surface the Shields Data Incident Settlement, a different case with a different site. A ZOLL claim is not checked there, and a Shields notice says nothing about your ZOLL payment.
“Late claims still accepted”
The claim deadline was September 2, 2026. A site or message offering to file or reopen a ZOLL claim now, especially one asking for your Social Security number, is not part of this settlement.
ZOLL Settlement Payout — Questions People Actually Ask
What is the ZOLL data settlement payout date?
As of October 12, 2026, none has been announced. Under the settlement agreement, payment is due within 30 days after the Effective Date. The Effective Date follows the final approval order once the appeal period passes, about 30 days if no one appeals. We could not confirm that the final approval order had been signed after the September 23, 2026 hearing.
When to expect a settlement payment?
For ZOLL: no earlier than about two months after final approval, if there is no appeal. That is about 30 days to the Effective Date plus up to 30 days to pay. An appeal would delay everything until it is resolved.
How much is the ZOLL data settlement amount per person?
Nothing has been paid, so there is no actual figure. The official estimates are $100 for people whose Social Security numbers were potentially exposed and $50 for others, plus up to $5,000 in documented losses for those who claimed them. Estimates can go up or down.
Will I get paid automatically?
No. Only people who submitted a valid claim by September 2, 2026 are paid. Class members who did nothing are bound by the settlement but receive no money.
How will the ZOLL settlement payout be sent?
The settlement agreement provides for payment “via mailed check or electronic distribution.” The method you get depends on what you chose on your claim. We could not confirm which electronic options were offered.
What if my check expires or gets lost?
Checks are void 90 days after issuance and carry that warning. If yours becomes void, you can ask the administrator to reissue it, but only within 180 days after the Effective Date. After that, the request does not have to be honored.
What happens to money nobody cashes?
Under the agreement, money left after payments are made and the check-cashing period ends goes to one or more charities agreed by the parties, subject to court approval (cy pres). If money is still left more than 200 days after the first distribution, the agreement provides for a second, equal payment to claimants who cashed or deposited their first payment, as long as the average check would be at least $3.00. Anything still left more than 120 days after that goes to charity.
How do I get the latest ZOLL settlement update?
Check HeartDeviceDataSettlement.com, which posts court orders under Court Documents, or contact EisnerAmper at 1-844-518-0188 or info@HeartDeviceDataSettlement.com. Under the agreement, the site stays up until 90 days after the Effective Date.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
