What the Lawsuit Alleges

Between January 22 and 24, 2023, unauthorized actors accessed ZOLL Medical Corporation's internal network. The exposed files involved current and former patients who used — or were evaluated for — the ZOLL LifeVest wearable cardioverter defibrillator, and included names, addresses, dates of birth, Social Security numbers, and health information. The class action (Smith et al. v. ZOLL Medical Corp.) alleged ZOLL failed to implement reasonable data security for some of the most sensitive data that exists: cardiac patients' health records. ZOLL denies wrongdoing but agreed to a $3.5 million settlement.

U.S. District Court for the District of Massachusetts — Case No. 1:23-cv-10575. Settlement administered by EisnerAmper (heartdevicedatasettlement.com).

Current Status

Preliminary approval was granted May 5, 2026. The exclusion/objection deadline is August 3, 2026; the claim deadline is September 2, 2026; and the final approval hearing is set for September 10, 2026 in Boston. Checks have not been mailed — distribution follows final approval and any appeals.

Who Is Affected & Can You Join?

U.S. residents who received a notice from ZOLL about the January 2023 data incident. There are two subclasses: the SSN Subclass (your Social Security number was potentially exposed) and the Non-SSN Subclass. Eligibility is tied to ZOLL's breach-notification records — if you were a LifeVest patient around 2023 and received (or believe you should have received) a notice, check the administrator site.

Is There a Payout?

Pro-rata cash structure: SSN Subclass members are estimated to receive about $100; Non-SSN Subclass members about $50 — both figures come from the official FAQ and shift with the number of valid claims. Separately, both subclasses can claim up to $5,000 for documented out-of-pocket identity-theft losses (receipts required; self-written statements alone don't qualify). With a $3.5M fund for roughly a million notified patients, the flat payments only stay near the estimates if a small fraction files — file early and keep expectations realistic.

    January 2023 — Network Intrusion

    Unauthorized access to ZOLL's internal network January 22–24; unusual activity is detected January 28 and confirmed by forensic investigation in early February.

    March 2023 — Patient Notification

    ZOLL begins notifying affected LifeVest patients; at least seven class actions follow in the District of Massachusetts and are consolidated as Case No. 1:23-cv-10575.

    The court preliminarily approves the $3.5 million settlement; EisnerAmper is appointed administrator and notices go out.

Scam & Misinformation Warnings

'Heart device recall' robocalls

This settlement is about a DATA breach, not a device defect or recall. Calls claiming your LifeVest is being recalled and asking for payment data are scams — device safety questions go to your cardiologist, not a settlement line.

Fee-charging claim services

Filing is free at heartdevicedatasettlement.com. Nobody legitimate charges to file a $50–$100 claim for you.

Phishing for your SSN 'to verify your subclass'

The administrator already knows which subclass you're in from ZOLL's records. Emails or calls asking for your full Social Security number to 'confirm your higher payment' are identity theft attempts.
